Discussion of Sanitary Sewer System Evaluation Survey (SSES). Mr. Patel explained that in 2010 the City completed its first professional services contract to perform a Sanitary Sewer Evaluation Survey (SSES). The primary purpose of an SSES is to find defects in the sanitary sewer collection system to reduce the Inflow and Infiltration (I/I). Five additional SSES studies were conducted in the years following 2010, which identified defects in the system. Some of these defects have been addressed but a majority are still outstanding. As of May 2021, the repair costs on the public side are estimated to be $5.8 million and $2.1 million on the private side. I/I is water that ultimately makes its way to the Wastewater Treatment Plant (WWTP) but does not need to be treated. It jeopardizes the sanitary sewer collection system by reducing the capacity of the pipes. The additional flow can also result in flooding and basement backups, which can lead to the need for larger sewers and/or treatment plant capacity expansion, as well as increased sewer fees to offset the additional WWTP operations costs. Mr. Patel explained that the current options are to do nothing (not feasible), address deficiencies on the public side, or address both public and private deficiencies. He recommended addressing deficiencies on the public side, including sanitary sewer cured in place pipe, manhole lining, and 5-feet lateral lining. Following discussion, the Committee agreed that would be their recommendation, along with some investigation into select private locations 6. Unfinished Business. None. 7. New Business. Alderman Short inquired about why the City does not have CTNPace busses. Alderman Dimas stated that it was looked into several years ago and determined that at the time, based on population and proximity to shopping centers, the City was not deemed an appropriate location to utilize the public buses. She also noted that circumstances have changed significantly since that time. Mr. Patel commented that participation is typically based on ridership, which the CT A studies to determine routes and schedules. He advised that he would make a call to Pace to inquire. 8. Reports from Staff. Mr. Patel noted that the Stockberry Ln., Grove Ave., and Ingalton Hill Estates Area Resurfacing Project began on May 27, with completion anticipated in late June or mid-July. The Booster #4 & #8 project is also ongoing, with the end of July being targeted for completion. Parkway tree planting and street striping are both complete, while the crack sealing is about 1/3 complete. The contractor for the Fair Meadows Subdivision Rehabilitation Project is still working through an issue with their SAM.gov registration before they can start that project. Guttman SIGNATURE_________ _ ITEM SUMMARY: The City's Sanitary Lift Station #5 and associated forcemain (located at 344 S. Neltnor Boulevard, behind the Burger King restaurant) design engineering that began in 2018 was completed in April 2022. The scope of work includes approximately 1,000 lineal feet of new sanitary forcemain, new wet well, pumps, electrical upgrades, mechanical upgrades, on-site generator, and a new building to house all the lift station equipment. The invitation to bid was advertised in the Daily Herald and on an online platform QuestCDN on April 5, 2022, and bids were opened on April 26, 2022. The City Council awarded the construction contract to Integral Construction, Inc. (Integral) on May 16, 2022 (Resolution No. 22-R- 0027). Staff recently held a pre-construction meeting with Integral staff on June 22, 2022. Due to material related shortages and delays, the earliest Integral anticipates to begin working is November 2022. Depending on the start date, the project is anticipated to be completed in fall of 2023. Integral has begun to provide material submittal for review and approval prior to placing orders. Typically, the contractor on such projects will submit a list of materials to be reviewed by the owner to ensure they meets the design specifications. Once the submittal has been reviewed and approved by the owner the contractor will place the order for those items. In order to assist with reviewing of materials per the contract specifications and to provide onsite construction oversight, City staff solicited proposals from four engineering firms. After careful review of each proposals, staff's recommendation is to utilize Thomas Engineering Group, LLC (TEG) for construction oversight. TEG has provided similar services for the Lift Station #1. TEG has also committed to providing the same key personnel to the Lift Station #5 project. Based on its knowledge, past experience and familiarity with City's construction standards, staff believes TEG is the most qualified firm to provide such services. TEG has submitted a proposal in the amount not to exceed $75,518.98, which represents 4.9% of the construction contract value of $1 ,531,999.31. Typically, for locally funded projects which doesn't involve any type of