Ordinance No. 22-O-0004 has been drafted accomplish this objective, correct the scrivner’s error, and satisfy State statutory requirements. COMMITTEE RECOMMENDATION: N/A ===== PDF PAGE 57 ===== [Extraction: OCR (rendered-page OCR)] ORDINANCE NO. 22-0-0004 AN ORDINANCE OF THE CITY OF WEST CHICAGO, DUPAGE COUNTY, ILLINOIS AMENDING ORDINANCE NO. 21-0-0042 CALLING FOR A PUBLIC HEARING AND A JOINT REVIEW BOARD MEETING TO CONSIDER THE DESIGNATION OF A REDEVELOPMENT PROJECT AREA AND THE APPROVAL OF A REDEVELOPMENT PLAN AND PROJECT FOR THE DOWNTOWN TAX INCREMENT FINANCING DISTRICT NO. 2 TO CORRECT SCRIVENER’S ERRORS THEREIN WHEREAS, the City of West Chicago (“City”) is a home rule unit of local government pursuant to Section 6 of Article VII of the Constitution of the State of Illinois, and has the authority to exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and WHEREAS, the Mayor and City Council of the City adopted Ordinance No. 21-O- 0042 on January 3, 2022, entitled, “An Ordinance Of The City Of West Chicago, DuPage County, Illinois Calling For A Public Hearing And A Joint Review Board Meeting To Consider The Designation Of A Redevelopment Project Area And The Approval Of A Redevelopment Plan And Project (Downtown Tax Increment Financing District No. 2)” (“Ordinance No. 21-O-0042”); and WHEREAS, a scrivener’s error has been noted relative to the date of the public hearing called for in Ordinance No. 21-O-0042, in Section 2 and Exhibits B and C thereof, as the public hearing date has been set on February 21, 2022, not February 7, 2022, as noted in Ordinance No. 21-O-0042; and WHEREAS, the City properly mailed notice within the time required, and will properly publish notice within the time required, of the public hearing on February 21, 2022, and it is in the best interests of the City and the public to correct said scrivener’s error, although said scrivener’s error does not affect the validity or legality of the public hearing and Joint Review Board meeting set in Ordinance No. 21-O-0042; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF WEST CHICAGO, DUPAGE COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: Incorporation. That the recitals above shall be and are hereby incorporated in this Section 1 as if restated herein. SECTION 2: Scrivener’s Errors Corrections. That all other provisions of Ordinance No. 21-O- 0042 not corrected herein, shall remain in full force and effect. SECTION 4: Ratification. That all actions of the City, its elected officials, employees and agents related to Ordinance No. 21-O-0042 and the “TIF District,” as defined therein, are ratified, confirmed and approved. SECTION 5: Severability. That if any Section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such Section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 6: Repeal. That all ordinances, resolutions, motions or parts thereof in conflict with this Ordinance shall be and the same are hereby repealed. SECTION 7: Effect. That this Ordinance shall be in full force and effect upon its adoption, approval and publication in pamphlet form as provided by law. PASSED this 17" day of January, 2022.
