Mayor Ruben Pineda called the meeting to order at 7:00 pm. 2. Pledge of Allegiance to the Flag. Alderman Swiatek led all in the pledge of allegiance. 3. Invocation. City Administrator Guttman said since he has been on their Board, he has been working on this so rather than handshakes and verbal agreements, this action memorializes the responsibilities of each party. B. Ordinance 19-0-0036 — An Ordinance of the City of West Chicago, DuPage County, Illinois, Adding Article XXVIV Prohibiting Adult Use Cannabis Business Establishments Other Than Medial Cannabis Cultivation Centers and Medical Cannabis Dispensing Organizations, to Chapter 9 of the Code of Ordinance of the City of West Chicago Alderman Dimas made a motion, seconded by Alderman Hallett, to adopt the above item. During discussion, Alderman Dimas said this issue caused a lot of discussion in the community. She brought this forward to address tonight so if it is not wanted, then people will not have to come to three meetings. She will vote yes. Alderman Hallett said quite often representatives are told to vote their conscious, but tonight was different in which everyone heard their conscience from the speakers. He will also vote to approve. He later said everyone on the Council has given this a great deal of thought whether for or against the ordinance. He said he was proud to serve with them. Alderman Garling thanked everyone who came tonight and said the schools are opposed to use and he too is opposed to people using marijuana. Alderman Beifuss thanked everyone who came out tonight, and said they love our City. They feel so strongly that West Chicago goes in a good direction. He has heard from a variety of people and the consistent message is that it would make people’s jobs harder and to please not do that. Alderman Ferguson said he remembers when the City had a bad reputation and has heard from the community to opt out of marijuana sales. Alderman Chassee appreciated all who came here and spoke from the heart. She said the Council was not here to discuss the legalization of marijuana. That has already happened. Many of the things talked about tonight are out of the City’s control. People need to speak to their State representatives. People fear the unknown and think of when marijuana was provided by a criminal element. She has spent 30 years in law enforcement concerning crimes against children. She gave a number of examples of various studies that show regulations and education can reduce use and abuse. She also spoke of the financial benefits. The City cannot keep increasing taxes. Marijuana tax money can be earmarked for resources. Marijuana will be here even if it is not bought here. We will still have to train our first responders. It will become an ongoing battle. St. Charles will have the same costs, but they will get money from marijuana sales. We will be sending our neighbors and money to other communities. Alderman Chassee said she knows this is not a popular decision, but she would like to see this go forward to the Plan Commission to see what regulations could be had. Mayor Pineda said we would not be having this discussion except for the legislature in Springfield. It was forced on us. People should speak to their state representative. The Mayor said he grew up in West Chicago and would like to make this a better community to live in. He wants people to be proud of the fact that they live in West Chicago. He did not think the City needs marijuana dispensaries here. He did say the new developments in West Chicago will cost money and people do not want their property taxes to go up. But the increased revenues are not worth it to him as he wants a healthy West Chicago. He thanked all who sent him emails. Alderman Brown thanked everyone who came out this evening. She agreed with Alderman Chassee. Marijuana will be here on January 1, 2020. She is the parent of two children. She will be teaching her children at home to make sure they have the tools and knowledge and will be responsible for their actions. She said she had to echo Aldermen Chassee and Brown. She did not think marijuana is something we want our children to have. Whether it is sold here in West Chicago or not, it will be here. She said we need to regulate it and make it as safe as we can, and give the Police Department the resources to combat it. If the City opts out, it is losing resources. Alderman Birch-Ferguson thanked everyone for coming out. She said she remains concerned and would like to have a continuing discussion with the people. She thinks the issue needs to be considered. A service will be held for her on November 10, 2019, 9:30 am, at St. Michael's Church. The City Clerk announced that Shirley Siebert, the City Clerk of Wood Dale had also passed away. She was well known to City Attorney Bond. 13. Mayor’s Comments. The Mayor thanked the Aldermen for thinking long and hard and making a real deep decision for what has passed. Once completed Ball’s headquarters will contain about 90,000 square feet of office space. The proper- ty provides more than the required number of parking spaces. Ball will also provide substantial land- scaping around the innovation center, which has significant amounts of glazing to create and open-air feel to the interior. Burke Engineering, Ltd.), for Design-Build services related to the 1350 W. Hawthorne Lane Salt Storage Facility Project, for an amount not to exceed $2,834,320.00. Using various qualified sub-contractors, Burke, LLC proposal included construction of a 70’x120’ barn style salt storage building capable of storing approximately 6,000 tons of rock salt material, along with required site grading, parking lot improvements, utilities, fire alarm system, security fencing, site/building lighting, and assistance with obtaining required construction permits. Burke’s proposal/contract also included $25,000.00 for anticipated wetland banking and maintenance services. A stormwater management permit, and wetland banking and maintenance services, were anticipated to be required from DuPage County due to unavoidable impacts of special management areas (i.e., wetland areas). Unfortunately, DuPage County’s requirements, as a condition of its issuance of a Stormwater Management Permit issued for the project, are more substantial than originally anticipated. DuPage County is requiring restoration, enhancement, maintenance, prescribed burns management, monitoring, and annual reports, for a period of three (3) years, of the natural areas associated with the 1) the existing northwest compensatory storage basin constructed for the Water Treatment Plant, 2) the southeast wetland buffer enhancement area associated with construction of the salt storage facility, and 3) the newly constructed north-central basin constructed for the salt storage facility. Given the fact that DuPage County’s permit requirements are more than anticipated, at the City’s request, Christopher B. Burke Engineering, Ltd. (CBBEL) has provided staff with a maintenance and monitoring services proposal in the amount of $42,590.00 (see attached proposal). Under separate contract with the City, on Monday, September 17, 2018, the City Council approved Resolution No. 18-R-0076 authorizing the Mayor to execute a contract with RUN Group, Inc. of Wheaton, Illinois, for engineering construction oversight services related to the 2018 Sanitary Sewer Rehabilitation Project for an amount not to exceed $44,900.00. RJN’s main priority was to represent the City’s interests, coordinate with Kenny Construction, and provide project management and construction oversight services to ensure that work conducted by Kenny Construction Company and its subcontractors was completed in accordance with project schedules and specifications. During the project, Kenny experienced difficulties with its subcontractor(s) which resulted in substantial project delays; which resulted in the need for RUN Group to provide additional unplanned project management and construction oversight services. The additional engineering services resulted in an overall RUN contract cost increase of $19,921.21, bringing the total Contract amount to $64,821.21.
