ITEM SUMMARY:
On August 3, 2020, the City entered into a Pre-Annexation Agreement with Pulte Home Company, LLC and
the owner of 34.97 acres of unincorporated property located at 28541 Roosevelt Road and 28W700 Purnell
Road. The agreement provides for the eventual annexation of the property, which was developed as an 84-
lot residential subdivision in DuPage County known as Trillium Farm.
The agreement stipulates that the City will annex the Trillium Farm once contiguity of the property with the
municipal limits of the City is accomplished and once the last residential home is sold. Contiguity with Trillium
Farm was achieved with the annexation of a portion of the Blackwell Forest Preserve last year and the last
home was constructed and sold this summer. The City may now move forward with the formal annexation of
Trillium Farm. An Ordinance formally annexing the property has been prepared for action.
ACTIONS PROPOSED:
Approval of the Ordinance providing for the annexation of the Trillium Farm residential subdivision.

ORDINANCE NO. 24-0-0025
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF
THE TRILLIUM FARM RESIDENTIAL SUBDIVISION LOCATED ON
THE EAST SIDE OF PURNELL ROAD AND SOUTH OF GARY’S MILL ROAD
WHEREAS, on August 3, 2020, the City of West Chicago (the “City”) approved Resolution
20-R-0045, entering into a Pre-Annexation Agreement (the “Agreement”) with Pulte Home
Company, LLC (the “Developer”) and Chicago Title Land Trust Company as successor Trustee to
LaSalle Bank National Association, as Successor Trustee to American National Bank and Trust
Company Chicago, as Trustee under a Trust Agreement dated February 25, 1987 and known as
Trust No. 1029 (the “Owner”); and,
WHEREAS, the Agreement, among other things, provides for the eventual annexation of
34.97 acres of unincorporated property located at 28W541 Roosevelt Road and 28W700 Purnell
Road (the “Property”), legally described on the Plat of Annexation, attached as Exhibit “A”; and,
WHEREAS, a Petition made under oath requesting that the Property be annexed to the City
was submitted to the City Clerk by the Owner on July 9, 2020; and,
WHEREAS, said Petition was presented to the City on August 3, 2020 pursuant to the
provisions of 65 ILCS 5/7-1-89, as amended; and,
WHEREAS, said Petition was included as Exhibit “C” of the Agreement; and,
WHEREAS, since then, the Property has been developed as an 84-lot single-family
detached residential subdivision (the “Development”) in unincorporated DuPage County, as
specified in the Agreement; and,
WHEREAS, the Agreement stipulates that the City will annex the Property once contiguity
of the Property with the municipal limits of the City is accomplished and once the last residential
home in the Development is sold; and,
WHEREAS, contiguity with the Property was achieved with the annexation of a portion of
the Blackwell Forest Preserve on February 6, 2023, according to Ordinance 23-O-0003; and,
WHEREAS, all lots in the Development have been sold and all homes in the Development
have been constructed and completed; and,
WHEREAS, said property is not within the corporate limits of any municipality and
portions thereof are contiguous to the corporate limits of the City of West Chicago; and,
WHEREAS, the statutes of the State of Illinois provide that the City may pass an ordinance
annexing the Property to the City, if said ordinance is passed by a majority of the Corporate
Authorities; and,

WHEREAS, all notice requirements to the authorities of Winfield Township for annexation
of the Property were completed on or about August 8, 2024 in accordance with 65 ILCS 5/7-1-1.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of West
Chicago, in regular session assembled:
Section 1. The subject territory legally described in Exhibit “A” being indicated on the
Plat of Annexation to the City of West Chicago, which is appended to and made part of this
ordinance, is hereby annexed to the City of West Chicago, County of DuPage, and State of
Illinois.
Section 2. The Executive Office Manager is hereby directed to record with the DuPage
County Recorder and to file with the DuPage County Clerk a certified copy of this ordinance,
together with the Plat of Annexation, appended to this Ordinance.
Section 3. That the Executive Office Manager shall and is hereby authorized to file with
the Executive Director of the DuPage County Board of Election Commissioners a certified copy
of this Ordinance together with an accurate map of the territory annexed appended thereto.
Section 4. All ordinances and resolutions, or parts thereof, in conflict with this ordinance
are hereby repealed.
Section 5. That this Ordinance shall be in full force and effect after its passage, approval
and publication in pamphlet form as provided by law.
