That the foregoing recitals are hereby incorporated herein as if set forth. SECTION 2. That Chapter 1, Section 1-8(a), General penalty, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows, with all subparagraphs of Section 1-8(a) remaining unchanged: (a) Amount. The violation of or failure to comply with any provision of this Code, shall constitute an offense against the city, and shall subject the offender, upon a finding of liable, to a fine not less than one hundred fifty dollars ($150.00), for the first offense; a fine not be less than three hundred dollars ($300.00) for the second offense; a fine not less than six hundred dollars ($600.00) for the third offence and every subsequent offense thereafter. The fine for any violation hereunder shall not exceed fifteen hundred dollars ($1,500.00), except for those violations set forth in Appendix H which provide a different maximum fine amount, up to the statutory limit of $50,000.00 as provided by law, and those violations for which a greater fine is established in the Code provision governing that violation, including violations regulating size and weight of motor vehicles as set forth in Chapter 17, Article X of this Code, which are subject to the penalty structure in the Illinois Vehicle Code. SECTION 3. That Chapter 3, Section 3-3, Possession of alcoholic liquor in motor vehicle, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: Sec. 3-3.- Possession of alcoholic liquor in motor vehicle. No person shall transport, carry, possess or have any alcoholic liquor in, upon or about any motor vehicle, except in the original package with the seal unbroken. The fines and penalties for a violation of this section shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations. SECTION 4. That Chapter 3, Section 3-4, Underage consumption of alcoholic liquor, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: Sec. 3-4.- Underage consumption of alcoholic liquor. (a) The consumption of alcoholic liquor by any person under the age of twenty-one (21) years is forbidden. (b) It shall be unlawful to sell, give or deliver alcoholic liquor to any person under the age of twenty-one (21) years. (c) It shall be unlawful for any person under the age of twenty-one (21) years to misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor in any place in the city where alcoholic liquor is sold. ===== PDF PAGE 7 ===== [Extraction: OCR (rendered-page OCR)] (d) ) (f) (g) It shall be unlawful for any parent or guardian to permit any persons under the age of twenty-one (21) years old of which he or she be parent or guardian to violate any provisions of this chapter. The possession, dispensing or consumption by a person under the age of twenty-one (21), of alcoholic liquor, in the performance of a religious service or ceremony, or the consumption by a person under the age of twenty-one (21) under the direct supervision and approval of the parents or parent of such underage person in the privacy of a home, is not prohibited. It shall be unlawful for any owner or occupant of any premises located within the city to knowingly allow any person under the age of twenty-one (21) years to remain in such premises while in the possession of alcoholic liquor or while consuming alcoholic liquor in violation of this chapter. The fines and penalties for a violation of this section shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations. SECTION 5. That Chapter 3, Section 3-5, Other general restrictions, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: Sec. 3-5. Other general restrictions. (a) (b) (c) Any person to whom the sale, gift or delivery of alcoholic liquor is prohibited because of age shall not purchase or accept a gift of such alcoholic liquor or have such alcoholic liquor in his possession. No person shall transfer, alter or deface such an identification card, use such identification card, use the identification card of another, carry or use a false forged identification card, or obtain an identification card by means of false information. No person shall purchase, accept delivery or have possession of alcoholic liquor on the basis of an identification card in violation of this section. The fines and penalties for a violation of this section shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations. SECTION 6. That Chapter 9, Licenses, Permits and Business Regulations, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended by adding a new Section entitled “Sec. 9-11.- Fines and Penalties” as follows: Sec. 9-11.- Fines and penalties. Unless otherwise specifically provided, the fines and penalties applicable to violations of this chapter shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations, which is hereby adopted and incorporated by reference as though fully set forth herein. That Chapter 10, Nuisances, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended by adding a new Section entitled “Sec. 10-6.- Fines and Penalties” as follows: Sec. 10-6.