City Museum — City Administrator Michael Guttman explained the contract with Phalen Consulting, Inc. Ms. Sara Phalen did follow up with an explanation of the contract. Alderman Short suggested a change in hours to have more availability in the evenings and on weekends. Ms. Phalen did mention that she has been looking into extending the weekend hours. Mr. Guttman mentioned the contract will continue as presented. Ms. Phalen and Tom Dabareiner, Community Development Director, will talk about the extended hours and will report to the Committee. B. Video Gaming — Chief Fleury gave a report on information obtained from surrounding cities in the Dupage County area on video gaming. Data contains total number of machines, revenue and criminal activities. A survey was conducted with the business in West Chicago that hold liquor licenses and asked if they would be interested in having video gaming in their establishments. Out of the twenty businesses, eleven were interested, two were not, one is out of business due to Covid and the remaining were left messages for a call back with their vote. The direction of the Committee is to Staff is to take this discussion item to City Council with recommendations. Yes: Chairman Chassee, Alderman Brown, Birch Ferguson, Swiatek and Short. No: Alderman Hallett and Jakabesin. 1h New Business. A. The speeding on Sophia Street item was withdrawn from the agenda. The enforcement action taken has satisfied the person who had previously requested the enforcement. B. Alderman Short asked for additional traffic enforcement on the corner of Bishop and Forest. Chief Fleury will add additional enforcement at the intersection. 8. Reports from Staff. A. West Chicago Police Department Monthly Report. Chief Fleury will provide the Joliet Street study report. 9. These TASERs, model name X26P, were purchased from Axon Enterprises, Inc. (Axon) in piecemeal fashion between 2015-2018. Nine of our TASERS are no longer under warranty; the remaining six will be out of warranty within the next 12-24 months. Our TASERs are not subject to a service contract. Any supplies needed for these devices such as holsters, batteries, training/certification equipment and cartridges (these contain the charge, probes and conductive wires) are purchased on an as-needed basis. Axon currently offers an upgraded TASER, known as the TASER 7. The TASER 7 includes several desirable upgrades from the X26P. For instance, the TASER 7 has two cartridges loaded and available for use, while the X26P contains one. Further, one of the cartridges loaded in the TASER 7 is designed for close-quarter use (as close as 4’), while the second is specific to longer distances (11.5’ and greater). Additionally, the TASER 7 is designed to be stored in an internet-connected docking station. The docking station allows for daily download of data, charging of the battery and transmission of software updates to the device. The X26P, by contrast, is powered by a non-rechargeable battery, and data downloads/software uploads are done manually by staff on a quarterly basis. This process requires each X26P unit to be taken out of service, plugged into a computer and the resulting data downloaded and stored. To the point of data storage, the TASER 7 utilizes the same data storage platform as our Body Worn Cameras (BWCs) and in-car camera system (both of which are also Axon products). Finally, the proposed contract includes several advantageous provisions, including a warranty on the TASERs for the life of the contract as well as the cost of all replacement cartridges (both those needed for annual training, as well as those for use in the field) over the course of five years. Staff is requesting to enter into a Master Services and Purchasing Agreement with Axon for the purchase and use of Axon products and services associated with 15 TASERs for an amount not to exceed $75,749.97 (payable over the course of a five year contract). This proposed purchase will be made using money from the Drug Asset Forfeiture Fund, which is a restricted fund from which only eligible equipment purchases may be made; no personnel/benefit, non-police-related capital or other routine operating expenses may be paid from the Drug Asset Forfeiture Fund. Please see the attached Quote and Master Services and Purchasing Agreement for further information. (“Axon”). Agency will receive TASER 7 Conducted Energy Weapon (“CEW’”) hardware, accessories, warranty, and services documented in the attached Quote Appendix (“Quote”). 