That Special Use Permit approval included sev- eral site improvements to be completed by specific dates. Mr. Langkamp did not meet many of those original completion deadlines. After four amendments to the Special Use Permit, some work remains unfinished. A July 31, 2019 final deadline was adopted by City Council earlier this year. In addition, Mr. Langkamp is currently non-compliant with the most recent work completed on-site. Of the 153,824 square feet (3.5 acres) of pavement required in Zones 7 and 8, approximately 39,000 square feet was modified at the end of September 2018 and was inspected by City staff on October 3, 2018. City staff is of the opinion that the recent work, using a dust control binding agent rather than asphalt or concrete, does not conform to the City’s minimum pavement standards. The City’s Code, and that adopted by the Fire District, requires explicitly concrete or a minimum of a 6-inch base plus at least two inches of asphalt. Staff has reached out to the owner of Forming America but has not learned of any updates so far this year. ACTIONS PROPOSED: Review of Forming America’s current site improvement completion status.