- Fines and penalties. Unless otherwise specifically provided, the fines and penalties applicable to violations of this chapter shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations, which is hereby adopted and incorporated by reference as though fully set forth herein. For any violation of this chapter that is not listed in Appendix H, the general penalty provision set forth in chapter 1 of this Code shall apply. The city may enforce any offense under this chapter through its administrative adjudication system, by filing a complaint in a court of competent jurisdiction, or by any other lawful means authorized by this Code or state law. The fines and penalties for a violation of this article shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations. For any violation of this article that is not listed in Appendix H, the fine amounts stated in the general penalty provision set forth in chapter 1 of this Code shall apply. SECTION 10. Prohibited conduct on public ways. (a) (b) (c) (d) (e) (f) It shall be unlawful for any person or group of persons to collect upon a public way for any unlawful purpose. It shall be unlawful for any person or group of persons to annoy any other person or persons upon any public way. It shall be unlawful for any person or group of persons to block, hinder or delay the passage of any person or persons upon a public way. It shall be unlawful for any person or group of persons to use the public ways for lying, sitting or picnicking thereon. It shall be unlawful for any person to deposit any snow, garbage or refuse of any kind, description or nature in any street, alley or public way, and no such refuse shall be so placed that it can be blown about or scattered by the wind. (1) It shall be the duty of the public works personnel, as are designated and assigned by the director of public works, to enforce all laws and regulations, as provided for in this Chapter 15, relating to the city's public ways. Nothing in this section precludes any city officer or official expressly authorized in this chapter from also enforcing the City Code provisions relating to the regulating of the city's public ways. The fines and penalties for a violation of this section shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations. SECTION 11. That Chapter 17, Section 17-2, Penalties and related provisions, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: (a) (b) The court upon making a finding of guilty for any offense under section 17-11-501 of this code, in addition to any sentencing alternatives elected by the court, shall impose a fine of not less than seven hundred fifty dollars ($750.00) nor more than two thousand five hundred dollars ($2,500.00) for each such offense. Unless otherwise specifically provided, the fines and penalties applicable to violations of this chapter shall be as set forth in Appendix H — Schedule of Fines and Penalties for Code Violations, which is hereby adopted and incorporated by reference as though fully set forth herein. For any violation of this chapter that is not listed in Appendix H, the fine amounts stated in the general penalty provision set forth in chapter 1 of this Code shall apply. That the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended by adding a new Appendix entitled “Appendix H—Schedule of Fines and Penalties for Code Violations” as follows: APPENDIX H — SCHEDULE OF FINES AND PENALTIES FOR CODE VIOLATIONS Sec. 1 Purpose and applicability. This Appendix is adopted as a comprehensive schedule of fines and penalties applicable to designated violations of the West Chicago Municipal Code. The fines set forth herein shall apply unless otherwise specifically provided in the body of the Code. Violations listed in this Appendix may be enforced through the City’s administrative adjudication system, by prosecution in a court of competent jurisdiction, or by any other lawful means authorized by this Code or state law, as determined appropriate by the City. For any violation of the Municipal Code not listed in this Appendix, the general penalty provisions of Chapter 1 shall apply, unless otherwise specifically provided in the body of the Code. Sec. 2 Schedule of Fines and Penalties. See Exhibit A attached hereto and incorporated by reference as if fully set forth herein. SECTION 13. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed insofar as they conflict herewith. SECTION 14. and WHEREAS, the City seeks to amend its administrative adjudication provisions to expressly provide for the applicability of the fine amounts set forth in Appendix H to relevant violations adjudicated through the City’s administrative adjudication system; and WHEREAS, the City also seeks to expand the scope of its administrative adjudication system to include additional types of code violations enforceable under its home rule authority, thereby enhancing the City’s ability to protect public health, safety, and welfare, while providing convenience to the residents for resolving Code violations; and WHEREAS, the Mayor and City Council find that these amendments are in the best interests of the City and its residents and will promote the efficient enforcement of the City Code. Section 4: That Chapter 8, Section 8-12, Enforcement of administrative law judge’s order, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: (a) Any fine and any