1 Term. The start date is based on the initial shipment of TASER 7 hardware (“Start Date”). If shipped in the first half of the month, the Start Date is the 1st of the following month. If shipped in the last half of the month, the Start Date is the 15th of the following month. The TASER 7 term will end upon completion of the associated TASER 7 subscription in the Quote (“Term’). If the Quote has multiple TASER 7 ship dates, each shipment will have a 60-month term, starting on the shipment of TASER 7 as described above. 2 Unlimited Duty Cartridge Plan. If the Quote includes “Unlimited Duty Cartridge Plan’, this section applies. Agency must purchase an Unlimited Duty Cartridge Plan for each CEW user. A CEW user includes officers that use a CEW in the line of duty and ones that only use a CEW for training. Agency may not resell cartridges received under any TASER 7 plan. Axon will only replace cartridges used in the line of duty. 3 Training. If the Quote includes a training voucher, Agency must use the voucher within 1 year of issuance, or the voucher will be void. During the Term, Axon will issue Agency a voucher annually beginning on the Start Date. The voucher has no cash value. Agency cannot exchange it for another product or service. If the Quote includes Axon Online Training or Virtual Reality Content (collectively, “Training Content”), Agency may access Training Content during the Term. Axon will deliver all Training Content electronically. Unless stated in the Quote, the voucher does not include travel expenses and will be Agency's responsibility. 4 Payment. Unless specified in the Quote, Axon will invoice Agency on the Start Date and then on the Start Date anniversary during the Term, if annual payments are elected. Payment is due net 30 days from the invoice. Payment obligations are non-cancelable. Agency will pay invoices without setoff, deduction, or withholding. Unless Agency provides Axon a valid and correct tax exemption certificate applicable to the purchase and ship-to location, Agency is responsible for all taxes associated with the order. 5 Shipping. Axon may make partial shipments and ship from multiple locations. All shipments are FOB shipping point via common carrier. Title and risk of loss pass to Agency upon Axon’s delivery to the common carrier. Agency is responsible for any shipping charges in the Quote. If the Quote includes future deliveries of hardware, Axon will ship hardware to Agency's address on the Quote. 6 Returns. All sales are final. Axon does not allow refunds or exchanges, except warranty returns or as provided by state or federal law. 7 Hardware Limited Warranty. Axon warrants that Axon-manufactured hardware is free from defects in workmanship and materials for 1 year from the date of Agency's receipt. Axon warrants its Axon-manufactured accessories for 90-days from the date of Agency's receipt. Used CEW cartridges are deemed to have operated properly. Non-Axon manufactured Devices are not covered by Axon’s warranty. Agency should contact the manufacturer for support of non-Axon manufactured hardware. If Axon receives a valid warranty claim for Axon manufactured hardware during the warranty term, Axon’s sole responsibility is to repair or replace the hardware with the same or like hardware, at Axon’s option. Replacement hardware will be new or like new. Axon will warrant the replacement hardware for the longer of (a) the remaining warranty of the original hardware or (b) 90-days from the date of repair or replacement. If Agency exchanges hardware or a part, the replacement item becomes Agency's property, and the replaced item becomes Axon’s property. Before delivering hardware for service, Agency must upload hardware data to Axon Evidence or download it and retain a copy. Axon is not responsible for any loss of software, data, or other information contained in storage media or any part of the hardware sent to Axon for service. 8 Warranty Limitations. Axon’s warranty obligations exclude damage related to (a) failure to follow instructions on product's use; (b) products used with products not manufactured or recommended by Axon; (c) abuse, misuse, intentional, or deliberate damage to the product; (d) force majeure; (e) products repaired or modified by persons other than Axon without the written permission of Axon; or (f) products with a defaced or removed serial number. To the extent permitted by law, the warranties and remedies set forth above are exclusive and Axon disclaims all other warranties, remedies, and conditions, whether oral or written, statutory, or implied, as permitted by applicable law. If statutory or implied warranties cannot be lawfully disclaimed, then all such warranties are limited to the duration of the express warranty described above and limited by the other provisions contained in this Agreement. Axon’s cumulative liability to any party for any loss or damage resulting from any claims, demands, or actions arising out of or relating to any Axon product will not exceed the purchase price paid to Axon for the product or if for services, the amount paid for such services over the prior 12 months preceding the claim. In no event will either party be liable for any direct, special, indirect, incidental, exemplary, punitive, or consequential damages, however caused, whether for breach of warranty, breach of contract, negligence, strict liability, tort or under any other legal theory. 