Regular physical activity helps prevent risk factors for disease (such as high blood pressure and weight gain) and protects against multiple chronic diseases (such as heart disease, stroke, some cancers, type 2 diabetes, and depression); and WHEREAS, An individual’s decision to walk can be made easier by programs and policies that provide opportunities and encouragement for walking and by improvements to community walkability; and WHEREAS, Step /t Up! Mayor Ruben Pineda ===== PDF PAGE 5 ===== [Extraction: OCR (rendered-page OCR)] Mayoral Proclamation National Rail Safety Week WHEREAS, 2,220 rail grad crossing collisions resulted in 812 personal injuries and were responsible for 294 fatalities in the United States during 2019; and WHEREAS, 1,111 trespassing incidents have occurred in the United States resulting in 579 pedestrians being killed and another 532 injured while trespassing on railroad property rights of way during 2019; and WHEREAS, educating and informing the public about rail safety, reminding the public that railroad right of ways are private property, enhancing public awareness of the dangers associated with highway rail grade crossings, ensuring pedestrians and motorists are looking and listening while near railways, and obeying established traffic laws will reduce the number of fatalities and injuries; and WHEREAS, the International Association of Chiefs of Police, National Operation Lifesaver, United States Department of Transportation, and all local, state, county, and railroad law enforcement officers, first responders, and railroad corporations commit to partnering together in an effort to educate at a national level all aspects of railroad safety, to enforce applicable laws in support of National Rail Safety Week. Call to Order. Mayor Ruben Pineda (in person) called the meeting to order at 7:00 pm. The Mayor said it was determined that in person meetings are not practical or pertinent. 2. Pledge of Allegiance. Alderman Brown led all in the pledge of allegiance. 3. Invocation. There was no invocation. 4. Roll Call and Establishment of a Quorum. Roll call found Aldermen James E. Beifuss, Jr., Heather Brown, Jayme Sheahan, Alton Hallett, Michael D. Ferguson, Sandy Dimas, Melissa Birch-Ferguson, Christopher Swiatek, Jeanne Short, John E. During discussion, Alderman Garling pointed out that the sign would be directly below a power line, which he would rather not see a variance for at this time. Aldermen Beifuss had questions about the height of the proposed sign. Alderman Beifuss also would have liked to see this matter go to committee. Alderman Dimas said staff looked at various avenues to make it conforming and none were available except to be in the same place, so she thought it should go forward. Alderman Jakabcsin agreed. Alderman Beifuss was concerned that it is right near the sidewalk where people walk and bike. He asked if the City Administrator could give reasons for the height of the sign. City Administrator Guttman said he and Community Development Director Tom Dabareiner worked on this and gave the dimensions. The Mayor said staff worked on this matter and this is the best option. Alderman Short asked if it could fall again. That would be unlikely. The Mayor said if the Council rejects the variance, the owner can keep the old sign in perpetuity. Alderman Beifuss said the new sign is an improvement and he feels satisfied. Alderman Ferguson said the new sign will not be detrimental because it is being restored to its original state. Mayor’s Comments: The Mayor said everyone needs to be careful of the COVID-19 virus. He said he says this at every meeting because we do not want to go backwards. Businesses are open. He sent letters to some to make sure they are following the guidelines. Car shows cannot have more than 50 people, and no alcohol can be served. If we go back to Phase III it will jeopardize businesses in West Chicago. The Mayor said he is working with others and the county to get more information out to our residents. The last time these parking lots received a protective layer of sealcoat was 2016. Sealcoating of parking lot(s) is a tried and proven maintenance method to help preserve the integrity, visual appeal, safety, and durability of the property. It can be very costly to replace or fix the asphalt in the parking lot after harsh winter weather, but the City can save significant dollars by remaining proactive with its maintenance programs. When sealcoating is applied to a parking lot surface, it adds a protective layer that acts as a barrier between the harsh environment’s wear and tear, and the asphalt of your parking lot. There were six plan holders but only one bid was received. Heartland Recycling-Aurora CCDD, LLC of Aurora, Illinois, submitted the only bid of $55.00 per wet ton. This cost represents an increase of $7.75 per wet ton over the per ton project costs in 2018. Heartland Recycling-Aurora CCDD, LLC has provided