grant funding, construction oversight costs are in the range of 8-10%. JAKE KELLEY. CONSTRUCTION INSPECTOR Mr. Kelley has over 7 years of construction experience in construction management and inspection. He has knowledge, experiences pertaining to municipal, private projects, IDOT, and Tollway. He's experience is with reconstruction projects as well as with bituminous and concrete paving, earth excavation, landscaping, storm sewer, water main, sanitary sewer, cleaning and televising storm sewers, sign fabrication and installation, and more. Specific responsibilities include documentation of construction activities and contract quantities, plan review, submittal review, and quantity verification. PROJECT UNDERSTANDING The City's Lift Station #5 is located near the Metra Station in a mixed residential and commercial area of West Chicago. The construction limits of the Project include Lift Station #5 and the existing force main, between the existing lift station and the intersection of Main Street and Wilson Avenue, located approximately 600 feet south/southwest of the intersection of Main Street and IL Route 59. The engineering plans and final bid documents were prepared by RJN Group. The City of West Chicago is currently seeking bids for the Project. The contractor is to keep access open to the train station depot at a times for vehicles, bicycles, pedestrians etc. If required, Contractor shall set up a detour to access the train station depot. TEG will coordinate with the contractor to maintain access to the Metra parking lot and provide construction related information in the City's preferred format. The recommended sequence of construction, according to the bid documents, for the Lift Station #5 replacement is as follows: 1. The Contractor shall set-up on the existing sewer line and test the temporary bypass pumping and demonstrate satisfactory operation. 2. The Contractor shall complete site clearing and fencing within the limits of construction. 3. The Contractor shall install a new sanitary manhole on the existing incoming sanitary sewer. The Contractor shall then install another new sanitary manhole just upstream of the proposed wet well and replace the sewer between the two new proposed sanitary manholes. Once completed, the Contractor shall install a plug in the new sewer line that goes to the new wet well. The existing lift station shall remain in operation until stage 5. 4. The Contractor shall install the proposed wet well, valve vault, quick connect vault and piping. 5. The Contractor shall construct the foundation of the prefabricated building. 7. The Contractor shall set the new prefabricated building and complete electrical work to connect all required wiring to the new building, pump control panel, and PLC cabinet. The prefabricated building shall be delivered complete with generator, new pump control panel, PLC, and miscellaneous items pre-installed. 8. The Contractor shall coordinate with ComEd for the new meter and energizing the new service to the building. The Contractor CCJrrlEd. shall coordinate with NICOR for a new gas service and meter to An Fxelon company be installed and gas piping connected to the new stand-by generator. 9. The Contractor shall reconnect the existing transformer to the existing control panel located outside of the existing control building. 10. The Contractor shall install the grinder pump at the train station with all the electrical work complete and connect the pump discharge to the proposed force main. 11. Once the new gas service is ready the new natural gas generator and automatic transfer switch shall be tested and approved for operation. 12. The Contractor shall install, test and commission the proposed 8.5HP submersible pumps in the new wet well. 13. The Owner will take the existing lift station out of service. 14. The Contractor will begin site work demolition operations and demolition of the existing control building. The Contractor shall fill the existing wet well and remove the steel septic tank at the train station. 15. The Contractor shall perform grading of the existing site. 16. Upon approval of all site work, mechanical piping, pump testing, and generator testing the work of the Contractor shall be considered substantially complete. 17. Obtain from the contractor a list of proposed suppliers and subcontractors, and emergency contact information for the prime and subcontractors. 2. Provide meeting minutes to all parties following the meeting including a contact list for all contractors, subcontractors, material suppliers, and TEG personnel. 3. Review contractor's schedule for compliance with contract. Our RE will track actual progress in relation to the approved schedule and hold ongoing discussions with the contractor regarding his progression of work. 4. Prepare and distribute construction notifications, construction newsletters, website posting, etc. for distribution to the City, City agents, Metra, and other affected parties. 