9 Spare Products. For qualified purchases, Axon may provide agency a predetermined number of spare TASER 7 hardware as detailed in the Quote (“Spare Axon Devices”). Spare Axon Devices are intended to replace broken or non-functioning units while Agency submits the broken or non-functioning units through Axon’s warranty return process. Axon will repair or replace the unit with a replacement Axon Device. Title and risk of loss for all Spare Axon Devices shall pass to agency in accordance with the shipping terms under Section 5. Axon assumes no liability or obligation in the event Agency does not utilize Spare Axon Devices for the intended purpose. 10 Trade-In. If a trade-in discount is on the Quote, Agency must return used hardware and accessories associated with the discount (“Trade-In Units”) to Axon. Agency must ship batteries via ground shipping. Axon will pay the shipping costs of the return. If Axon does not receive Trade-In Units within the timeframe below, Axon will invoice Agency the value of the trade-in discount. Agency may not destroy Trade-In Units and receive a trade-in discount. If payment for TASER 7 is more than 30 days past due, Axon may terminate Agency's TASER 7 plan by notifying Agency. Axon will invoice Agency the remaining MSRP for TASER 7 products received before termination. If terminating for non-appropriations, Axon will not invoice Agency if Agency returns the CEW, battery, holster, dock, core, training suits, and unused cartridges to Axon within 30 days of the date of termination. 13.3. Agency will be responsible for payment of any missed payments due to the termination before being allowed to purchase any future TASER 7 plan. 14 Delays. Axon will use reasonable efforts to deliver products and services as soon as practicable. If delivery is interrupted due to causes beyond Axon’s control, Axon may delay or terminate delivery with notice. 15 Proprietary Information. Agency agrees Axon has and claims various proprietary rights in the hardware, firmware, software, and the integration of ancillary materials, knowledge, and designs that constitute Axon products and services. Agency will not directly or indirectly cause any proprietary rights to be violated. 16 Export Compliance. Each party will comply with all import and export control laws and regulations. 17 Assignment. Agency may not assign or transfer this Agreement without Axon’s prior written approval. 18 Governing Law; Venue. The laws of the state where Agency is physically located, without reference to conflict of law rules, govern this Agreement and any dispute that might arise between the parties. The United Nations Convention for the International Sale of Goods does not apply to this Agreement. 19 Entire Agreement. This Agreement, including the appendices, represents the entire agreement between the Parties. This Agreement supersedes all prior agreements or understandings, whether written or verbal, regarding the subject matter of this Agreement. This Agreement may only be modified or amended in a writing signed by the Parties. If a court of competent jurisdiction holds any portion of this Agreement invalid or unenforceable, the remaining portions of this Agreement will remain in effect. Agency Content includes Evidence but excludes Non-Content Data. “Evidence” is media or multimedia uploaded into Axon Evidence as ‘evidence’ by an Agency. Evidence is a subset of Agency Content. “Non-Content Data’ is data, configuration, and usage information about Agency’s Axon Evidence tenant, Axon Devices and client software, and users that is transmitted or generated when using Axon Devices. Non-Content Data includes data about users captured during account management and customer support activities. Non-Content Data does not include Agency Content. 2 Subscription Term. The TASER 7 Axon Evidence Subscription Term begins on the Start Date. 3 Access Rights. Upon Axon granting Agency a TASER 7 Axon Evidence subscription, Agency may access and use Axon Evidence for the storage and management of data from TASER 7 CEW devices during the TASER 7 Axon Evidence Subscription Term. Agency may not upload any non- TASER 7 data or any other files to Axon Evidence. Agency may not exceed the number of end- users than the Quote specifies. 