Regular Meeting
July 21, 2025
1. Call to Order. Mayor Bovey called the meeting to order at 7:00 p.m. on July 21,
2025.
2. Pledge of Allegiance. Mayor Bovey led all in the Pledge of Allegiance.
3. Roll Call and Establishment of a Quorum.
Roll call found Dan Beebe, Julieta Alcantar-Garcia, Rebecca Stout, Sandy Dimas,
Melissa Birch Ferguson, Denise Carreto-Mufioz, Joseph C. Morano, Jayme Sheahan,
John Smith, Jr. Carlos Avifia Soto, and Matthew Myers were present. Alderman Alton
Hallett and Christopher Swiatek were absent.
Also in attendance Assistant City Administrator Tia Messino, Business & Community
Relations Director Kelley Chrisse, Community Development Director Tom Dabareiner,
Public Works Director Mehul Patel, and Attorney Keri-Lyn Krafthefer.
4. Public Participation.
A. Louise Handel — Mrs. Handel spoke regarding West Chicago Sister Cities. She
also expressed some issues with Wheaton Academy.
B. Heather Niziolek — Mrs. Niziolek talked about truth, accountability, and the right
the public has to know what happens inside city hall. She’s requesting the
release of executive session minutes regarding Resolution 22-R-0051.
C. Sugeira Tellez — Ms. Tellez along with Rafael Vieyra and Tom Tawney on behalf
of Despertar Latino presented a proposal for the Mexican Independence Day
celebration this year.
D. Tim Devitt — Mr. Devitt thanked Alderman Morano for taking care of an issue. He
spoke near bad accidents happening on Route 59 and Joliet Road when drivers
make an illegal left on the church parking lot. Mr. Devitt also expressed the need
for elected officials to fully disclose the reason why they motion to table an item.
5. City Council Meeting Minutes of July 7, 2025. Alderman Birch Ferguson made a
motion, seconded by Alderman Smith to approve the minutes of July 7, 2025.
Aldermen Alcantar-Garcia, Beebe and Avifia Soto pointed out some needed
corrections.
Voting Aye by Voice Vote: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson,
Smith, Carreto-Mufioz, Avifia Soto, Santiago, Sheahan, Morano and Myers. Motion
carried.
6. Corporate Disbursement Report. Alderman Dimas made a motion to approve the
amended amount, seconded by Alderman Myers approving the July 7, 2025, Corporate
Disbursement Report in the amount of $372,175.51.
Alderman Beebe pointed out a correction in the amount.

7. Consent Agenda:
Alderman Myers requested Item 7.G. be pulled from the consent agenda.

on Single-Family Residential Properties.
B. Ordinance No. 25-O0-0026 — An Ordinance Amending the Code of
Ordinances of the City of West Chicago to Create and Permit the Temporary
Use of Temporary Outside Seasonal Events.
Alderman Stout made a motion, seconded by Alderman Birch Ferguson.

*Infrastructure Committee:
C. Approve — The Purchase of Three 2025 Ford F-350 Super Cab 4x4 Pick-
Up Truck, for a cost not to exceed $151,341.00, from Haggerty Ford, and
Authorize the City Administrator to Contract with a Third-Party to Install the
Necessary Appurtenances/Equipment for Those Three Vehicles.
D. Approve — The Purchase and Delivery of Up to 2,080 Tons of Road Salt,
at the price of $147,243.20, from Compass Minerals America, Inc., under
the DuPage County Road Salt Joint Purchasing Program for the 2025-2026
Winter Season.
E. Resolution No. 25-R-0044 -— A Resolution Authorizing the Mayor to
Execute Amendment No. 1 for Professional Environmental Services with
Civil & Environmental Consultants, Inc. for the West Washington Street Soil
Removal Project in an Amount Not to Exceed $130.000.00 for a Revised
Contract Amount of $254,750.00.
F. Resolution No. 25-R-0047 — A Resolution Authorizing the Mayor to
Execute a Contract with Civiltech Engineering, Inc. for the Preliminary
Design Engineering Services Related to the Downtown Revitalization
Project in an Amount Not to Exceed $219,341.23.
Alderman Morano made a motion, seconded by Alderman Beebe.
Attorney Krafthefer interrupted the meeting to inform Council members of the procedure
that needs to take place to approve the established consent agenda.
Alderman Birch Ferguson made a motion, seconded by Alderman Dimas to approve the
consent agenda not including Items 7.G, J, K, N, P, Q, R and 9.A.

Alderman Dimas made a motion to approve Items 7.0 and S, seconded by Alderman
Beebe.

At this point City Council discussed the items pulled.
G. Approve — Wheaton Academy's Homecoming Event — Scheduled on September

Alderman Myers made a motion to approve item G, seconded by Alderman Dimas.
Alderman Myers said the reason he pulled it from the consent agenda was in light of the
comments. He would like staff to inquire about the issues that were presented to them.
Mayor Bovey and Chief Fleury will meet with Wheaton Academy staff and follow-up with
the Mrs. Handel.

