The attached Resolution declares the property as surplus, and sets the terms for the sale. STAFF RECOMMENDATION: Staff recommends approval of Resolution Nol. 24-R-0063. COMMITTEE RECOMMENDATION: The sale of City property is sent directly to the City Council for approval. ===== PDF PAGE 29 ===== [Extraction: OCR (rendered-page OCR)] RESOLUTION NO. 24-R-0063 A RESOLUTION OF THE CITY OF WEST CHICAGO, DUPAGE COUNTY, ILLINOIS DECLARING CERTAIN MUNICIPALLY OWNED REAL ESTATE, COMMONLY KNOWN AS 126 WOOD STREET SURPLUS PROPERTY AND AUTHORIZING THE SALE OF SAID PROPERTY WHEREAS, the City of West Chicago (hereinafter referred to as the “City”) is a body politic and corporate, organized and existing pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1- 1 et seq.; and WHEREAS, the City possesses the authority, pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1-1 et seq., to adopt ordinances pertaining to the public health, safety, and welfare; and WHEREAS, the City Council of the City (hereinafter referred to as the “City Council”) is the corporate authority for the City and is authorized by law to exercise all powers and to control the affairs of the City; and WHEREAS, the City Council possesses full power and authority to approve and pass all necessary ordinances, resolutions, rules and regulations necessary for carrying into effect the objects for which the City was formed, in accordance with the Illinois Municipal Code; and WHEREAS, the City is the Owner of a certain real property located in the City, identified with the common address 126 Wood Street, West Chicago, Illinois (hereinafter referred to as the “Real Property);” and WHEREAS, the Real Property is identified in PIN 04-09-210-005; 04-09-210-009; and 04- 09-210-011, which Real Property measures .15 acre in size and is zoned in the City’s B-1 Zoning District; and WHEREAS, the City Council has determined that it is no longer necessary, appropriate, or in the best interest of the City that it retain Title to the Real Property; and WHEREAS, pursuant to the Illinois Municipal Code, 65 ILCS 5/11-76-4.1, the City Council has the power to authorize the sale of surplus public real estate, and to direct the sale of such Real Property to be conducted by the City Administrator, assisted by such Staff as he deems necessary; and WHEREAS, the City is in receipt of a written Certified Appraisal for the Real Property; and WHEREAS, the City Council directs the City Administrator to public notice of the sale of the proposed sale, based upon a written Certified Appraisal of the Real Property; ===== PDF PAGE 30 ===== [Extraction: OCR (rendered-page OCR)] WHEREAS, the Terms of Sale for the Real Property are: a. A minimum Sale Price for the Real Property to be one hundred twenty-five thousand and 00/100 ($125,000.00); OR, that Price which is deemed by the City Administrator to be the highest fair cash value the City can expect to receive upon evaluation and attempting to recover/collect as much of the following items as possible: the costs of the Appraisal for each Parcel of Real Property; all closing costs associated with the Sale of each Parcel; reimbursing the City’s costs of acquisition; and payment of the City Liens; and b. The use of the Real Property will be restricted to uses permitted in the current B-1 Zoning District in the Code of Ordinances of the City. NOW, THEREFORE, BE IT RESOLVED by the Corporate Authorities of the City of West Chicago, Illinois, in Regular Session assembled: Section 1. That the Recitals set forth above are incorporated herein in their entirety. Section 2. That the Real Property designated herein is hereby declared “Surplus.” Section 3. That the City Administrator, assisted by such Staff as may in his opinion be necessary, be authorized and directed to sell the Real Property on Terms as are set forth herein, which are found acceptable by the City Council. Section 4. That upon receipt of an Offer to Purchase the Real Property on terms acceptable to the City Council, the City Administrator shall forward said Offer to the City Council for its approval, pursuant to the authorization set forth herein. Section 5. That this Resolution shall be published in a newspaper published in the City of West Chicago or in the County of DuPage immediately following its passage, as required by law. Section 6. That all ordinances and resolutions, or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed. Section 7.
