Mayor Bovey called the meeting to order at 7:00 p.m. on July 7, 2025. 2. Pledge of Allegiance. Mayor Bovey led all in the Pledge of Allegiance. 3. Roll Call and Establishment of a Quorum. Roll call found Dan Beebe, Julieta Alcantar-Garcia, Rebecca Stout, Sandy Dimas, Melissa Birch Ferguson, Denise Carreto-Mufioz, Alton Hallett, Joseph C. Morano, Jayme Sheahan, Christopher Swiatek, John Smith, Jr. Carlos Avifia Soto, and Matthew Myers were present. Also in attendance Assistant City Administrator Tia Messino, Business & Community Relations Director Kelley Chrisse, Community Development Director Tom Dabareiner, Public Works Director Mehul Patel, Attorney Patrick Bond, and Attorney Jeff Jacobson. 4. Public Participation. A. Louise Handel — Mrs. Handel spoke regarding the grocery and retail tax. B. Kurt Jaros — Mr. Jaros expressed his concern over wasteful spending as well as his disagreement with the agreement offered to Michael Guttman. 5. City Council Meeting Minutes of June 16, 2025. Alderman Swiatek made a motion, seconded by Alderman Alcantar-Garcia to approve the minutes of June 16, 2025. Voting Aye by Voice Vote: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson, Hallett, Carreto-Mufioz, Avifia Soto, Santiago, Sheahan, Swiatek, Stout, Smith, Morano and Myers. Aldermen Smith and Dimas abstained. Motion carried. 6. Corporate Disbursement Report. Alderman Dimas made a motion to approve the amended amount, seconded by Alderman Hallett approving the July 7, 2025, Corporate Disbursement Report in the amount of $2,312,666.24. B. Resolution No. 25-R-0046 — A Resolution Authorizing the Executive Office Manager to Execute BLR 09110 — Resolution for Improvement Under the Illinois Highway Code and the Mayor to Execute BLR 09150 — Request for Expenditure/Authorization of Rebuild Illinois Funds in the Amount of $1,780,000.00 for the 2024 Harvester Road Reconstruction Project. Alderman Beebe requested Item 7.C. be removed from the consent agenda and placed under Unfinished Business. 8. Reports by Committee: 9. Unfinished Business: Ordinance No. 25-0-0023 — An Ordinance Amending Section 7.51(a) of Article VI of Chapter 7 of the Code of Ordinances of the City of West Chicago to Modify the Boundaries of the East Washington Street Historic District in the City of West Chicago, DuPage County, Illinois. Alderman Birch Ferguson made a motion, seconded by Alderman Dimas to approve Ordinance No. 25-0-0023. Alderman Myers made a motion, seconded by Alderman Stout to approve Ordinance No. 25-0-0022. Voting Aye by Voice Vote: Beeb, Alcantar-Garcia, Stout, Dimas, Birch Ferguson Carreto-Mufioz, Santiago, Sheahan, Hallett, Swiatek, Stout, Smith, Morano and Myers. Alderman Avina Soto abstained. Motion carried. B. Resolution No. 25-R-0048 — A Resolution Approving a Certain Employment Agreement with Michael Guttman — Executive Director of Special Projects. Alderman Morano made a motion, seconded by Alderman Dimas to approve Resolution No. 25-R-0048. Mayor Bovey explained the logic behind the presented agreement. A few aldermen had questions regarding the agreement which Mayor Bovey answered. Appoint Ancel Glink as Interim Corporate Counsel for a period not to exceed January 5, 2026 pursuant to the attached engagement letter. Alderman Dimas requested this be tabled. There was discussion between aldermen and Mayor Bovey. Attorney Krafthefer clarified on why there should be an interim corporate counsel to address the pending litigation. Mayor Bovey said either way he would be removing Bond and Conway as corporate counsel. He would also be removing the pending litigation. Alderman Dimas made a motion to table Item 7.F., seconded by Alderman Myers to table the above item. Voting Aye by Roll Call: Stout, Dimas, Birch Ferguson Carreto-Mufioz, Sheahan, Hallett, Swiatek, Stout, Smith, Morano, and Myers. Voting Nay: Beebe, Alcantar-Garcia, Santiago, Carreto-Mufioz, Avifia Soto. Motion carried. Alderman Myers made a motion to approve Ancel Glink for a period not to exceed July 21, 2025. Alderman Birch Ferguson seconded the motion. Mayor Bovey said the appointment needs to come from him. He did think it would move them to a better place. He would amend his appointment to a month. Alderman Myers made a motion to confirm the Mayor's appointment of Ancel Glink as Interim Corporate Counsel for a period not to exceed August 5, 2025 pursuant to the engagement letter. Alderman Birch Ferguson seconded the amended motion. Selection of Special Counsel to represent the City of West Chicago related to City of West Chicago v. Daniel Bovey and Jody Bovey Litigation. Attorney Krafthefer gave a brief overview of each. Alderman Morano asked Attorney Krafthefer who she would recommend and she said Ross Secler. Alderman Stout made a motion to go with the recommendation of Attorney Krafthefer of Ross Secler to serve as Special Counsel to represent the City, seconded by Alderman Morano to approve the above item. Voting Aye by Roll Call: Beebe, Alcantar-Garcia, Stout, Dimas, Birch Ferguson Carreto- Mufioz, Sheahan, Hallett, Swiatek, Stout, Smith, Morano, Santiago, Avifia Soto and Myers. Motion carried. H. Discussion and Possible Action to Approve Settlement Agreement related to Daniel Bovey v. Michael Guttman, et al., 2025 CH 93. Mayor Bovey said he is going to pull this item as he will be removing this lawsuit. I. Ordinance No. 25-O-0021 — An Ordinance Amending Chapter 16, Article II of the Code of Ordinances of the City of West Chicago to Increase the Home Rule Municipal Retailers’ Occupation Tax and the Home Rule Municipal Service Occupation Tax.? Mayor Bovey recommended remain tabled. J. Discussion and Possible Action on the Use of a Third Party Search Agency in Finding a New Administrator. Mayor Bovey is fine with any of the firms; however he doesn't feel the one-man firm of Arndt should be chosen or MGT as that firm is the most expensive one. Many aldermen agreed MGT is a good choice as they have helped the City hire staff in the past. Alderman Stout made a motion to hire MGT to help with the search of a new administrator, seconded by Alderman Swiatek to approve the above item. ' Colin Fleury, Tia Messino, and Mayor Bovey are finalizing the terms which are expected to be presented for City Council consideration at the next City Council meeting. ? Mayor’s Comments. Mayor Bovey thanked those that came out to the meeting. He will be looking to involve the community in the search for a new administrator. He acknowledged the comments from the public. He thanked Attorney Krafthefer, as well as City Council. He mentioned he will be bringing back Item 9.E. 13. Executive Session A. Litigation — 5 ILCS 120/2 (C) (11) There was no need for Executive Session. 14.