5. Review signage and MOT plan prior to construction to ensure construction signage for motorists and pedestrians are clear. 6. Set up field books, quantity book, diary and other forms of documentation. 7. Check and approve or reject and request re-submittal of any submittals made by the contractor for compliance with the contract documents. 8. TEG anticipates working directly with Com Ed, City staff, and the successful bidder to coordinate the new electrical service. Construction Phase 1. Observe the progress and quality of the executed work. Determine if the work is proceeding in accordance with the Contract Documents. TEG will maintain daily contact with City, keeping the City informed of the progress of the work, guard the City against defects and deficiencies in the work, advise the City of all observed deficiencies of the work and disapprove and reject all work failing to conform to the Contract Documents. 2. Review contractor's schedule on a regular basis and update progress schedule. TEG will compare actual progress to contractor's approved schedule. If progress falls behind, we will work with contractor to take appropriate action to get back on schedule. 3. Provide liaison functions to facilitate coordination of utilities (ComEd). Maintain contact with utility companies as frequent as necessary and monitor their contractor's compliance with proposed schedules. Verify that adjustments or relocations are clear of proposed improvements. 4. Maintain and circulate copies of records of the meetings. • Ensure layout is accurate and complete. • Maintain orderly files of correspondence, reports of job conferences, shop drawings, contractor's request for information, and other submissions, reproductions or original contract documents including all addenda, change orders and additional drawings issued subsequent to the award of the contract. • Prepare payment requisitions and change orders. Review applications for payment with the Contractor for compliance with established submission procedure and forward them with recommendations to the City. • Maintain a set of working drawings, updated regularly, to show final elevations and locations of all underground. • Conduct a final inspection with the City and prepare a final punch list of corrective or incomplete work. • Verify that all items on the final list have been corrected and make recommendations to the City concerning project acceptance. Post-Construction and Project Close-Out 1. The Resident Engineer shall deliver a draft of the record drawings for the underground utilities within one month of the substantial completion of the construction of the underground utilities. 2. Deliver job boxes and all project records to the City. 3. TEG will provide record drawings and weekly reports in accordance with City's requirements. FEES It is anticipated that construction will tentatively begin in early June, following contract award, execution, and preconstruction meeting. According to the engineer's estimate of time, 150 calendar days are required to complete all site civil and utility work shown on the final engineering plans. Our not-to-exceed fee estimate, provided herein, includes construction engineering hours based on having a full-time Resident Engineer and support staff over a period of 150 calendar days (approximately 21 weeks) to oversee the construction of the Lift Station No. 5 and Force Main Replacement Project. It is anticipated that all construction activities will be completed by September 2023. The following pages, rates, and tables represent what TEG has developed in terms of a design engineering cost estimate. We have utilized an IDOT standard Cost Estimate of Consultant Services (CECS) and discounted 2.60 Direct Labor Multiplier (OLM) method of compensation, as outlined in the 10-year engineering agreement. The Village of Burr Ridge hired TEG for Phase II Training IDOT Traffic Incident and Phase Ill for this $1.1M annual water main replacement project for improvements at Management Training two (2) locations in Burr Ridge. The 2019 locations included County Line Road (Cook Work Zone Safety & Traffic Control County), County Line Lane in the Carriage Way Subdivision, work along the County ICORS TrainingLine Road/Carriage Way/N Frontage intersection, and Chasemoor Drive between 79th Street and Foxborough Drive. TEG secured federal funding on behalf of the City by applying for STP highway funding through the DuPage Mayors and Managers Conference. TEG was hired by the City to provide planning, design, and construction engineering services for this $1.2M STP funded pavement reconstruction project. The project is located on a major thoroughfare in the City's downtown business district and required staged construction, detour plans, and close coordination effort with the residents and businesses along the project corridor. The project also spans the Union Pacific and Canadian National Railroads. Planning efforts included a Life Cycle Cost Analysis of several different pavement maintenance and rehabilitation