Call to Order, Roll Call and Establishment of a Quorum Chairperson Laimins called the meeting to order at 7:00 p.m. Roll call found Chairperson Laimins, and Commissioners Kasprak, Banasiak, Billingsley, Henkin, Slattery, and Terrazas present. With all seven members present, a quorum was established. Staff in attendance included City Planner John Sterrett. 2. Pledge of Allegiance Chairperson Laimins led the Commission in the Pledge of Allegiance. 3. Chairperson’s Comments Chairperson Laimins explained the Rules of Procedure for the Plan Commission for those in the audience. 4. Public Comment None. 5. Public Hearing of Case PC 24-10 – Preliminary Planned Unit Development and Zoning Map Amendment – Redwood USA, LLC – 30W300 North Avenue Commissioner Billingsley made a motion, seconded by Commissioner Henkin, to open the public hearing. With a voice vote of all ayes, the motion carried. Mr. Sterrett was duly sworn in. Mr. Sterrett stated that this is a request from Redwood USA LLC, for a Preliminary Planned Unit Development, a Preliminary Plat of Subdivision, and a Zoning Map Amendment for the property at 30W300 North Avenue, for a 139-unit one-story town-home style rental development know as Redwood Apartments. The property is located on the north side of North Avenue at Atlantic Drive, approximately 1,275 feet west of Illinois Route 59. The property is entirely vacant and is heavily wooded on the east side of the property with wetlands. The property is approximately 43 acres with approximately 2,160 feet of frontage along North Avenue. The property is adjacent to the Pratt’s Wayne Woods Forest Preserve to the west and north, the Woods of St. Andrews residential development to the north, Pasquinelli’s Ashmore Estates residential development to the east and northeast, the Wood Glen Senior Residences and Aperion Care to the east, various commercial, industrial, and vacant properties to the south. The property has split zoning with B-3 General Business District located primarily along North Avenue and R-6 Multiple-Family Residential mostly in the rear of the property. The property was originally approved in 2007 as a Planned Unit Development for a mixed-use development ===== PDF PAGE 3 ===== [Extraction: embedded PDF text] with townhomes in the rear of the property on the R-6 portion and commercial development on the B-3 portion along North Avenue, known as Kipling Woods at St. Andrews. This project never moved forward after approval because of the downturn in the economy the following year. Redwood is under contract to purchase the property and is proposing to re-subdivide the property into two lots with Lot 1 to have the townhome style units known as Redwood Apartments primarily in the rear of the property, and Lot 2 along North Avenue for future commercial development. The proposed lots do not match up exactly with the existing zoning districts of B-3 and R-6 so the district lines need to be modified slightly. The petitioner is proposing a zoning map amendment so that Lot 1 is entirely within the R-6 District and Lot 2 is entirely within the B-3 District. The lots will be served by the existing signalized full access at Atlantic Drive and North Avenue. The petitioner is also proposing a second access onto North Avenue further west as a right- in/right-out. Lot 2, which will have the Redwood Apartments, will be entirely owned, operated, and maintained by Redwood. The internal drives on the property will be private, owned and maintained by Redwood. The petitioner has submitted landscape standards, with details on how they intend to install landscaping around the perimeter of the site and foundation landscaping. As mentioned, there are wetlands on the property that Redwood will be impacting with the proposed development. To comply with the County’s Stormwater Management Ordinance, the petitioner intends to purchase wetland credits. As a preliminary planned unit development and zoning map amendment, the petitioner notified all property owners within 250 feet of the subject property advertising the public hearing, placed a hearing sign, both in English and Spanish, on the property, and a notice advertising the public hearing appeared in the September 30th edition of the Daily Herald. Staff is recommending preliminary approval of the proposed plan and zoning map amendment and has drafted findings of fact supporting this recommendation. Paul DeKruiff of Redwood USA, LLC, 7007 East Pleasant Valley Road, Independence, Ohio, was duly sworn in. Mr. DeKruiff provided a Powerpoint presentation of the proposed project and gave a background to the type of development proposed on the property and reviewed some aspects of the property itself. Kevin Sarafin of CEMCON Ltd., 2280 White Oak Circle #100, Aurora, Illinois was duly sworn in. Mr. Sarafin is the project engineer for the proposed development. Mr. Sarafin elaborated on the site conditions such as the grading and the existing wetlands. Mr. Sarafin explained how the proposed stormwater management area would function and discussed a proposed retaining wall along the northeast property lines to address the changes in grade. Mr. Sarafin also highlighted the distances of the proposed townhomes to the property lines adjacent to the existing residential lots. Chairperson Laimins stated that a letter was received from the DuPage County Forest Preserve expressing concerns about the proposed project and that a response from the petitioner was received as well. All written correspondence was sent to the members of the Plan Commissioners prior to the public hearing for review. The following members of the public were duly sworn in and stated the following testimony: Darren Dandre, 420 Saint Andrew’s Court, raised concerns about removal of the large amount of significant trees and stressed trying to preserve these trees and had concerns about sewer and water utilities. Tom Scott, 450 Saint Andrew’s Court, raised concerns about