4 Agency Owns Agency Content. Agency controls and owns all right, title, and interest in Agency Content. Except as outlined herein, Axon obtains no interest in Agency Content, and Agency Content is not Axon’s business records. Agency is solely responsible for uploading, sharing, managing, and deleting Agency Content. Axon will only have access to Agency Content for the limited purposes set forth herein. Agency agrees to allow Axon access to Agency Content to (a) perform troubleshooting, maintenance, or diagnostic screenings; and (b) enforce this Agreement or policies governing use of the Axon products. 5 Security. Axon will implement commercially reasonable and appropriate measures to secure Agency Content against accidental or unlawful loss, access, or disclosure. Axon will maintain a comprehensive information security program to protect Axon Evidence and Agency Content including logical, physical access, vulnerability, risk, and configuration management; incident monitoring and response; encryption of uploaded digital evidence; security education; and data protection. Axon agrees to the Federal Bureau of Investigation Criminal Justice Information Services Security Addendum. 6 Agency Responsibilities. Agency is responsible for (a) ensuring Agency users comply with this Agreement; (b) ensuring Agency owns Agency Content and no Agency Content or Agency end user's use of Agency Content or Axon Evidence violates this Agreement or applicable laws; and (c) maintaining necessary computer equipment and Internet connections for use of Axon Evidence. If Agency becomes aware of any violation of this Agreement by an end-user, Agency will immediately terminate that end user’s access to Axon Evidence. Agency is also responsible for maintaining the security of end-user names and passwords and taking steps to maintain appropriate security and access by end-users to Agency Content. Login credentials are for Agency internal use only and Agency may not sell, transfer, or sublicense them to any other entity or person. Agency may download the audit log at any time. Agency shall contact Axon immediately if an unauthorized third party may be using Agency's account or Agency Content or if account information is lost or stolen. 7 Privacy. Storage. Axon may place Agency Content that Agency has not viewed or accessed for 6 months into archival storage. Agency Content in archival storage will not have immediate availability and may take up to 24 hours to access. Location of Data Storage. Axon may transfer Agency Content to third party subcontractors for storage. Axon will determine the locations of data centers where Agency Content will be stored. For United States agencies, Axon will ensure all Agency Content stored in Axon Evidence remains within the United States. Ownership of Agency Content remains with Agency. Suspension. Axon may suspend Agency access or any end-user’s right to access or use any portion or of Axon Evidence immediately upon notice, if: 10.1. | The Termination provisions of the TASER 7 Terms and Conditions apply; 10.2. Agency or an end-user’s use of or registration for Axon Evidence (i) poses a security risk to Axon Evidence or any third party, (ii) may adversely impact Axon Evidence or the systems or content of any other customer, (iii) may subject Axon, Axon’s affiliates, or any third party to liability, or (iv) may be fraudulent; Agency remains responsible for all fees incurred through the date of suspension without any credits for any period of suspension. Axon will not delete any of Agency Content on Axon Evidence due to suspension, except as specified elsewhere in this Agreement. Axon Evidence Warranty. Axon warrants that Axon Evidence will not infringe or misappropriate any patent, copyright, trademark, or trade secret rights of any third party. Axon disclaims any warranties or responsibility for data corruption or errors before the data is uploaded to Axon Evidence. Axon Evidence Restrictions. All Axon Evidence subscriptions will immediately terminate if Agency does not comply with any term of this Agreement. Agency and Agency end-users (including employees, contractors, agents, officers, volunteers, and directors), may not, or may not attempt to: 12.1. copy, modify, tamper with, repair, or create derivative works of any part of Axon Evidence; 12.2. reverse engineer, disassemble, or decompile Axon Evidence or apply any other process to derive any source code included in Axon Evidence, or allow any others to do the same; 12.3. | access or use Axon Evidence with the intent to gain unauthorized access, avoid incurring fees or exceeding usage limits or quotas; 12.4. use trade secret information contained in Axon Evidence, except as expressly permitted in this Agreement; 12.5. access