strategies, which resulted in a reconstruction determination. The project also includes the reconstruction of intermittent sidewalk, ADA compliant ramps, curb and gutter, pavement markings and landscape restoration. TEG is currently providing construction engineering services, which will include documentation of contract quantities, contractor payment requests, and project closeout. PHASE II AND Ill, GRAND AVENUE STREET LIGHTING IMPROVEMENTS, VILLAGE OF Fox LAKE - Resident Engineer. TEG was hired by the Village of Fox Lake to provide design and construction engineering services for the first phase of a two phase ornamental street lighting improvement along Grand Avenue. Phase 1 improvements included Grand Avenue, between Pistakee Lake Road and York Street. The project length was approximately 0.50 miles. The project included the removal of existing street lighting and installation of thirty (30) custom, decorative street lighting assemblies. The work consisted of removal and disposal of unsuitable material, installation of concrete and metal helix light pole foundations, decorative street lighting installation, unit duct, lighting controllers, electrical service installation, and final restoration. TEG secured an IDOT Region One Highway Permit for work within IDOT ROW at the intersection of US-12 and Grand Avenue. The final construction cost of the project was under the original contract amount of $544K. PHASE Ill, WARRENVILLE ROAD I 4TH ST. RECONSTRUCTION, CITY OF WARRENVILLE - Construction Inspector. TEG was hired by the city to provide planning, design, and construction engineering services for this $1.3M MFT funded pavement reconstruction project. The project consisted of removing the existing permeable pavers, pervious base course and sub-base cross section and replacing it with a conventional full-depth HMA pavement for approximately 1 mile between IL Route 56 and Batavia Road. Due to excessive traffic speeds and pedestrian safety concerns, the project also featured traffic calming measures such as landscape median islands, lane narrowing, bike crossing pavement markings, LED stop signs, and stamped crosswalks. TEG provided a traffic study report which identified the needs for additional stop control along the corridor. PHASE Ill, SETTLER'S RIDGE SUBDIVISION REHABILITATION PROJECT, SUGAR GROVE, IL - Resident Engineer. As resident engineer for this $3.2M rehabilitation project, provided construction inspections/observations, layout, measurements, and pay estimates for the Village of Sugar Grove. The project consisted of milling and resurfacing the entire HOA subdivision, as well as 1 mile of Gordon Road South of Galena Blvd. Within the subdivision, ADA ramps, sidewalk, and curb and gutter were removed and replaced to follow current standards. Storm sewer replacement, drainage ditch design realignment, and seeding were also part of the extent of this project for the Village of Sugar Grove. The Village of Sugar Grove and Settler's Ridge HOA were given daily updates and pictures of the project to keep them involved. PHASE Ill, MONTGOMERY BUSINESS DISTRICT DEVELOPMENT PROJECT, AUCUTT ROAD, MONTGOMERY, ILLINOIS - Construction Inspector. As on site construction inspector for the development of the Nexeo Solutions Chemical Factory and the American Crystal Sugar production plant, provided construction observations and final inspections for this Montgomery Business District Development Project. Responsibilities included construction inspections and observations of water main, storm sewer, and sanitary sewer installation, HMA and concrete paving, and curb and gutter installation. Pressure testing of water main, as well as sanitary testing were also performed. After completion, final inspections were performed for the Village of Montgomery. PHASE Ill, MONTGOMERY OLD DOMINION FREIGHT SHIPPING FACILITY DEVELOPMENT, AUCUTT ROAD, MONTGOMERY, ILLINOIS - Construction Inspector. As on site construction inspector for the development of the Old Dominion Freight shipping facility, provided on site construction inspections for the Village of Montgomery. Responsibilities included inspections and observations of water main, storm sewer, and sanitary sewer installation, as well as HMA and concrete paving. Pressure testing of water main was also performed for the Village of Montgomery. PHASE Ill, HMA RESURFACING PROJECT, IL 71, STANDARD, ILLINOIS, ILLINOIS DEPARTMENT OF TRANSPORATION: DISTRICT 3 - Resident Engineer. As resident engineer for the Illinois Department of Transportation - District 3 on this $2.2M project, provided construction management, layout, documentation, and inspection for 4 miles of HMA resurfacing on IL 71 between IL 89 and Cedar Point, IL. This project consisted of milling the existing HMA and resurfacing this location of IL 71, along with pavement striping, raised reflective pavement markers, and incidental HMA. Due to drainage concerns with an adjacent HMA shoulder widening project throughout the same location of IL 71, the mainline