the additional burden the proposal would place on the schools. Lindsay Scott, 450 Saint Andrew’s Court, raised concerns about the proposed retaining wall and its impact on the adjacent properties. Hugo Van Nispen, 471 Saint Andrew’s Court, raised concerns about stormwater runoff from the proposal affecting adjacent properties. Irene Noe, 370 Chippewa Lane, asked questions about how far the development and the houses would be to her property. Debbie Keeling, 380 Chippewa Lane, stated she is not in favor of the proposed project for a variety of reasons, which have been previously mentioned by other residents. Scott Bublitz, 355 Indianwood Lane, raised concerns about affect of home values, taxes, and crime. With all members of the public having had the opportunity to speak, and with all Plan Commissioners having the opportunity to question staff, Commissioner Kasprak made a motion, seconded by Commissioner Terrazas, to close the public hearing. With a voice vote of all ayes, the motion carried and the public hearing was closed. 6. Review and Recommendation of Case PC 24-10 – Preliminary Planned Unit Development, Preliminary Plat of Subdivision, and Zoning Map Amendment – Redwood USA, LLC – 30W300 North Avenue The Plan Commission deliberated the proposed Preliminary Planned Unit Development and Zoning Map Amendment. After a discussion, Commissioner Billingsley made a motion, seconded by Commissioner Kasprak, to recommend approval of the proposed Preliminary Planned Unit Development, Preliminary Plat of Subdivision, and Zoning Map Amendment with the following conditions: 1. That the site be developed in substantial conformance with the following plans: a. Preliminary PUD Plan, consisting of 3 sheets prepared by Cemcon, Ltd. dated April 24, 2024 with a revision date of August 16, 2024. ===== PDF PAGE 5 ===== [Extraction: embedded PDF text] b. And incorporate the following Findings of Fact into the recommendation: Preliminary Planned Unit Development Findings of Fact (A) In what respects the proposed plan is consistent with the comprehensive plan and the stated purpose and intent of the planned unit development regulations. The proposed plan of commercial along North Avenue and residential on the balance of the property is consistent with the Comprehensive Plan, which indicates corridor commercial along North Avenue with residential in the rear of the subject property. (B) The extent to which the proposed plan meets the requirements and standards of the planned unit development regulations. The proposed Planned Unit Development complies with the requirements and standards contained in Section 15.7 and Section 15.7-2 of the Zoning Code. No variations to these requirements are sought to accomplish the project. (C) The extent to which the proposed plan departs from the zoning and subdivision regulations otherwise applicable to the subject property including, but not limited to, the density, dimension, area, bulk and use and the reasons why such departures are deemed to be in the public interest. No deviations from the Zoning Code for the residential development are being sought. All requirements of the R-6 Multi-family District have been satisfied. (D) The method by which the proposed plan makes adequate provision for public services, provides adequate control over vehicular traffic, provides for and protects designated common open space and furthers the amenities of light and air, recreation and visual enjoyment. The proposed development will utilize the existing signalized intersection at North Avenue and Atlantic Drive and will construct an access drive from the north leg of this intersection. The proposal received preliminary approval for engineering and will have a more in depth review of stormwater and utilities during final engineering. Approximately sixty percent of the site will remain as common open space, to be maintained by Redwood. The proposed townhomes are one-story and will limit obstruction of light and air to surrounding properties. (E) The relationship and compatibility of the proposed plan to the adjacent properties and neighborhood. The subject property is adjacent to two existing multi-family residential developments to the east with single-family developments to the north and northeast. The proposed townhome-style rental units will be consistent with the existing multi-family developments in the area and will provide ===== PDF PAGE 6 ===== [Extraction: embedded PDF text] a transition between the future commercial development along North Avenue and the existing single-family homes to the north and northeast. (F) The desirability of the proposed plan as regards physical development, tax base and economic well-being of the city. The proposed plan is a mixed-use development with future commercial opportunities along North Avenue and proposed multi-family residential in the rear, both consistent with the City’s Comprehensive Plan. The future commercial opportunities along North Avenue will enhance the City’s economic base and provide retail opportunities west of the Route 59/North Avenue commercial hub. Furthermore, the proposed residential development provides additional housing options for the City, consistent with the goals and objectives within the Comprehensive Plan. Zoning Map Amendment Findings of Fact (A) The existing uses and zoning of the property in question. The subject property contains two zoning districts – the B-3 Regional Shopping District along North Avenue and the R-6 Multi-Family Residence District on the balance of the property. The property is currently vacant but was placed in these districts in anticipation of a mixed-use development known as Kipling Woods, which never came to fruition. (B) The existing uses and zoning of other lots in the vicinity. Other properties along North Avenue in the general vicinity are also located within the B-3 District and have commercial uses. Multiple lots adjacent to the east of the