Axon Evidence to build a competitive product or service or copy any features, functions, or graphics of Axon Evidence; 12.6. remove, alter, or obscure any confidentiality or proprietary rights notices (including copyright and trademark notices) of Axon’s or Axon’s licensors on or within Axon Evidence; or 12.7. use Axon Evidence to store or transmit infringing, libelous, or otherwise unlawful or tortious material, to store or transmit material in violation of third-party privacy rights, or to store or transmit malicious code. After Termination. Axon will not delete Agency Content for 90 days following termination. During these 90 days, Agency may retrieve Agency Content only if all amounts due have been paid. Upon request, Axon will provide written proof that all Agency Content has been successfully deleted and fully removed from Axon Evidence. Post-Termination Assistance. Axon will provide Agency with the same post-termination data retrieval assistance that Axon generally makes available to all customers. Requests for Axon to provide additional assistance in downloading or transferring Agency Content, including requests for Axon’s Data Egress Services, will result in additional fees and Axon will not warrant or guarantee data integrity or readability in the external system. U.S. Government Rights. If Agency is a U.S. Federal department or using Axon Evidence on behalf of U.S. Federal department, Axon Evidence is provided as a “commercial item,” “commercial computer software,” “commercial computer software documentation,” and “technical data,” as defined in the Federal Acquisition Regulation and Defense Federal Acquisition Regulation Supplement. In the past several years, significant strides have been made in the delivery of law enforcement-related training using virtual reality (VR) technology. To that end, we are proposing the purchase of a VR system named “Apex Officer.” Apex Officer (hereafter, Apex), sold by GOVRED Technology, Inc., is an interactive crisis intervention, de-escalation and force options training simulator. The purchase of the Apex system will allow us to fulfill many State training mandates while providing a significant upgrade to the training we already receive. A study by Dr. Narendra Kini, CEO of Miami Children’s Health Systems, determined the use of VR technology to deliver training for certain medical procedures resulted in a retention level of 80% one year later. The Apex system is able to create thousands of different outcomes in hundreds of different scenarios because it is based on VR technology. Also factored into the decision to pursue the purchase of this system is the fact while use of force training is obviously important, exposing officers to situations in which force does not become necessary based on effective de-escalation efforts is of paramount importance as well. The Apex system allows training to be delivered in which not every scenario culminates with a use of force. This “shoot don’t shoot”/decision-based training is key to the continued development of a baseline mindset of our officers that de-escalation, when tactically appropriate, is the preferred approach to conflict resolution. Additionally, the Apex system allows officers to utilize and train with both lethal and less lethal equipment. The fact the system operates in a virtual world will allow us to deliver high-impact training without the associated cost for ammunition (which is becoming increasingly expensive with longer lead times to obtain) as well as reduce the likelihood of injury during training to officers. Blair St. The caller stated the victim was “in trouble” with law enforcement. The victim as directed to purchase $400.00 in Google Play Cards and provide the card information to the caller. The victim provided the card information to the caller. The victim was later requested to provide his social security and address information to the caller. Person(s) unknown emailed the victim at her residence in the 1600 block of Orchard Ct. The email appeared to be an invoice and had a number to call. The victim called the number and was convinced to purchase $700.00 in prepaid Best Buy cards and provide the suspect with the card numbers and redemption codes. Motor Vehicle Theft: Person(s) unknown removed a vehicle from a parking lot in the 1200 block of Kings Circle. The owner stated the keys were lost and the car had not been moved for about two weeks. The owner was also unsure as to if the car had been locked. Aurora Police Detectives advised the vehicle had been used in an Aggravated Battery with a Firearm incident in their city. Person(s) unknown removed a vehicle from The Crusher, located at 651 W. Washington St. The vehicle had been purchased at