profile of the road had to be raised, thus milling less in certain areas to allow for proper drainage. On June 2, 2022, staff had a lengthy discussion with the Infrastructure Committee regarding the SSES and Repair Program. Staff was directed to complete an SSES study in the center and southeast portion of the City. Due to the volume of repairs identified in previous SSES studies, once the study is completed, the focus will shift solely to the repairs until all outstanding items have been addressed. This will be the last evaluation program conducted for the foreseeable future. The City has conducted SSES studies in 2010, 2011, 2013, 2014, 2016, and 2018. The primary purpose of these studies is to find defects in the sanitary sewer collection system. The defects are found via dye testing , smoke testing, sewer televising, and manhole inspections. As part of these studies, accurate location of City infrastructure such as manhole locations is also captured in a Geographic Information System (GIS) database. The 2022-2023 SSES program is a continuation of the previous studies. This survey work will encompass the areas of the City that have not been inspected during the programs from 2010-2018. The remaining area is roughly Harrison Street south to Dayton Avenue and Lyman Avenue east to Route 59. A location map is attached for reference. The study area encompasses roughly 80,000 lineal feet of sanitary sewer and approximately 326 sanitary manholes. The data collected will then be used to finalize a cost effective sanitary sewer repair program for implementation in future years. Due to their knowledge and familiarity with City's sanitary sewer system as well as successfully performing previous SSES studies, after direction from the Infrastructure Committee, City staff approached RJN Group, Inc. (RJN) to request a cost proposal for the 2022-2023 SSES program. RJN submitted the initial proposal in the amount of $246,783.26. After successful negotiations, RJN has submitted a revised not to exceed proposal in the amount of $232,588.36. RJN's scope of work will include manhole mapping and inspections, smoke testing, wet weather investigations, and dye testing of the sanitary collection system tributary to the locations noted above. Please note unlike our previous studies, in an effort to reduce costs, City staff will be performing the sewer televising with City equipment. RJN's scope of work includes analyzing our televised data and properly coding the defects using an artificial intelligence software. (RJN) is pleased to submit this proposal to the City of West Chicago (City) for reducing inflow and infiltration (I/I) in the sanitary system as shown in the enclosed project location map. Key Project Goals and Objectives The goal of this program is to complete the remaining Sanitary Sewer Evaluation Survey (SSES) program in the older residential area of the City as identified in the flow monitoring study of the City's sewer system that was performed in 2009. There are four main components of this proposal: • Manhole Surveying and Inspections • Smoked Testing Services • Sanitary Sewer Assessment Study • Dye Testing Services • Engineering Analysis and Reporting A summary of each SSES task is provided below, while the detailed scope of services is provided in Exhibit A. Manhole Surveying and Inspections Each manhole will be located by either survey grade GPS or terrestrial survey equipment with a new manhole number assigned. The task of locating and numbering manholes will be completed and approved by the City prior to starting the remaining tasks. The numbering system established in 2010 will be utilized. Surface inspection of the manholes will be provided to identify frame and lid defects and other structural defects in the manhole. Manhole/pipe sizes, materials, and inverts will also be collected. Smoke Testing Smoke testing identifies improper connections into the system as well as sewer, manhole and service lateral defects. Smoke is blown into a sewer segment through the manholes. Defects are identified by smoke exiting through the ground or structures. RJN utilizes a 3 or 4-person crew and smoke tests with two smoke blowers, for a maximum linear length of 600 feet of sewer. Sandbags are used where practicable to minimize smoke entering other segments. Final Deliverable: A detailed list of all identified defects, Clarity data access, GIS of data collected, and recommendations for follow-up remediation or inspections. Sanitary Sewer Assessment Study Perform closed-circuit television (CCTV) analysis of approximately 80,250 LF of videos of the cleaned and televised sewer pipes. Use SewerAI auto-coding software to develop a PACP coded database of the CCTV inspection. Quality Control the auto-coding software and develop rehabilitation recommendations for the reviewed CCTV. The CCTV will be completed and provided to RJN by City staff. Final Deliverable: A complete analysis of the televised sewer including quality control of the SewerAI auto-coding, a PACP database, and rehabilitation recommendations. 