waste lime sludge removal services for the City of West Chicago in 2008, 2013, and 2018, and performed well. Heartland’s references have been checked with positive comments received. A majority vote of the City Council is required to allow the Complaint to move forward for a Sanctions Hearing and determination. If a majority of the City Council agrees, in Executive Session, the Complaint shall be put in writing and presented to the Elected Official against whom the allegations are directed. Said Elected Official shall have the following rights in the Complaint process: The opportunity to respond to the Complaint; and The opportunity to participate in any informal resolutions of the Complaint; and The opportunity to have a Hearing on the Complaint; and The opportunity to speak to the nature of the Sanctions sought to be imposed in the event the City Council determines sanctions are appropriate, as provided for herein. AYN Neither the Elected Official making the Complaint, nor the Elected Official against whom the Complaint is directed, shall be subjected to any unjust treatment as a result of either filing the Complaint or being the Complainant. The accused Elected Official shall be given Notice of the Complaint and the Meeting scheduled to present the Complaint, no less than forty-eight (48) hours prior to the conduct of said Executive Session. An informal presentation of the Complaint shall be made to the whole City Council. The accused Elected Official shall have an opportunity to respond to the Complaint. Only information pertinent to the Complaint shall be discussed. If the matter is not resolved through the information discussion of the City Council and it appears as though the implementation of discipline may be warranted, the matter shall be advanced for a Hearing before the City Council, as provided for herein. Step II: Sanction Procedures When a violation is determined by the City Council to be serious enough to possibly warrant discipline of the Elected Official, the matter shall be scheduled for a Hearing before the City Council. The accused Elected Official shall be provided a copy of the written Complaint. A Hearing, in Executive Session, shall be scheduled by the Mayor at a time and date convenient for the accused Elected Official, however, in no event shall the Hearing be extended beyond a period of thirty (30) days, unless good cause is shown for said extension. The City Council shall present the information and evidence relating to the Complaint. The accused Elected Official will then be afforded an opportunity to respond to the information presented in support of the Complaint and to provide and offer any information or evidence in support of his or her defense to the allegations in the Complaint. Thereafter, the City Council will deliberate, in the presence of the accused Elected Official, and will determine whether sufficient information was provided to support the allegations in the Complaint and, if so, whether discipline of the accused Elected Official is necessary and/or appropriate. When a violation is determined by a vote of two-thirds (2/3) of the City Council Members present, including the Mayor, after affording the accused Elected Official an opportunity to be heard, the City Council may impose discipline, as provided for herein. Written Reprimand When it is determined that an Elected Official violates a rule, regulation, policy or procedure of the City Council, which violation or any such conduct impacts City operations, City Council relations or City Council/Staff interaction, which is more serious in nature or which is a continuation of a violation previously determined, after a Hearing, as provided for above, the City Council may impose a Written Reprimand against the Elected Official found to be in violation of same. The determination to impose said sanction must be approved by a vote of two-thirds (2/3) of the City Council Members present, including the Mayor. Meeting Suspension When it is determined that an Elected Official commits a serious violation of a rule, regulation, policy or procedure of the City, which violation or any such conduct has a serious impact on City operations, City relations or City Council/Staff interaction, and which is more serious in nature or which is a repeat or continuation of a violation previously determined, after a Hearing, as provided for above, the City Council may impose a Suspension of the Elected Official found to be in violation of same from a City Council Meeting or Committee of the Whole Meeting, the date of which Meeting, shall be specifically identified. The determination to impose said sanction must be approved by a vote of two-thirds (2/3) of the City Council Members present, including the Mayor. Step IV: Decisions Final It is understood that the Decision, as reflected in said vote of two-thirds (2/3) of the City Council Members present, including the Mayor shall be a final Decision.
