There is hereby created a commission, to be known as the cultural arts commission. (Ord. No. 2620, § 2, 12-21-92) Sec. 2-436. - Membership and appointment. The commission shall consist of ten (10) members, all of whom shall be appointed by the mayor with the advice and consent of the city council. (1) Nine (9) of the said ten (10) members shall have an interest and expertise in the functions of the commission and shall be voting members of the commission. (b) Special meetings of the commission may be called by the chairman or any three (3) members provided that notice is given as provided in the Illinois "Open Meetings Act." (Ord. The cultural arts commission shall: (1) Make recommendations to the city council for the provision of an environment in which the cultural arts will flourish within the corporate limits of the city; (2) Foster educational opportunities and enhance the quality of life for all of the residents of West Chicago by making recommendations to develop arts and cultural programs directed at various age, ethnic, and religious groups; ===== PDF PAGE 7 ===== [Extraction: embedded PDF text] (3) Enhance the economic base in West Chicago by promoting opportunities to combine areas and economic development; (4) Cooperate with the professional city staff to administer all commission programs and activities; (5) Support and foster strong bonds between and among all arts organizations in the community and encourage new arts organizations in a manner which will make the whole considerably stronger than the individual parts, which shall include working cooperatively with other city commissions, and other public and private agencies; (6) Apply for grants to support commission programs and administer and serve as a vehicle for "regrants" under the rules of the Illinois Arts Council and other agencies; (7) Provide a vehicle for publicizing all arts-related events of various organizations as well as community, state or national events related to the arts, and provide a strong public relations program for communicating the commission's goals and their impact on community life; and (8) Act as a resource center and clearing house for information and provide technical assistance to community arts organizations to enable them to improve the effectiveness of grant writing, planning, audience development, identification of sources for funds, and assistance in connection with legal, tax, insurance and liability issues related to arts programs and arts organizations. The cultural arts commission shall submit a written annual report to the city council at the first council meeting in February of each year. The report shall contain an outline of activities and work accomplished during the previous year and shall include recommendations for any proposed improvements or programs which the council should consider for the next year. [Ch. 2, Sec. 81] Cultural Commission. A. Membership. The Cultural Commission shall consist of up to 11 persons to be appointed by the Mayor with the consent of the City Council. Effective May 1, 2014, a person appointed to the Commission shall serve a term of three years. This term may be extended after the three years for no more than two additional three-year terms. Members of the Commission shall serve no more than three consecutive three-year terms (a total of nine years). All terms shall expire on April 30th. Reappointment shall be by the Mayor with the consent of the City Council. The members of the Commission shall elect a Chairman and a Vice-Chairman on an annual basis. [Ord. No. 2018-42] B. Meetings. The Commission shall meet on a regular basis on a schedule to be established by the members, but not less than once per month. A regular place of meeting shall be established by the Commission. All meetings shall be open to the public, unless grounds exist for a closed meeting pursuant to the Illinois Open Meetings Act. [Ord. No. 2018-42] C. Duties and functions. The Commission shall have as its duties and functions: (1) To serve as an advisory body to the City Council, the City Manager and other City officials in creating, developing plans for, and supporting Cultural District(s). (2) To recommend to the City Council, the City Manager and other City officials cultural programs of any description or variety calculated to enhance the viability of Cultural District(s) and the community. (3) To work with appropriate City personnel to establish means to elicit public participation in and support of Cultural District(s), other cultural programs, and helping to fully integrate the arts, in all their diversity, into the fabric of civic life. (4) To request, receive and utilize, staff assistance from the City administration to enable the Commission to carry out its responsibilities. [Ord. There is hereby created a commission to be known as the cultural arts commission (hereinafter referred to as "commission"). (Ord. No. G57-91, § 1, 1991; Code 1976, § 3.75.010) 3.75.020. - Membership and appointment. The commission shall consist of ten (10) members, all of whom shall be appointed by the city council. All members shall be known to have an interest and expertise in the functions of the commission and who shall be voting members of the commission. One (1) member shall be a member of the city council who shall be an ex officio voting member of the commission. One (1) member shall be exempt from residency requirements so long as they are deemed by the mayor and council of the city to have legitimate and