ACTIONS PROPOSED: Staff recommends adoption of Ordinance No. 23-O0-0035 COMMITTEE RECOMMENDATION: ===== PDF PAGE 5 ===== [Extraction: OCR (rendered-page OCR)] ORDINANCE NO. 23-0-0035 AN ORDINANCE OF THE CITY OF WEST CHICAGO AMENDING CHAPTER 17, ARTICLE XVII, DIVISION 16, OF THE CODE OF ORDINANCES REGARDING TURN RESTRICTIONS —- PURNELL ROAD AND GARY’S MILL ROAD WHEREAS, the DuPage County Board adopted certain traffic control restrictions for the intersection of Purnell Road and Gary’s Mill Road when it approved the Trillium Farms Subdivision; and WHEREAS, the City of West Chicago (hereinafter the “City”) subsequently approved an annexation of land owned by the DuPage County Forest Preserve District that resulted in this intersection now becoming the jurisdiction of the City; and WHEREAS, the City must now add these restrictions to the Code of Ordinances to allow for their enforcement by City officials. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of West Chicago, in regular session assembled as follows: Section 1. That Chapter 17, Article XVII, Division 16 of the Code of Ordinance of the City of West Chicago is hereby re-named from “Right-Turns Only” to “Turn Restrictions” and that Section 17-246 is deleted in its entirety and the following language shall be substituted: “Sec. 17-246. - Designated. The subjects walked around the school and had coffee in the teachers’ lounge. The investigation is ongoing. Burglary to Motor Vehicle & Fraud: #2301497 Person(s) unknown entered the victim’s unsecured vehicle parked on Tower Rd. The suspects removed the victim’s wallet and used the owner’s debit/credit cards at the Walmart in St. Charles. Two successful purchases were made, totaling $2,026.79. Another purchase was unsuccessful, and a fourth is pending. The victim’s card was also used at a 7-11 in Bartlett for $46.65. Surveillance video of the suspects and suspect vehicle was obtained from Walmart. The investigation is ongoing. Aggravated Assault: #2301564 Person(s) unknown displayed a handgun to a motorist on Neltnor Blvd. near Pine St. The complainant was traveling southbound on Neltnor Blvd. when another vehicle began to tailgate her. The complainant put her hand out the window and gave the tailgating motorist an obscene hand gesture. The second motorist pulled alongside the complaint, rolled down his window, and held up a handgun. The suspect then left the scene. The investigation is ongoing. Theft Under $500.00: #2301461 Person(s) unknown removed the victim’s bicycle from Menards at 220 W. North Ave. The subject arrived at work at 0800 and hid his unsecured bicycle in some bushes. When he left at 1600 hours, the bike had been taken. Fraud: #2301506 Person(s) unknown used the victim’s credit card information to make multiple purchases of rebar from a company in the 1800 block of Arthur Ln. The unauthorized charges totaled $30,009.06. Neltnor Blvd. The suspect entered the store and approached the counter with an energy drink. The suspect then asked for two packs of cigarettes. The suspect then picked up one of the packs, lifted his shirt to display a handgun tucked into his waistband, and exited the store. The investigation is ongoing. #2301536 Person(s) unknown entered the smoke shop in the 900 block of N. Neltnor Blvd. The suspect approached the counter, lifted his t-shirt to reveal a gun tucked into his waistband, and told the clerk to empty the safe. The clerk did not open the safe. When a customer entered the store, the suspect asked for vape cartridges before leaving without any items. Upon arrival, officers were led to a room where the subject was lying on the floor, purple in color, not responding, having a faint pulse, and gasping for air. The family stated they had already administered two doses of Narcan. CPR began, the subject’s pulse improved, he regained color to his face, and regained consciousness. West Chicago Fire Protection District personnel arrived, began treatment, and transported the subject to Northwestern Medicine Central DuPage Hospital. #2301424 On August 10th, Officers Schiever and Solis responded to a residence in the 600 block of E. Blair St. for a reported overdose. Upon arrival, the subject was located unconscious and lying on the floor. A dose of Narcan was administered, and the subject regained consciousness. When the victim was helped to her feet, a small baggie of suspected heroin fell to the ground. West Chicago Fire Protection District personnel transported the subject to the Northwestern Medicine Central DuPage Hospital. #2201518 On September 10th, 2022, Officer Montgomery responded to a business in the 1200 block of Powis Dr. for a theft report. Forty-eight new tires and rims valued at $45,600.00 had been removed from six semi-tractors. A Ryder truck had been stolen from an adjacent parking lot in the 1300 block of Howard Dr. The properties are separated by a chain link fence that had been cut open. Ryder provided GPS data to investigators, and Detectives Flanigan and Eversole went to Riverdale, Markham, and Alsip to collect video surveillance of suspects and the stolen Ryder Truck. At a tire business