administrative, enforcement, or compliance costs imposed by an administrative law judge's order that remain unpaid after the exhaustion of, or the failure to exhaust, judicial review procedures, unless stayed by a court of competent jurisdiction, shall be a debt due and owing the city and may be collected in accordance with applicable law. In any case in which a respondent fails to comply with an administrative law judge's order to correct a Code violation, and where such order was issued pursuant to the City’s authority to adjudicate code violations under applicable state law, any expenses incurred by the city to enforce the administrative law judge's order, including but not limited to attorney's fees, court costs and costs related to property demolition or foreclosure, shall be a debt due and owing the city. Prior to any expenses being fixed by an administrative law judge pursuant to this subsection (d), the respondent shall be provided with notice that directs the respondent to appear at a hearing before an administrative law judge to determine whether the respondent has failed to comply with the administrative law judge's order. The notice shall set the place and the time for the hearing, which shall not be less than seven (7) days from the date the notice is served. Notice may be served by first class mail or by an overnight or two-day commercial delivery service and the seven-day period shall begin to run on the date that the notice was personally served, deposited in the mail or placed with the overnight or commercial delivery service. Nothing in this section shall prevent the city from enforcing or seeking to enforce any order of an administrative law judge in any manner provided by law. Section 5. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed insofar as they conflict herewith. Section 6. The recorded image must also display the time, date, and location of the violation. Disregarding a traffic control device means failure to stop and remain stopped before an intersection that is controlled by a red signal as provided for in section 11-306 of the Code. No turn on red means where the motor vehicle comes to a complete stop and does not enter the intersection as defined by section 1-132 of the Code, during the cycle of the red signal indication unless one (1) or more pedestrians are present, even if the motor vehicle stops at a point past a stop line or crosswalk where a driver is required to stop, as specified in subsection (c) of Section 11-306 of the Code or this Ordinance Recorded images means images produced by the automated traffic law enforcement system, which consist of either two (2) or more photographs; two (2) or more microphotographs; two (2) or more electronic images; or, a video recording showing the motor vehicle and, on at least one (1) image or portion of the recording, clearly identifying the registration or digital registration plate number of the motor vehicle. Traffic compliance administrator means the person appointed as such pursuant to section 11- 208.3 of the Code and shall have the following additional powers: adopt, distribute and process automated traffic law violation notices and other notices required by this article, collect money paid as fines and penalties, operate the automated traffic law enforcement system, and make certified reports to the Secretary of State as required by this article. SECTION 3: That Chapter 17, Article XX, Section 17-2022, Defenses, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: The following may be considered defenses by the hearing officer for a violation of section 17-2021: (1) That the motor vehicle or registration plates or digital registration plates of the motor vehicle were stolen before the violation occurred, and not under the control of or in the possession of the owner at the time of the violation; (2) That the motor vehicle was hijacked before the violation occurred and not under the control of or in the possession of the owner or lessee at the time of the violation; (3) That the driver of the vehicle passed through the intersection when the light was red either (i) in order to yield the right-of-way to an emergency vehicle or (ii) as part of a funeral procession. (4) Any other evidence or issues provided by City Code. To demonstrate that the motor vehicle was hijacked or the motor vehicle or registration plates or digital registration plates were stolen before the violation occurred and were not under the control or possession of the owner or lessee at the time of the violation, the owner or lessee must submit proof that a report concerning the stelern motor vehicle or registration plates was filed with a law enforcement agency in a timely manner. ===== PDF PAGE 41 ===== [Extraction: OCR (rendered-page OCR)] Unless the driver of the motor vehicle received a Uniform Traffic Citation from a police officer_at the time of the violation, the motor vehicle owner is subject to a civil penalty not exceeding $100 or the completion of a traffic education program, or both, plus an additional penalty of not more than $100 for failure to pay the original penalty or to complete a required traffic education program, or