vested interests in the success of the Hemmens Cultural Center and the city. Each appointment shall be for a term of three (3) years, provided that no commission member shall serve for more than two (2) full consecutive terms. B. All vacancies occurring in the membership of the commission shall be filled by appointment for the remainder of the unexpired term in the same manner as the original appointment. The commission shall have the power to adopt its own bylaws and schedule of regular meetings and determine the place that such meetings shall be held. These rules shall include procedures for the election by the members of a vice-chairman and secretary from among the membership of the commission, provided that no such officer shall serve for more than two (2) consecutive one (1) year terms. Coordinate, recommend and advocate to the city council the use of gifts or bequests so as to improve and meet the needs of the city's arts community. H. Provide a vehicle for publicizing all arts-related events, as well as community events related to the arts, and establish a strong public relations program for communicating the commission's goals and their impact on community's quality of life. I. Promote the usage of the Hemmens Cultural Center for a variety of performing and fine arts activities. J. Solicit community opinion regarding the Hemmens Cultural Center and to report gathered information to city staff as needed or requested. K. Recommend and advocate to the city council projects to improve the Hemmens Cultural Center. L. Solicit community opinion regarding the arts in the city and to report gathered information to city staff as needed or requested. M. To prepare and submit reports to the city council concerning its activities when warranted or requested. N. To perform such other duties as the city council may designate. ===== PDF PAGE 11 ===== [Extraction: embedded PDF text] ARTICLE XI. - ARTS AND HUMANITIES Village of Niles DIVISION 1. - PUBLIC ARTS AND CULTURE PROGRAM Sec. 2-600. - Creation; purpose. A Public Arts and Culture Advisory Council is hereby established to assist, inform and advise the Village Board of Trustees on matters pertaining to the arts, culture, and special events in the Village of Niles. This Council is established to assist the Village in furthering the arts, culture, and special events and the annual allocation of budgeted funds, to include those funds generated by the public arts and culture program appearance and arts fee in section 2-603. The appearance and arts fee is a revenue that is reserved for the sole use of funding of artistic entities, cultural amenities and special events in the Village of Niles that express the character of the community and provide cultural experiences that are open to all residents and visitors. (Ord. No. 2014-70, § 1, 12-9-14) Sec. 2-601. - Public Arts and Culture Advisory Council membership; compensation; term. (a) The members of the Council shall be appointed by the President with the advice and consent of the Village Board. The President shall appoint one of the individuals as the chairperson who shall establish a schedule of meetings that will be open to the public. (b) The Council shall consist of 13 members. (1) At least five of said members shall have a professional expertise in various facets of the duties of the Council by virtue of their training, employment and/or experience. Said areas of expertise may include, but are not necessarily limited to, business, nonprofit management, arts, social or artistic events, Village heritage, diversity and culture. (2) The President shall seek to appoint at least five members to the Council as representatives of various community organizations including but not limited to Niles-Maine Library District, Niles Park District, Niles Historical Society, Niles Chamber of Commerce and Industry, Niles Sister Cities, Veterans of Foreign Wars, School District 63 and School District 71. (c) Members of the Council shall serve without compensation. (d) Members of the Council shall be appointed for a one-year period. (Ord. No. 2014-70, § 1, 12-9-14; Ord. No. 2015-42, § 1, 6-23-15; Ord. Sec. 2-603. - Appearance and arts fee. An appearance and arts fee as described in appendix D fee schedule of the Village Code is hereby established. This is calculated for each nonresidential building permit and based upon the construction valuation, provided the valuation of construction meets or exceeds $10,000.00. There is no fee for construction valuation of $9,999.99 and below. Said fees shall be collected by the Community Development Department at the time of permit issuance, and the fees to be placed in a segregated account for the exclusive purpose of providing funding for the Public Arts Program outlined in section 2-600. (Ord. No. 2014-70, § 1, 12-9-14) Sec. 2-604. - Powers and duties. (a) Provide recommendation to the Village Board of Trustees regarding the disbursement of budgeted, donated and/or granted funds. (b) Promote the identification and development of available resources related to arts, culture, and special events in the Village of Niles. (c) Encourage arts, culture, and special events in the Village of Niles. (d) Identify, select or commission public art for installation in public spaces. (e) Designate the appropriate placement of purchased, commissioned, or donated public art work in public areas where residents and visitors live and congregate, and that are highly accessible and visible. (f) Educate the public about and