2022 SSES Program, City of West Chicago I Page 2•• ===== PDF PAGE 38 ===== [Extraction: embedded PDF text] Dye Testing Dye testing is used to confirm direct and indirect storm water connections to the sanitary sewers found during smoke testing. The exact number of locations requiring dye testing is not known until the smoke testing has been completed. The proposal is based on twelve dye testing set ups. Final Deliverable: A detailed list of confirmed cross-connections between the storm and sanitary sewer with recommendations for separation and rehabilitation. Data Analysis and Report Compile all the field findings and summarize work completed into a report for the City. The report will also include recommendations for the rehabilitation of identified defects and estimated costs for rehabilitation. Final Deliverable: An SSES report outlining defects identified, rehabilitation and remediation recommendations for the system to reduce inflow and infiltration with budgetary costs, and recommendations for any additional inspections. Assuring Quality RJN is committed to providing quality deliverables. The data, analysis, and recommendations provided by RJN will be used to make decisions on how much and where to spend City sanitary sewer system funds. RJN's use of electronic forms for data collection with standardized entry and error trapping, the use of QC tools in our in-house data management software, as well as our corporate training and QC processes in place will ensure that results and recommendations will provide value to the City. These subdivisions have rear yard sanitary sewers. The subdivisions were constructed in the 1950s and the sewer lines are made of vitrified clay pipe. Clay pipe is susceptible to root intrusion and leaks: Tiny tree roots can enter loose clay plumbing joints, growing bigger and breaking away the clay as time goes by. These sewers are difficult for City staff to maintain due to their locations in rear yards. Since 2020, 20% of our calls for sanitary sewer issues have been from residents in these areas. The sewer mains are in need of rehabilitation. In order to obtain the best pricing and get the project to bid in early 2023, staff requested a proposal from RJN Group (RJN). RJN's scope of work will include preparing plans, specifications and bid documents to repair approximately 11,500 lineal feet of cured-in-place pipe (CIPP), approximately 72 manhole rehabilitations and perform lateral grout sealing on approximately 330 laterals. All of the work will be focused within the public right-of-way and/or easements. RJN has provided a proposal for an amount not to exceed $53,548.00 to develop plans, specifications, and bid documents for the program. ARTICLE IV GROUP ACKNOWLEDGEMENT. INDEMNITY AND BINDJNG EFFECT The GROUP acknowledges the hazardous nature of the work involved in the Adopt-A-Highway program. The GROUP agrees to comply with all of the terms and conditions set forth in the ACT, and the terms and conditions set forth in Chapter 15, Article II of the CITY'S Code of Ordinances. The GROUP agrees to indemnify, assume all liability for and hold the State of Illinois and the CITY, their respective officers, agents and employees, harmless from any and all claims of action, including all costs and attorneys' fees in connection therewith, resulting from the GROUP'S members, volunteers and/or employees work in the Adopt-A- Highway program, except for the negligent acts of the State, the CITY, and their respective officers, agents or employees. The GROUP further agrees that: A. No person shall participate in any litter collection activities pursuant to the Adopt- A-Highway program unless and until the GROUP has obtained and submitted to the CITY a release, in the form attached hereto and incorporated herein as Exhibit "C", executed by such person or, if such person is under eighteen (18) years of age, the parent or guardian of such person. B. The GROUP shall schedule all litter collection activities with the CITY'S Director of Public Works not less than seven (7) days prior to such activities, and shall at that time submit any participant releases not previously submitted and /or new releases for any participants who have attained the age of eighteen (18) years and for whom releases executed by a parent or guardian were previously submitted to the CITY. C. The GROUP shall not schedule any litter collection activities prior to the month of April, nor after the month of November, in any year. D. The GROUP shall not undertake any litter collection activities before dawn or after dusk on any day, or during any period of inclement weather. E. The GROUP shall not undertake any litter collection activities without first having posted temporary warning signs to inform motorists that work is being conducted along the adopted section(s) of street right-of-way, which signs shall be supplied by the CITY. F. The GROUP shall provide safety vests, gloves and litter