in Alsip, the surveillance camera captured the Ryder truck and a Mercury entering the lot with a suspect exiting the Mercury and walking toward the business. Detective Flanigan sent out a bulletin to local law enforcement agencies seeking information on the suspects and received a reply from DuPage County Sheriff’s Office investigators providing names of four possible suspects who have committed similar offenses, one of whom drives a Mercury matching the one involved in this theft. Photos were obtained of the suspects that appeared to match the subjects captured in surveillance video and photographs. On June 22nd, 2023, Detectives Eversole and Flanigan interviewed a suspect at the DuPage County Jail, who admitted to the tire thefts and the theft of the truck. The DuPage County State’s Attorney’s Office approved a charge of Theft $10,000 - $100,000, and on August 9th, 2023, Detective Flanigan obtained an arrest warrant for the suspect. The paperwork was delivered to the DuPage County Jail, where the suspect was in custody on unrelated charges. #2301151 On July 1st, officers responded to the 29W300 block of Hawthorne Ln for a report of shots fired. Upon arrival, a victim was located lying in the yard, and it was later determined the victim’s injuries were consistent with being struck by a car and not a gunshot wound. Witnesses were identified and interviewed and claimed they heard shots fired before the vehicle struck the victim. Later, social media posts from one of the subjects who had been on the scene showed a 9mm handgun being displayed. A search warrant was obtained for the subject’s residence in an attempt to locate the firearm. The DuPage MERIT SWAT team conducted the search on July 5th. A loaded 9mm Taurus handgun, 11 rounds of 9mm ammunition, 44 rounds of .380 ammunition, and a black gun case were all located. After the search, the subject said he had hidden the gun and ammunition in his mother’s room. The DuPage County State’s Attorney’s Office approved a charge of Unlawful Use or Possession of Weapons or Ammunition by a Convicted Felon, and a warrant was obtained for the subject’s arrest. On August 11th, Detectives Calabrese and Moore, assisted by officers of the West Chicago and Carol Stream Police Departments, arrested the subject as he left his place of employment in Carol Stream, then transported him to the Police Station, where he was reinterviewed. The subject was fingerprinted, photographed, and transported to the DuPage County Jail. 12 ===== PDF PAGE 19 ===== [Extraction: embedded PDF text] #2300132 On January 30th, 2023, Detective Herbert was assigned to follow up on a criminal sexual assault investigation that occurred on November 25th, 2001, in West Chicago. This follow-up investigation was conducted because, on December 19th, 2022, the DuPage County Crime Lab identified the DNA profile obtained from the victim's sexual assault kit from 2001. The DuPage County Crime Lab stated a suspect’s DNA profile was consistent with the DNA profile obtained from the sexual assault kit. The DNA profile of the suspect was linked to a Warrenville criminal sexual assault in 2010. Since a suspect was identified, Detective Herbert conducted a criminal history check and discovered the suspect had multiple arrests, including booking photos. It was learned that in 2000, the suspect was arrested by the Saint Charles Police Department for Burglary, Criminal Trespass to Land, and Reckless Driving and transferred to the DuPage County Jail, where he was photographed during intake procedures. Detective Herbert contacted the DuPage County Jail and requested the suspect’s booking photo from May of 2000 since the suspect's arrest was closest chronologically to the criminal sexual assault from November 25th, 2001. The booking photo was compared against the FACES composite picture that the victim created of the offender from the 2001 incident. The suspect's booking photo was determined to be very similar to the composite image of the offender that the victim had created. The DuPage County State’s Attorney’s Office approved a charge of Criminal Sexual Assault. On February 15th, an arrest warrant was obtained for the suspect. On July 11th, 2023, the DuPage County Sheriff's Office warrant/transport team picked up the suspect at the Three Rivers Federal Correctional Institution in Texas on the original arrest warrant for Criminal Sexual Assault related to this investigation. The suspect was taken on a flight to O'Hare airport and then transported to the West Chicago Police Department, where he was interviewed. The suspect was asked what his uniform was at this time, and he stated he had to wear a black sports coat, white button-down dress shirt, bow tie, and black pants while working. The victim described her attacker as wearing a black sports coat, white button- down shirt, and black pants at the time of the incident. The victim advised that the outfit reminded her of something a male subject would wear to a wedding reception. The suspect denied the sexual assault. The subject was fingerprinted, photographed, and transported to the DuPage County Jail. 13