promote public art, culture, and special events in the Village of Niles. (g) Investigate, develop and recruit funding opportunities for public art and cultural/special events. (h) Work toward the development and implementation of an arts and culture master plan. (Ord. The cultural arts commission is created as an advisory commission to the village board of trustees and village staff as requested by the village president to: (A) Establish, initiate, sponsor, organize, and promote cultural and artistic programs and services for the enrichment and enjoyment of the Oswego community. (B) Build awareness of and participation in all the arts—visual, performing, and literary. (C) Continually add to the established public art collection. (D) Provide a diverse representation of superior quality artistic and cultural programs and events to serve all segments of the Oswego community, thus enhancing the quality of life in Oswego. (Ord. 18-70, 8-21-2018, eff. 9-1-2018) Sec. 2-8-2. - Membership. The cultural arts commission shall consist of a total of nine voting members, no fewer than six of whom reside within the corporate limits of the Village of Oswego, and up to three of whom while not residing in the village, either own a business in the village or are employed within the village; and one ex officio, non- voting member. Additionally, a staff member shall be appointed by the village president to serve as the liaison to the commission. This person shall serve as an ex officio member of the commission and shall not vote, but will provide logistical staff support as needed. Members shall be appointed by the village president with advice and consent of the village board of trustees. The members shall be appointed on the basis of expertise, experience, and interest in visual, performing, and literary arts. The village president, with advice and consent of the village board of trustees, may remove individual cultural arts commission members. (Ord. 18-70, 8-21-2018, eff. 9-1-2018; Ord. No. 24-21, § 1, 2-20-2024) Sec. 2-8-3. - Term of office. The initial term of all original members of the commission shall commence upon their appointments. Vacancies shall be filled for the unexpired term only. Following the adoption of this chapter and the appointment of the initial cultural arts commission members, terms shall be considered to begin on May 1 of the calendar year and end on April 30. The village president, with advice and consent of the village board of trustees, shall annually appoint a chairperson and an acting chairperson. The acting chairperson shall serve in the absence of the chairperson. (Ord. 18-70, 8-21-2018, eff. 9-1-2018; Ord. No. 24-21, § 1, 2-20-2024) Sec. 2-8-5. - Meeting. A quorum shall consist of four voting members. All decisions or actions of the cultural arts commission shall be made by a majority vote of those members present and voting at any meeting where a quorum exists. Meetings shall be held either monthly or bimonthly. These meeting dates will be approved by the Village of Oswego Board of Trustees at the beginning of each calendar year. No members of the cultural arts commission shall vote on any matter that may materially or apparently affect the property, income or business interest of that member, or if otherwise prohibited by law. The chairperson, and in his/her absence the acting chairperson, may administer oaths. All meetings of the cultural arts commission shall be open to the public unless properly closed under the Illinois Open Meetings Act. The cultural arts commission shall keep minutes of its proceedings, showing the vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall be immediately filed in the office of the village clerk and shall be a public record. The cultural arts commission shall have the following powers, duties and responsibilities as directed by the village president and board of trustees to: (A) Propose and develop cultural/arts policies; (B) Act as the reviewing body for certain public art projects; (C) Be responsible for the care and maintenance of the village's public art collection; (D) Serve as a cultural/arts information and resource center. ===== PDF PAGE 15 ===== [Extraction: embedded PDF text] DIVISION 8. - FINE AND CULTURAL ARTS COMMISSION City of Wheaton Sec. 2-308. - Composition. The fine and cultural arts commission shall consist of no less than seven but no more than 11 members. (Ord. No. O-2022-34, § 1, 8-15-2022) Sec. 2-309. - Purpose. The purpose of the fine and cultural arts commission shall be to: (1) Increase citizen access to the arts by providing leadership, advocacy, and the support for art that enriches the cultural vitality of our community; and (2) Provide advice and work cooperatively with the city council to promote fine and cultural arts in the city; and (3) Foster and promote an appreciation of fine arts within the city by enlisting and encouraging public and private agencies, as well as the general public, to support art and cultural events within the city; and (4) At the request of the city council, review and make recommendations directly to the city council for art works for public buildings and public spaces; and (5) Assist in creating and maintaining a city-wide arts and culture webpage on the city website that includes links to art related organizations and individuals who advance art in the city. The fine and cultural arts commission shall meet no less than six scheduled times per year at a date and time to be determined by the commission.