balance of the property are within the R-6 district and contain multi-family dwelling structures. (C) Suitability of the property in question for uses already permitted under the existing regulations. The subject property is suitable for the existing districts in which it is located in. The proposed development, however, requires a slight modification to the zoning district lines to accommodate the mix of residential use in the rear of the property and the future commercial use along North Avenue. (D) Suitability of the property in question for the proposed use. As previously mentioned, the proposed development requires a slight modification to the zoning district lines to accommodate the mix of residential use in the rear of the property and the future commercial use along North Avenue. (E) The trend of development in the vicinity of the property in question, including any recent zoning activity. The trend in the development in the general area is consistent with B-3 lots along North Avenue and R-6 lots immediately to the east. (F) The effect the proposed rezoning would have on implementation of the Comprehensive Plan. The proposed rezoning will not affect the surrounding properties. The rezoning is only to modify the existing district lines slightly to accommodate the new development. The proposed rezoning will not have a detrimental impact on the health, safety, nor welfare of the community and will be consistent and compatible with other zoning in the general vicinity. A roll call vote found Commissioners Billingsley, Kasprak, Banasiak, Henkin, Slattery, and Terrazas, and Chairperson Laimins voting “aye”. No one voted “no”. With a roll call vote of seven (7) “aye” and zero (0) “no”, the motion carried. 7. Public Hearing of Case PC 24-18 – Zoning Text Amendment – Uses in the M Manufacturing District – Data Centers – City of West Chicago Commissioner Kasprak made a motion, seconded by Commissioner Slattery, to open the public hearing. With a voice vote of all ayes, the motion carried. COMMUNITY DEVELOPMENT TOM DABAREINER, AICP (630) 293-2200 DIRECTOR FAX (630) 293-1257 www.westchicago.org MEMORANDUM TO: Plan Commission/Zoning Board of Appeals FROM: John Sterrett, City Planner DATE: November 26, 2024 RE: Case PC 24-15 – Turner Elementary School Special Use Permit for Parking Lot Reconfiguration/Expansion – West Chicago School District 33 At the November 6, 2024 Plan Commission meeting, the Commission opened a public hearing for Case PC 24-15 to hear a request from West Chicago Elementary School District 33 for approval of a Special Use Permit for a public elementary school at 750 Ingalton Avenue, which has been used as Turner Elementary School for several decades and will continue as such. At the hearing, the School District stated their plans to reconfigure the existing parking lot on the east side of the building. The School District also intends to construct a new parking lot immediately south of the existing parking lot. The School District explained that a one-way driveway from the new southern parking lot to National Street will be constructed to serve as an exit for passenger vehicles leaving the drop-off/pick-up lane. This driveway will be installed adjacent to an existing multi-use path that is owned and maintained by the School District. During public comment at the hearing, concerns were raised from residents that live immediately to the east of the proposed driveway onto National Street. One concern was that the driveway would be constructed over an existing sanitary line and could damage the line. The potential for cars using this driveway during non-school hours was also raised as a concern as well as cars speeding on the driveway. Finally, testimony was provided by residents that an easement exists over the portion of the School District property where the driveway is to be located and that this easement contains language prohibiting use of this portion of the property for anything but a multi-use path. Because of these concerns, members of the Plan Commission voted unanimously to continue the hearing to the December 3, 2024 meeting for resolution to these concerns. The School District has revised their plan to reduce the width of the driveway onto National Street to twelve (12) feet, which is the minimum width required. The reduction in width will allow the driveway to be constructed without being on top of the sanitary line and will also leave twenty (20) feet between the edge of the proposed driveway and the residential properties to the east. The School District is also proposing to install a gate at the entrance to the proposed parking lot that will be closed and locked when school is not in session to prevent any vehicles from using the proposed driveway. Furthermore, the School District will install a speed hump on the proposed driveway to slow vehicular traffic when the driveway is in use. It should be noted that the West Chicago Fire Protection District reviewed these revisions and finds them to be acceptable, provided, however, that the proposed gate is equipped with a Knox Padlock accessible to the Fire Protection District. Finally, a title search of the property was conducted to determine if any easements exist that prevent a driveway from being installed and used in the proposed location. The only easement that exists was approved in 1996 to grant the City, from the School District, the right to keep, maintain, construct, improve, repair, replace, or remove water main within the easement. This easement is attached for review. At the December 3, 2024 Plan Commission meeting, the Commission must vote to reopen the public hearing. The public hearing will start with the School District presenting their revised plans and answer questions from members of the Plan Commission. Members of the public will then be provided the opportunity to comment on the revised plans. Once all members of the public have had the opportunity to provide