pick up equipment for clean up activities. ( E)Q5 ILCS 120/1) Sec. 1. Short title. This Act may be cited as the Illinois Adopt-A-Highway Act. (Source : P.A. 87 -1118.) (605 ILCS 120/5) Sec. 5. Purpose. The Adopt-A-Highway program allows private citizens to support municipal, township, and county anti-litter efforts by allowing groups to adopt a section of highway for the purpose of litter collection. The following Sections set forth the uniform guidelines and requirements for the administration of Adopt-A-Highway programs in the State of Illinois. (Source: P.A. 87-1118.) (605 ILCS 120/10) Sec. 10. Definitions. For purposes of this Act: "Group" means members or employees of civic or not-for-profit organizations, and commercial or private enterprises, who have requested to participate, or are participating in, an Adopt-A-Highway program. "Litter" means any unsightly or offensive matter that may include, but is not limited to, disposable packaging, containers, cans, bottles, paper, ashes, and cigar and cigarette butts. Litter does not include hazardous, heavy, large items, or carcasses. "Group coordinator" means the individual selected by a group to serve as its liaison with a sponsoring jurisdiction. "Group president" means the individual who is the recognized leader, president, or chairman for a group. "Adopted section" means a length of municipal, township, county, or State right-of-way identified by the sponsoring jurisdiction as a safe, adoptable section of right-of-way for adoption by a group. Sections of rights-of-way may be determined inappropriate for adoption for safety reasons. No interstate highway shall be an adopted section. "Director" means the designee or designees for any municipality, township, or county who has responsibility for the administration of a jurisdiction's Adopt-A-Highway programs. "Sponsoring jurisdiction" means the Illinois Department of Transportation or any municipality, township, or county that establishes Adopt-A-Highway programs within its jurisdictional area. ===== PDF PAGE 79 ===== [Extraction: embedded PDF text] (Source: P.A. 89-229, eff. 1-1-96.) (605 ILCS 120/15) Sec. 15. Participation in Adopt-A-Highway Program. Groups may apply to a sponsoring jurisdiction for participation in the jurisdiction's Adopt~A-Highway program. The sponsoring jurisdiction shall establish the terms and procedures groups must follow in applying for participation in the Adopt-A-Highway program. (Source: P.A. 87-1118.) (605 ILCS 120/20) Sec. 20. Agreement. (a) The sponsoring jurisdiction shall have sole responsibility in determining whether an application is rejected or accepted. If an application is approved, the group coordinator and group president shall execute a written agreement with the sponsoring jurisdiction that provides for the group's participation in the Adopt-A-Highway program. (b) The agreement shall be in the form prescribed by the sponsoring jurisdiction and shall, at a minimum, contain the following: (1) an acknowledgment by the group of the hazardous nature of the work involved in participating in the Adopt-A-Highway program; (2) an agreement to comply with the terms and conditions in the Act and any other terms and conditions required by the sponsoring jurisdiction; (3) an agreement that the volunteers or the volunteer's agents shall assume all liability for and hold the State and the State's agents or employees harmless from any and all claims of action resulting from the group's volunteers or agents work in the program, except for the negligent acts of the State, and the State's agents or employees; (4) an agreement that the volunteers or the volunteer's agents shall assume all liability for and hold the sponsoring jurisdiction and the sponsoring jurisdiction's agents or employees harmless from any and all claims of action resulting from the group's volunteers or agents work in the program, except for the negligent acts of the sponsoring jurisdiction and the sponsoring jurisdiction's agents or employees; (5) an agreement that the members of the group are jointly and severally bound by the terms and conditions set forth in the agreement; and (6) the respective responsibilities of the group and the sponsoring jurisdiction as contained in Sections 25 and 30 of this Act. Groups participating in an Adopt-A-Highway program shall: (1) be required to obey and abide by all laws and regulations relating to safety and any other terms and conditions as required by the sponsoring jurisdiction; (2) provide one adult supervisor for every 5 youths when persons under age 18 are present on an adopted section; (3) not allow a person under the age of 10 to be a member of the group who would be volunteering for the purpose of litter collection; (4) require all group members to attend a safety meeting conducted by the group before participation in any litter collection along an adopted section; (5) require the group coordinator, or designee, to conduct group safety meetings and to receive safety training as required