Alderman Alcantar-Garcia said she removed item J from the consent agenda and recuses
herself as she is co-founder of Despertar Latino.
Alderman Birch Ferguson made a motion to approve item J, seconded by Alderman
Stout.

K. Resolution No. 25-R-0050 — A Resolution Authorizing the Mayor to Enter Into a
Funding Agreement with Despertar Latino to Support the 2025 Mexican
Independence Day Event.
Alderman Alcantar-Garcia again removed item K from the consent agenda and recuses
herself as she is co-founder of Despertar Latino.
Alderman Dimas made a motion to approve item K, seconded by Alderman Birch
Ferguson.
Alderman Morano asked if it’s possible to add the amount of $16,500 in the resolution
title.
Mayor Bovey explained that this year the organizers decided not to have a parade. He
also explained what the funding entails.
Alderman Dimas made a motion to amend item K to include the $16,500 amount,
seconded by Alderman Morano.
Voting Aye by Roll Call: Beebe, Stout, Dimas, Birch Ferguson, Smith, Carreto-Mufioz,
Santiago, Sheahan, Morano, Avifia Soto and Myers. Motion carried. Voting Abstained:

Alderman Morano made a motion to table item N, seconded by Alderman Santiago.
Both Alderman Morano and Mayor Bovey agree more information is needed to
understand this better and be able to vote on it.
Alderman Alcantar-Garcia asked if there could be some sort of open house so
constituents can understand the taxes being considered.
There was discussion about having a special meeting.

P. Ordinance No. 25-00-0031 — An Ordinance Amending the Code of Ordinances
of the City of West Chicago Regarding C-4 Liquor License Classification (Alcohol
Sales at Gas Stations).
Alderman Alcantar-Garcia made a motion to approve item P, seconded by Alderman
Beebe.
Alderman Beebe wanted to make a change to the ordinance as written, limited to beer
and wine only.
Alderman Morano agreed with Alderman Beebe.
Alderman Myers asked why the square footage was reduced from 3,500 to 2,500.
Kelley Chrisse explained the change was due to a scriveners error.
Mayor Bovey asked Ms. Chrisse to explain the ordinances related to liquor licenses.
She spoke about the proposed Class C-6 liquor license and the needed amendment to
not allow single serve spirits. Also, gave an explanation of if this C-6 is approved it
would open a C-4 that can be transferred to a new applicant that was received. If it is
not approved, then City Council needs to approve a new C-4 liquor license.
Alderman Alcantar-Garcia made a motion to amend item P to include beer and wine
only, seconded by Alderman Beebe.
Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson, Smith,
Carreto-Mufioz, Santiago, Sheahan, Morano, and Myers. Motion carried. Voting
Abstained: Avifia Soto.
Q. Ordinance No. 25-0-0032 — An Ordinance Amending the Code of Ordinances
of the City of West Chicago to Define Certain Terms in its Liquor Code and to
Create a New Liquor License Classification and Regulations Addressing the Sale
of Packaged Alcoholic Beverages at Gas Stations.
Alderman Morano made a motion to approve item Q, seconded by Alderman Smith.
Alderman Morano asked where it states the size of the liquor bottles.
Kelley Chrisse was asked by Mayor Bovey to explain this ordinance.
Kelley Chrisse explained that a business largely invested and renovated a gas station
that received approval to include the sale of hard alcohol as well as beer and wine.
Alderman Morano’s concern is the single serve liquor and how dangerous it can be.
Alderman Santiago asked what the difference is between having the single serve ina
gas station and liquor store.

Mayor Bovey explained that the business volunteered not to serve single serve. He
asked Attorney Krafthefer.
Attorney Krafthefer advised to specify the volume allowed in the single serve.
Alderman Myers has an objection to this ordinance as it only allows one gas station to
have this.
Mayor Bovey explained that to be fair because this had been approved and to now take
it away would be unfair.
Alderman Myers said it’s also unfair to their competitors. He doesn’t understand why
this particular business is not present to plead their case.
Alderman Dimas suggested to make a motion for this item to go back to the Liquor
Commission and have this business present.
Alderman Morano agreed with Alderman Dimas as well as Mayor Bovey.
Alderman Stout made a motion to move item Q to the Liquor Control Commission for
further clarification and discussion, seconded by Alderman Dimas.
Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson, Smith,
Carreto-Mufioz, Santiago, Sheahan, Morano, Avifia Soto and Myers. Motion carried.
R. Ordinance No. 25-O-0033 — An Ordinance Amending the Code of Ordinances
of the City of West Chicago to Increase the Number of Class C-4 Liquor Licenses
(Speedway, LLC DBA Speedway #3994).
Alderman Myers made a motion to approve item R, seconded by Alderman Sheahan.
Alderman Dimas asked if this category can be decreased if/when the Class C-6 is
approved.
Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Smith, Carreto-Mufioz,
Santiago, Sheahan, Morano, and Myers. Motion carried. Voting Nay: Birch-Ferguson.
Voting Abstained: Avifia Soto.
8. Reports by Committee: None
9. Unfinished Business:
A. Selection — Of Special Counsel to represent the City of West Chicago related to
City of West Chicago v. Daniel Bovey and Jody Bovey Litigation.
Mayor Bovey recused himself and asked Alderman Morano to take over this part of the
meeting.
Tia Messino explained that at the last meeting Ross Secler was chosen, but he is no
longer available. The other person was David Freeman, who has confirmed he is
available as well is able to come to the August 4'" meeting for an executive session.
There was discussion on whether the need for each counsel to be interviewed was
necessary.
Alderman Myers made a motion to select David Freeman as counsel to represent the
City, seconded by Alderman Santiago.
Voting Aye by Roll Call: Alcantar-Garcia, Santiago, and Myers. Voting Nay: Beebe,
Sheahan, Carreto Mufioz, Dimas, Birch Ferguson, Smith, Stout, Avifia Soto, Morano.