comment and after the members of the Plan Commission have asked their questions, the petitioner will be afforded the opportunity to provide closing remarks. Once these tasks have been performed, the Commission must vote to close the public hearing. No additional testimony will be accepted, and no further questions, other than of procedure will be allowed. All public notice requirements were completed including a notice of public hearing published in the Daily Herald on Monday, October 21, 2024, notification to all property owners within 250 feet of the subject property, and placement of a hearing sign on the property visible from Ingalton Avenue. Existing Conditions. The subject property is 8.0 acres and has been used as Turner Elementary School for several decades. The property includes the 47,000 square-foot school building with play fields, recreational areas, and playground equipment. The building is served with a parking lot on the east side of the property with an access onto Ingalton Avenue. The property contains a multi-use path owned by the petitioner that connects to a cross walk on National Street. Proposal. The petitioner is proposing to reconfigure the existing parking lot and construct a new parking lot immediately south of the existing parking lot. The petitioner is proposing these improvements to improve student drop-off. The location and dimensions of the proposed parking lot and reconfigured parking lot comply with Zoning Code. Both the reconfigured lot and the proposed parking lot will have parking lot islands each landscaped with 3-inch caliper shade trees to comply with the landscaping requirements. The proposed driveway from the new parking lot to National Street will have deciduous shrubs alongside it. The existing parking lot access on Ingalton Avenue aligns with James Avenue. The petitioner is proposing to remove this access and install a new access onto Ingalton Avenue at the north end of the reconfigured parking lot. The reconfigured parking lot will have a dedicated drop-off lane along the entrance to the school. The proposed parking lot immediately to the south of the existing parking lot, will not be accessible from the existing parking lot and will be separated by the existing sidewalk that leads from Ingalton Avenue to the school. A new entrance off Ingalton Avenue is proposed and will have one-way traffic only into the school property. This parking lot will also feature a dedicated drop-off lane. Vehicles will exit the site on a proposed driveway from the proposed parking lot to National Street. This driveway will run next to the existing multi-use path down to National Street where an access onto National Street will be constructed. Preliminary engineering for stormwater and utilities have been approved in concept by the City’s Stormwater Engineer and Public Works Department. Special Use Findings of Fact: As stated under Section 5.5-4, the Plan Commission/Zoning Board of Appeals shall recommend a special use only if it shall make findings of fact based upon evidence presented that the special use: (A) Is necessary for the public convenience at the location or, the case of existing nonconforming uses, a special use permit will make the use more compatible with its surroundings. ***This standard should be interpreted as indicating whether or not the proposed use is good for the public at that particular physical location, and not whether or not the use itself is needed there*** The property has been used as a school for several decades and was located within a neighborhood to serve the needs of the students . Staff is of the opinion the petitioner has satisfied this finding. (B) Is so designed, located and proposed to be operated that the public health, safety and welfare will be protected: The proposed parking reconfiguration and new parking lot, each with a dedicated drop-off lane, will improve circulation on the site. Summary: The purpose of the proposed Zoning Text Amendment is to redefine a Daycare Facility to include care for all individuals, rather than just pre-elementary school aged children, and to allow a Daycare Facility as a permitted use in the B-2 General Business District, rather than a Special Use, and to allow a Daycare Facility as a permitted use in the M Manufacturing District. Recommendation: Staff recommends the Plan Commission pass a motion recommending approval of the proposed Zoning Text Amendment. Background. Staff has drafted an amendment to the Zoning Code to change the definition of a Day care center (Daycare Facility). The definition currently refers to the definition of a Nursery school, which is defined as “An establishment for the part-time care and/or instruction at any time of day of five (5) or more unrelated children of pre-elementary school age.” The current definition does not allow for anyone older than essentially 5 years of age to be placed within a Daycare Facility. This is not a practical definition and staff is of the opinion that no age limit should be placed on the definition of a Daycare Facility. All Daycare Facilities, regardless of the age they specialize in, should be permitted. Allowing Daycare Facilities that specialize in adult daycare is in keeping with the City’s Comprehensive Plan, which recommends placing emphasis on this type of care in the community. Furthermore, staff is proposing to permit a Daycare Facility by right in the B-2 General Business District, which currently requires a Special Use Permit, as well as in the M Manufacturing District, which is currently not permitted at all. A Daycare Facility is already permitted by right in the B-3 Regional Shopping District with no special use permit required. Staff is of the opinion that the same should be for the B-2 General Business District. The Comprehensive Plan recommends allowing Daycare Facilities as a permitted use in the M Manufacturing District to support workers within this district. Public Notice.