both, in a timely manner, if the motor vehicle is recorded by an automated traffic law enforcement system. A violation for which a civil penalty is imposed under this Section is not a violation of a traffic regulation governing the movement of vehicles and may not be recorded on the driving record of the owner of the vehicle. A registered owner who is a holder of a valid commercial driver’s license is not required to complete a traffic education program. For purposes of the required traffic education program only, a registered owner may submit an affidavit to the court or hearing officer swearing that at the time of the alleged violation, the vehicle was in the custody and control of another person. The affidavit must identify the person in custody and control of the vehicle, including the person’s name and current address. The person in custody and control of the vehicle at the time of the violation is required to complete the required traffic education program. If the person in custody and control of the vehicle at the time of the violation completes the required traffic education program, the registered owner of the vehicle is not required to complete a traffic education program. SECTION 4: That Chapter 17, Article XX, Section 17-2023, Notice of violation, of the Code of Ordinances of the City of West Chicago, Illinois, is hereby amended as follows: When the automated traffic law enforcement system records a motor vehicle entering an intersection in violation of section 17-2021, the city shall issue a written notice of violation to the registered owner or lessee of the vehicle, which shall be delivered by U.S. mail within thirty (30) days after the Illinois Secretary of State notifies the city of the identity of the registered owner or lessee of the vehicle, and in no event later than ninety (90) days following the violation. No person who is the lessor of a motor vehicle pursuant to a written lease agreement shall be liable for a violation under this Article occurring during the lease period, provided that the lessor, within sixty (60) days of receiving a written request from the City made within one hundred twenty (120) days after the violation, furnishes the name and address of the lessee. The lessor must supply the information by affidavit, accompanied by a copy of the lease agreement. The city shall only be required to notify a lessee if the leasing company/lessor provides the lessee's name by an affidavit and a copy of the lease within the time specified herein. sixty-{60)}-days-efthe netice’s issuance: If the driver information is not provided within the time allowed sixty(60}-days, the leasing company/lessor may be found liable. A notice of violation associated with an automated traffic law violation shall require a review of the associated recorded image by the traffic compliance administrator, who shall inspect the image and determine whether the motor vehicle was being operated in violation of section 17- 2021, or whether one (1) of the defenses enumerated in section 17-2022 is visibly applicable upon inspection. Each notice of violation shall constitute evidence of the facts contained in the notice and is admissible in any proceeding alleging a violation of the above-noted statutory and local provisions and shall be prima facie evidence of a violation, subject to rebuttal on the basis of the defenses established in this article. The notice of violation shall include the following information: (1) The name and address of the registered owner or lessee of the vehicle, as indicated by the records of the Secretary of State, or, if such information is outdated or unattainable, then the last known address recorded in a United States Post Office approved database; (2) The make (only if discernable) and registration number of the motor vehicle involved in the violation; (3) The violation charged; (4) The location where the violation occurred; (5) The date and time of the violation; (6) Acopy of the recorded images; (7) The amount of the civil penalty and the date by which the penalty should be paid (fourteen (14) days from the date of issuance), if a hearing is not requested, and a statement that the payment of the fine shall operate as a final disposition of the violation; (8) A statement that a failure to pay the civil penalty by the date noted may result in an additional late fee being assessed against the owner or lessee; (9) The amount of the late fee; (10) A statement that the failure to pay the civil penalty, to complete the required traffic education program, or to contest liability by the date specified will result in a final determination of liability and may result in the suspension of driving privileges for the registered owner of the vehicle; (11) A statement that the recorded images constitute prima facie evidence of a violation; (12) A statement that the person may elect to proceed by paying the fine, completing a required traffic education program, or both; or by challenging the charge in court, by mail or by administrative hearing; and (13) A_website address, accessible through the Internet, where the person may view the recorded images of the violation. The research