auction for $5,000.00 and left unsecured in the lot with a key fob under the front seat. Surveillance video shows a suspect entered the vehicle and removed it on August 6". Officer learned Lemont Police had run the vehicle’s plate on the 19". The vehicle had been parked in Lemont with the keys in the car for a week. The owner was notified and sent a tow truck to recover the vehicle. Theft of Cargo Container: Person(s) unknown removed a semi-trailer from a lot in the 1100 block of Harvester Rd. Burglary: Person(s) unknown entered the garage of a residence in the 800 block of Appletree Ln. The homeowners belatedly reported that on July 26" at 1 AM, a vehicle pulled into the victim’s driveway. Four subjects wearing ski masks and gloves exited the vehicle one possibly armed with what appeared to be a firearm. One suspect entered the victims’ unsecured vehicle parked in the driveway and utilized the garage door opener kept in the car. The other three subjects entered the garage. All four of the suspects are then seen quickly entering the vehicle they arrived in and then leaving the area. The only object known to have been taken was the garage door opener. Investigation is ongoing. Burglary from Motor Vehicle: Person(s) unknown entered the unsecured vehicle parked in the 300 block of S. Neltnor Blvd. Removed was a 35mm camera and a lens. The loss is estimated at $221.00. Investigation is ongoing. Person(s) unknown entered an unsecured vehicle parked in the 100 block of Ainsley Dr. Removed were two Bluetooth headphones valued at 4100.00 and a wallet valued at $50.00. When she went top pick them up, they were missing. Surveillance video captured the suspect removing the victim’s packages. Management was able to provide still photos and identify the suspect. The suspect was located, interviewed, admitted to the theft and was issued a local ordinance citation for Theft. Person(s) unknown removed the victim’s bicycle from the gazebo at Reed Keppler Park located at 241 W. National St. The owner left the BMX bicycle valued at $300.00 unsecured while he went swimming. When he returned, the bicycle was missing. Theft of Lost/Mislaid Property: Person(s) unknown removed the victim’s wallet from the 900 block of Lorlyn Dr. The victim had placed items on the ground before entering the apartment. She picked up the items and entered the building, later realizing the wallet was left outside. Returning to retrieve the item, it was found to be missing. The wallet contained $130.00 U.S.C, a debit card and Mexican Metricula card. The victim learned the debit card had been used for a $1.83 purchase at Mr. A’s Liquors and for $29.01 at the Citgo gas station. Investigation is ongoing. Theft of Motor Vehicle Parts/Accessories: Person(s) unknown removed the catalytic converters from two vehicles parked at a business in the 800 block of Industrial Dr. Person(s) unknown removed the catalytic converter from a vehicle parked in the 1600 block of Downs Dr. Person(s) unknown removed the catalytic converter from a vehicle parked in the 100 block of Wycliffe Dr. Aggravated Assault: A known person is alleged to have confronted the victim while armed with a handgun at a residence in the 600 block of Sherman St. The victim stated he was in the house when the suspect entered possessing a firearm and stated he was “ready to shoot” the victim. The victim left then for work and no one was at the residence when officers arrived. Oak St for a report of bullet hole found in a garage door. Officers located a spent bullet and two shell casings near the residence. While conducting a canvas of neighbors in the area, officers learned that gunshots were heard and around that same time a white SUV was seen driving through the area. Information was received that a resident who was in the area may have been targeted in the shooting. Detectives Calabrese and Flanigan interviewed two individuals. One denied being shot at. The second person admitted that she had been in the area with another individual who engaged in an argument with suspects who exited a white SUV with a black hood. The suspect returned to the vehicle, produced a handgun and fired two rounds at the victims before fleeing scene. Detectives were able to obtain surveillance video from a residence in the 1200 block of Oak St showing the white SUV with a black hood. The vehicle was recognized as frequenting West Chicago driven by a specific individual. On August 3, this vehicle was observed and stopped in the area of Oak St. and Forest Ave. Detectives Calabrese, Flanigan, Herbert and Bowers and Officers Alaniz and O’Neil all arrived to assist as the SUV was occupied by four individuals and a strong odor of cannabis was emanating from the vehicle. The driver was