August 15, 2022
Call to Order and Establishment of a Quorum: Mayor Pineda called the meeting to
order at 6:00 p.m. A quorum was established.
Members Present: Mayor Ruben Pineda
Alderman Becky Stout
Alderman Sandy Dimas
Staff Present: Michael Guttman, City Administrator
Public Participation: None
Approval of Minutes:
Alderman Dimas moved and Alderman Stout seconded a motion to approve the minutes
from the October 6, 2021 meeting. Motion unanimously passed by voice vote.
New Business:
Request by Raphael Barnes, owner of Laugh and N Joy Comedy Club Bar and
Grill, for a Class A-2 Liquor License
The Liquor Control Commission members encourage Mr. Barnes to proceed through the
process and look forward to him opening his new business.
Request by Mukesh Sharma, owner of Mike’s Wine & Spirits, for a New
Classification of Liquor License.
Mr. and Mrs. Sharma were present. Mr. Sharma presented why his operation is different
than typical packaged liquor stores that are now in West Chicago. Mrs. Sharma talked
about the tasting nights they host at their other stores. Aldermen Stout and Dimas are
concerned that the City was promised the same concept with Mr. A’s and that didn’t
occur. The Members want to visit their Hanover Park location and schedule a next
meeting.
Adjournment: Alderman Dimas moved to adjourn. Alderman Stout seconded that
motion. Voice vote showed all in favor. The meeting was adjourned at 6:30 p.m.

Mayor, Aldermen and Commissioners,
On behalf of the Western DuPage Chamber of Commerce and our members, | am requesting
both clarification and reconsideration of the Class C-4 Liquor License.
The City discontinued alcohol sales at gas/service station and grandfathered those holding this
license unless/until they were sold to a new owner or closed. This policy was upheld until the
Shell station at routes 64 and 59 was sold. In this case, the new owner negotiated to retain the
license while making improvements to the property. This station remains the only gas station
currently holding a class C-4 license; all others seeking this license have had their request
denied.
To maintain equity and fairness, the same consideration given to the Shell station owners
should be applied to all businesses meeting the same criteria. The requirements for such a
license are clearly defined in the code but are not offered to others or not applied equitably.
All classes of liquor license are regulated by increasing or decreasing the available license
when a change occurs; a business opens, closes or a licensed is revoked. This is very common
and has happened many times for every class except the C-4.
So, what is the approved criteria that the Shell station met and what is the process for others to
engage for consideration?
In today’s competitive environment, businesses and municipalities have had to realign their
operations and strategies to retain and grow revenue.
If someone wishes to fuel their car, pick up a convenience item and a bottle of wine, beer or
other alcoholic beverage, in West Chicago they must make two stops. This is not true in Carol
Stream, St. Charles and other location bordering West Chicago. The result is lost sales of fuel,
alcohol and other items; lottery, snacks, soft drinks...
Setting a minimum of 5,000 - 5500 square feet for facilities as a criteria along with the current
space, hours and method of securing alcoholic products during non-sale hours of alcohol. This
would result inno more than 10% of retail space dedicated to alcohol sales.