Attorney Krafthefer suggested the Council ask each firm to submit a proposal letter.
Also, possibly having a committee that includes only a few to interview even via Zoom.
Aldermen Dimas, Beebe, Stout and Alcantar-Garcia will be part of the interviewing
process.
B. Ordinance No. 25-O-0021 — An Ordinance Amending Chapter 16, Article II of
the Code of Ordinances of the City of West Chicago to Increase the Home Rule
Municipal Retailers’ Occupation Tax and the Home Rule Municipal Services
Occupation Tax.!
It was decided this would remain tabled.
C. Ordinance No. 25-0-0024 — An Ordinance of the City of West Chicago
Amending the City Code Related to Legal Services.?
It was decided this would remain tabled.
D. Resolution No. 25-R-0049 — A Resolution Approving a Certain Employment
Agreement with Colin Fleury — Chief of Police.
Alderman Dimas made a motion to approve item D, seconded by Alderman Beebe.
Alderman Morano expressed that it’s a shame they’re moving to a two-year contract for
the Chief. He would like to see four-year terms to set a good precedent for future
candidates, and to reward those who are doing great things for the city.
Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson,
Carreto-Mufioz, Sheahan, Smith, Morano, Santiago, Avifia Soto and Myers. Motion
carried.
E. Resolution No. 25-R-0051 — A Resolution Approving a Certain Employment
Agreement with Tia Messino — Interim City Administrator.
Alderman Alcantar-Garcia made a motion to approve Item E, seconded by Alderman
Myers.
Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson Carreto-
Mufioz, Sheahan, Smith, Morano, Santiago, Avifia Soto and Myers. Motion carried.

10. New Business:
A. Appoint a Temporary Chair for the August 4, 2025 City Council Meeting.
Mayor appointed Alderman Avifia Soto as temporary chair. He asked Attorney
Krafthefer to explain why they went with temporary chair as opposed to Mayor Pro Tem.
Attorney Krafthefer said under the Illinois Municipal Code you can select a Mayor Pro
Tem if you have an incapacitated Mayor unable to perform the duties of office. If you
have a Mayor who is able to perform his duties but only missing a meeting then you
would appoint a temporary chair to run the meeting.
Alderman Morano stated that they would have a deputy mayor when the mayor was out
not a Mayor Pro Tem.
Attorney Krafthefer said it was probably an honorary designation because the code
doesn’t include that.
Alderman Myers made a motion to approve Item A, seconded by Alderman Dimas.

11. Correspondence and Announcements
Alderman Morano mentioned Taco & Art Fest and the Back-to-School event at the
DuPage Airport on August 7" from 10 a.m. — 2 p.m.
Mayor Bovey mentioned that on July 26"" Taco & Art Fest will be held from 3-7 p.m. at
Reed-Kepler Park. He also mentioned National Night Out on August 5th)

Mayor Bovey reminded everyone the discussion regarding the taxes will be held after
the Development Committee meeting.
12. Mayor’s Comments.
Mayor Bovey was thankful that things are getting done. He thanked those that had
public comments. Mayor mentioned his family is hoping to visit our sister city. He
reiterated he, the Chief, and Alderman Smith will have a conversation with Wheaton
Academy and report back. Mayor thanked Ms. Niziolek and informed her that he will be
talking to counsel about her request. He said he was happy we have local paper.
Mayor Bovey expressed his desire to initiate three special temporary commissions: (1)
downtown revitalization; (2) transparency, community involvement and communication;
and (3) the city hall experience. He thanked Despertar Latino for coming. Mayor
shared the progress on the West Washington Street project and his ideas for that
space. He mentioned having the community’s input in the Downtown Revitalization
project.
13. Adjournment
At 8:53 p.m., Alderman Stout made a motion, which was seconded by Alderman Avifia-
Soto to adjourn this meeting.
