The Historical Preservation Commission reviewed the proposed improvement and approved Certificate of Appropriateness 24-18. Three cost estimates for the installation of the new awnings have been submitted as required: 1) F&S Awnings for $5,700.00; 2) Thatcher Oaks Awnings for $5,990.00; and 3) Hunzinger Williams Awnings for $7,175.00. The City’s contribution is typically 50% of the lowest estimated cost(s), which would result in a grant award of $2,850.00, if approved. The funding for the Program typically comes from the Downtown TIF District. However, the termination of the prior Downtown TIF District and the establishment of the new Downtown TIF District #2 has shifted the funding source to the Community Development Department's budget within the General Fund until sufficient increment is generated. Within the 2024 budget for Fagade Grant Funding, staff determined that there are sufficient funds available to reimburse up to $2,850.00 to The Bunker Bar & Grill LLC for the completed installation of new awnings per the Program’s guidelines and in accordance with all applicable City Codes. ACTIONS PROPOSED: Consideration of a Resolution authorizing the Mayor to execute a Fagade Improvement Grant Agreement in an amount not to exceed $2,850.00 for the installation of new awnings for The Bunker Bar & Grill at 216 Main Street. ARTICLE III IMPROVEMENTS TO THE SUBJECT REALTY The APPLICANT shall complete the IMPROVEMENTS on the SUBJECT REALTY in accordance with the terms and conditions of this AGREEMENT and in full compliance with all applicable codes, ordinances, rules, regulations, permits and any conditions attached thereto, whether imposed by the CITY or any other unit of local government or any Federal, State or governmental agency having jurisdiction over the SUBJECT REALTY or any portion thereof, and shall complete the IMPROVEMENTS in a good and workmanlike manner. The APPLICANT shall furnish, or cause to be furnished, at his/her own expense, all the necessary materials, labor and equipment to complete the IMPROVEMENTS in accordance with the PLANS. The IMPROVEMENTS shall be subject to inspection by, and approval of, the Ciny.. The APPLICANT shall pay to the CITY all plan review and other fees, except building permit fees as noted below, prior to the issuance of any required building permits for the IMPROVEMENTS on the SUBJECT REALTY, as required by the CITY'S Code of Ordinances. The CITY shall issue such the building permit at fifty (50) percent of the regular building permit fee, in accordance with Sec. 4-106 (g) of the Code of Ordinances of the City of West Chicago. The APPLICANT shall complete the IMPROVEMENTS within six (6) months of the issuance of the building permit by the CITY for such IMPROVEMENTS. If the APPLICANT fails to complete the IMPROVEMENTS within the established timeframe the CITY may rescind the financial contribution agreed upon herein in this AGREEMENT. ARTICLE IV REDEVELOPMENT OF THE SUBJECT REALTY Upon the APPLICANT'S completion of the IMPROVEMENTS on the SUBJECT REALTY as provided hereinabove, the APPLICANT shall give notice of completion to the CITY, and shall provide the CITY with all receipts, sworn contractor statements and lien waivers (hereinafter referred to as the “DOCUMENTATION”) showing that all persons who have done work, or have furnished materials with respect to the IMPROVEMENTS, and might be entitled to a lien therefore under any laws of the State of Illinois, have been paid in full for their work and are no longer entitled to such lien. The City Council, following the issuance of said final inspection report and receipt of all of the required DOCUMENTATION, shall authorize payment of the CITY'S financial contribution toward the IMPROVEMENTS pursuant to the PROGRAM in an amount equal to the lesser of Two Thousand Eight Hundred Fifty Dollars and Zero Cents ($2,850.00), or one half of the amount actually paid by the APPLICANT for the IMPROVEMENTS, as indicated on the DOCUMENTATION submitted to the CITY, whichever is less. ARTICLE V TIME Time is of the essence under this AGREEMENT and all time limits set forth herein shall be mandatory and shall not be waived except by a lawfully authorized and executed written waiver amendment to this AGREEMENT by the PARTIES excusing such timely performance. ARTICLE VI AMENDMENTS This AGREEMENT sets forth all the promises, inducements, agreements, conditions and undertakings between the APPLICANT and the CITY relative to the IMPROVEMENTS identified herein this AGREEMENT, and there shall be no promises, agreements, conditions or understandings, either oral or written, express or implied, between them, other than as herein set forth. Guttman, City Administrator nr SUBJ: Class C-4 Liquor Licenses — Request to Amend the City Code DATE: October 31, 2024 At its last meeting in October 2024, the Liquor Control Commission discussed the Western DuPage Chamber of Commerce’s request to allow for gas stations, with parameters, to sell alcoholic beverages, which would require an amendment to the City Code. Attached is a letter from David Sabathne describing the request. The Liquor Control Commission directed staff to conduct research on this subject and then place the item on an upcoming City Council agenda so that all of the elected officials can participate in the discussion. Current Landscape At this time, there is only one C-4 Liquor License available, which is held by True North which operates its convenience store and gas station at the southeast corner of Routes 59/64. This license authorizes the retail sale, on the premises, of alcoholic liquor in its original individual package, and not for consumption on the premises. To qualify for a Class C-4 license, the premises must be primarily used as a gas station. The floor area devoted to liquor sales shall not be in excess of five hundred (500) square feet and shall be in a segregated area, approved by the Liquor Control Commissioner, so designed to be separate and distinct. The City Code states that the number of Class C-4 licenses shall not be increased. In 2023, the City received approximately $8,800 from the local packaged liquor tax from alcohol sales at True North; it pays an annual license fee of $2,800. Over the last decade and prior to the current request, representatives from The Pride (northwest corner of Routes 59/64), Thorntons (Route 59) and Speedway (Route 38) have inquired about allowing the sale of alcoholic beverages at their locations, all of whom have been informed that it is the City Council’s desire to not increase the number of Class C-4 Liquor Licenses. Based on the results of a survey done by the DMMC in 2012, 10 of 25 responding member municipalities allowed alcohol sales at gas stations. Gurnee also does not allow exterior advertising of alcohol related signage or messaging. Next Steps Staff is looking for City Council direction as to whether or not it is interested in allowing additional Class C-4 Liquor Licenses to be issued. If it is, direction is needed on the types of additional regulations, if any, that it wishes to require of the holders of Class C-4 Liquor Licenses. ' Beer in containers of 16 ounces or less shall not be sold to any person in quantities of less than six cans or bottles for consumption; this regulation applies to all packaged liquor license holders. ? Doing Right for Business!” City of West Chicago 475 Main Street West Chicago, IL 60185 September 5, 2024 Mayor, Aldermen and Commissioners, On behalf of the Western DuPage Chamber of Commerce and our members, | am requesting both clarification and reconsideration of the Class C-4 Liquor License. The City discontinued alcohol sales at gas/service station and grandfathered those holding this license unless/until they were sold to a new owner or closed. This policy was upheld until the Shell station at routes 64 and 59 was sold. In this case, the new owner negotiated to retain the license while making improvements to the property. This station remains the only gas station currently holding a class C-4 license; all others seeking this license have had their request denied. To maintain equity and fairness, the same consideration given to the Shell station owners should be applied to all businesses meeting the same criteria. The requirements for such a license are clearly defined in the code but are not offered to others or not applied equitably. All classes of liquor license are regulated by increasing or decreasing the available license when a change occurs; a business opens, closes or a licensed is revoked. This is very common and has happened many times for every class except the C-4. So, what is the approved criteria that the Shell station met and what is the process for others to engage for consideration? In today’s competitive environment, businesses and municipalities have had to realign their operations and strategies to retain and grow revenue. If someone wishes to fuel their car, pick up a convenience item and a bottle of wine, beer or other alcoholic beverage, in West Chicago they must make two stops. This is not true in Carol Stream, St. Charles and other location bordering West Chicago. The result is lost sales of fuel, alcohol and other items; lottery, snacks, soft drinks... Setting a minimum of 5,000 - 5500 square feet for facilities as a criteria along with the current space, hours and method of securing alcoholic products during non-sale hours of alcohol.