known to have a suspended license and was placed under arrest. The occupants were removed and a search of the vehicle located three loaded handguns. All occupants were placed under arrest and transported to the Police Station. The DuPage County State’s Attorney’s Office approved charges of Aggravated Unlawful Use of a Weapon and Possession of a Stolen Firearm against one offender and Aggravated Unlawful Use of a Weapon and Unlawful Use of a Weapon against a second suspect. As juveniles, they were both transported to the Kane County Youth Home. In December 2019, a subject purchased a Mercedes Benz from Haggerty Ford. It was later learned the purchase had been made utilizing fictitious documents. The vehicle was later recovered in Lansing. In attempting to identify the offender, Detective Herbert uncovered an elaborate operation involving stolen identities, fraudulent credit applications, and fraudulent driver’s license and social security card manufacturing. The crimes perpetrated by the offenders occurred in DuPage, Cook and Lake Counties as well as into to Wisconsin, Iowa, Indiana and Michigan. Those involved in these crimes included sales associates with car dealerships and low-level street crime offenders, all led by a lead suspect from Lansing. The suspect has a lengthy criminal history including a conviction for murder. Detective Herbert along with a Barrington detective continued working the case. As the evidence against the main suspect mounted, Detective Herbert reached out to the Illinois Attorney General’s Office and U.S. Secret Service for assistance. In January of 2021, a large multi-jurisdictional operation led by Detective Herbert and Barrington’s detective recovered several stolen vehicles, driver’s license manufacturing equipment and cash. The main suspect fled the area but was later arrested in Indiana for possession of a stolen motor vehicle and released on bond before fleeing to Atlanta. Detective Herbert received information on August 29" that the offender may have returned to the Lansing area. On august 30", Detectives Herbert, Flanigan, Calabrese, the Barrington detective and other investigators began surveillance near the suspect’s home. Detective Herbert observed the suspect outside a residence and asked for assistance from other agencies. The U.S. Secret Service, the U.S. Marshalls, Lansing PD and Barrington PD assisted with taking the suspect into custody on a $1,000,000.00 warrant. The Illinois Attorney General’s Office approved charges against the suspect including Identity Theft, Aggravated Possession of a Stolen Motor Vehicle and Being the Organizer of a Continuing Financial Crimes Enterprise. In total, the suspect was charged with two Class X, three Class 1 and one Class 3 felonies. Detective Herbert’s efforts in this case resulted in a 26-count indictment, including a total of five Class 11 ===== PDF PAGE 47 ===== [Extraction: OCR (rendered-page OCR)] X felonies against the lead suspect and seven of his accomplices. Assisting in the case were all WCPD Detectives, TFO Potapezak, Officer’s Levato, Fuller, Nielsen and CSO/Evidence Custodian Fabiani. On August 4", Officers Kowalik and Smurawski responded to a residence in the 1600 block of Appletree Ln. A victim there had been battered by her ex-boyfriend who then fled the scene. The victim was bleeding profusely and was transported to Northwestern Medicine Central DuPage Hospital by West Chicago Fire Protection District personnel for treatment. Medical personnel advised the victim had suffered a left orbital wall fracture, spinal fracture, scalp contusion and knee and elbow abrasions. Due to the severity of the injuries, the DuPage County State’s Attorney’s Office approved charges of Aggravated Domestic Battery against the suspect. Detective Peterson obtained an arrest warrant for the suspect with no geographic limitations. Detective Herbert and Officer Kowalik made unsuccessful attempts to serve the warrant on the suspect at both his residence and place of employment. Due to the difficulty in locating the offender, Detective Herbert requested that the suspect’s cell phone be “pinged”. The return on the location came back to a specific area in Jacksonville, Florida. A search of records of calls made on the offender’s cell phone determined that the suspect had called an individual who lived at an address in the 12200 block of Amanda Cove Trail in Jacksonville. The Jacksonville Sheriffs Office was contacted, advised of the no bond warrant and agreed to conduct surveillance on the Cove Trail residence. On August 25", the offender was arrested on the warrant as he exited the residence and taken to the Jacksonville County Jail where he will be held pending extradition back to Illinois. 12