demonstrates that while many communities still do not allow the keeping of chickens on residential property, the practice is still common in the general area. Reasons for prohibit- ing chickens on residential property include the potential for becoming a nuisance, the fear of disease spreading, and attraction of rodents. Strict regulations on the use, however, would mitigate negative impacts while still allowing property owners the enjoyment of raising chickens. The regulations to allow chickens on residential property recommended by staff include: Limited to single-family detached residences only with a minimum lot size of 6,500 square feet. No more than 6 hens. Roosters are prohibited. A chicken coop shall be required with a minimum setback of 10 feet from all lot lines and a mini- mum size of 6 square feet per chicken. Chicken coops shall only be permitted in the rear yard. All feed shall be maintained in rodent-proof containers. No slaughtering is permitted. No sales of eggs or chickens permitted. No other poultry, livestock, or other farm type animals permitted. ACTION PROPOSED: Consideration of allowing chickens on residential properties with regulations. If the members of the Committee would like to proceed with allowing chickens on residential properties, they should direct staff to initiate a zoning text amendment which would include a public hearing with the Plan Commis- sion. When the employee entered the back room to retrieve phones, a UPS driver arrived to deliver some merchandise. The suspect took two of the boxes and fled from the store. North Ave. The victim left the apartment, and when he returned, his roommate and the items were gone. She did not authorize the account and had no connection to the address. Theft From Motor Vehicle: #2500522 Person(s) unknown entered the victim's vehicle while parked in the 1900 block of Franciscan Way. The owner was unsure if he had locked the car. The suspect took gym clothes, shoes, a wallet, credit cards, and a driver's license. Theft of Motor Vehicle Parts/Accessories: #2500516 Person(s) unknown removed the hoods from two truck tractors parked in the 1800 block of Hawthorne Ln. worth $20,000.00. Burglary: #2500453 Person(s) unknown entered an apartment in the 1200 block of Kings Ct. A neighbor saw three subjects exit the apartment when the owners weren't home. Officers noted pry marks on the door and damage to the door latch. The investigation is ongoing. Officer Guerra ran the registration through the Law Enforcement Agency Data System (LEADS) and confirmed a revoked registration. Additionally, the add-on from LEADS stated that the occupants should be held for questioning by the Secretary of State Police. Officer Guerra stopped the vehicle at the intersection of Roosevelt Rd. and Washington St. Officer Frommert arrived to assist. Officers also noted that the VIN plate on the dash had been tampered. The driver followed the officers back to the Police Station. The driver consented to a vehicle search, and a reader confirmed the actual VIN came back stolen from Markham, Il. A Secretary of State agent arrived at the Police Station, took possession of the vehicle, and took over the investigation. #2500443 On March 17", Officer Frommert observed a white van entering the Menards parking lot at 220 W. North Ave. Officer Frommert's training and experience taught him that U-Haul vans can be stolen, retagged, and resold. The van was unoccupied in the lot. Running the van through Carfax, Officer Frommert noticed several discrepancies. The VIN on the dashboard appeared to have been tampered and was not lying flat. Officer Schane and Sergeant Reyes arrived to assist, and the officers located a confidential VIN on the van's exterior. Running this confidential VIN, it came back as being stolen out of Chicago in 2021. The driver of the vehicle exited the store. He stated that he bought the van on Facebook Marketplace. Officer Frommert contacted the Secretary of State Police. The Secretary of State Police requested the van be brought to the Police Station for further investigation. The driver was allowed to remove his tools from the truck while the Secretary of State Police took over the investigation. #2500480 On March 24", Officer Solis observed a vehicle with no front plate displayed and no functioning rear registration plate light. Officer Solis stopped the car at the 200 block of Allen Ave. Officer Schiever arrived to assist. As a result of questioning, the occupant admitted that there was a firearm and a "small little joint." in the vehicle. Officers located cannabis in the ashtray and a loaded Smith & Wesson 9mm handgun on the rear passenger seat. Officers arrested the subject, transported him to the Police Station, and conducted an interview. The suspect stated he operates as an Uber driver and, in the past, was carjacked. A cousin lent him the firearm for protection. The driver had neither a Firearms Owner Identification Card (FOID) nor a Concealed Carry License (CCL). The DuPage County State's Attorney's Office approved a charge of Aggravated Unlawful Use of Weapon- No FOID/CCL. He was processed and transported to the DuPage County Jail. 10