by the sponsoring jurisdiction; (6) adopt a section for a minimum of 2 years; (7) collect litter along an adopted section 4 times a year, or as required by the director; (8) require the group coordinator to provide prior notice, as required by the director, whenever the group intends to collect litter along its adopted section; (9) require group members to properly wear any safety apparel provided by the sponsoring jurisdiction while collecting litter on an adopted section; (10) be responsible for prohibiting members from possessing,' consuming, or being under the influence of alcohol or drugs while on an adopted section; (11) maintain a first-aid kit and an adequate supply of drinking water while members are collecting litter along an adopted section; (12) place litter in trashbags provided by the sponsoring jurisdiction and place filled trashbags at a location on the adopted section as designated by the director; and (13) not subcontract or assign its duties or responsibilities to any other group or organization. (Source: P.A. 87-1118.) (605 ILCS 120/30) Sec. 30. Responsibilities of the sponsoring jurisdiction. The sponsoring jurisdiction shall: (1) determine the specific section of right-of-way that is adopted; (2) erect a sign that conforms with Section 35 at each end of an adopted section with the name or acronym of the group displayed; (3) provide a group with garbage bags; ===== PDF PAGE 81 ===== [Extraction: embedded PDF text] (4) provide a group with safety apparel and signs cautioning the public, if required by the sponsoring jurisdiction; and (5) remove filled garbage bags from an adopted section as soon as practical after litter collection has occurred, and shall otherwise be responsible for removing litter from adopted sections only under unusual circumstances such as to remove large, heavy, or hazardous items. (Source: P.A. 87-1118.) (605 ILCS 120/35) Sec. 35. Signs. Adopt-A-Highway signs shall be uniform Statewide in terms of shape, color, text, and location. The Illinois Department of Transportation shall develop and announce standards for Adopt-A-Highway signs within 90 days of the effective date of this Act. Nothing in this Act shall prohibit the sponsoring jurisdiction and the Illinois Department of Transportation from working cooperatively to carry out the intent of the Adopt-A-Highway Program. The sponsoring jurisdiction shall develop the safety training programs that are to be utilized by group coordinators in compliance with Section 25 of this Act. (a) A sponsoring jurisdiction may establish other procedures and requirements for the administration of its Adopt-A-Highway programs. The procedures and requirements shall not be inconsistent with any provision of this Act. (b) The sponsoring jurisdiction shall have the right to terminate an agreement if a group does not meet the terms and conditions of its agreement, or if the group's involvement in the Adopt-A-Highway program is inconsistent with any other restrictions or limitations established by the sponsoring jurisdiction. Penalty for Litter Control Act violation. (a) An individual convicted of violating Section 4 or Section 5 of the Litter Control Act by disposing of litter upon a public highway may be required to adopt for 30 days a designated portion of that highway, including the site where the offense occurred. Guttman SIGNATURE________ _ ITEM SUMMARY: The Special Service Area#2 detention basin is located on the west side of Kress Creek south of Hawthorne Lane. The property the basin is on appears to be owned by the West Chicago Park District. The outfall appears to be on the City's property northwest of its Water Treatment Plant Facility. The outfall is for the storm lift station #8 which was originally constructed in 1984. The detention basin outfall into Kress Creek has failed and needs to be replaced. Additionally, erosion is occurring within the ditch north of Hawthorne Lane. The ditch north of Hawthorne Lane is mapped as Kress Creek. Drawings are available that show the ditch north of Hawthorne Lane, however it appears to have existed prior to these drawings, as early as 1939. Therefore, this area will be considered jurisdictional by DuPage County and the United Stated Army Corp of Engineers (USACE). The City hired Engineering Resource Associates (ERA) to help prepare the plans and bid specifications in March 2021 . ERA was also tasked with obtaining permits through DuPage County as well USACE for the in-stream work. The scope of work includes repairing the fallen storm outfall, installation of vegetated rock toe on either side of Kress Creek both north and south of Hawthorne lane as well as planting a seed mix conducive to high and low water levels. The plantings will also require three years of maintenance and monitoring to meet permit requirements. The request for bids was advertised in the Daily Herald and on an online bidding platform QuestCDN on July 5, 2022. The bids were opened on July 26, 2022. The below table represents the bid results.
