MINUTES
DEVELOPMENT COMMITTEE
July 14, 2025, 6:00 P.M.
1. Call to Order, Roll Call, and Establishment of a Quorum.
Alderman Rebecca Stout called the meeting to order at 6:00 p.m.
Roll call found Aldermen Julieta Alcantar-Garcia, Melissa Birch Ferguson, Matthew
Myers, Rebecca Stout and Christopher Swiatek present. Alderman Stout announced a
quorum. Alderman Denise Carreto-Mufioz arrived after roll call.
Also in attendance were the Community Development Director, Tom Dabareiner and
Mayor, Daniel Bovey.
2. Approval of Minutes.

Alderman Swiatek moved, and Alderman Birch Ferguson seconded the motion
to approve the minutes. Voting Aye: Aldermen Alcantar-Garcia, Birch
Ferguson, Myers, Stout and Swiatek.
3. Public Participation. None.
4. Items for Consent.

Zoning Text Amendment (Keeping of Chickens on Certain Single-Family
Residential Properties) — Stemming from a request from Public Affairs Committee
members, text was drafted that would allow the keeping of chickens in Single-Family
residences. Properties would need to exceed 6,500 square feet in size. Coops would
be limited to one per backyard and hold no more than six hens and no roosters. The
proposed Zoning Text Amendment lists a number of additional restrictions, which
followed discussion with several coop operators and addressed Plan Commission
questions. Approval was unanimous (4-0) from the Plan Commission on July 1, 2025.
Alderman Myers requested Item A. be removed from the consent agenda for further
discussion.
Zoning Text Amendment (Creation of a Temporary Use to Permit Outside
Seasonal Events) — Five Points Production, operator of the Haunted House at 241 W.

Roosevelt requested a text amendment to allow temporary outside activities to occur
in conjunction with their Haunted House activities. For a period not to exceed 60 days
for one event per year, food trucks and merchandise sales would be included.
Approval was unanimous (4-0) from the Plan Commission on July 1, 2025.
An inquiry about the timeframe was made. The members were informed the event
would run from about September 1* through October 315, but not to exceed 60 days.
Alderman Birch Ferguson moved, and Alderman Alcantar-Garcia seconded the
motion to approve Item B. Voting Aye: Aldermen Alcantar-Garcia, Birch
Ferguson, Carreto-Mufioz, Myers, Stout and Swiatek.
5. Items for Discussion.
Tom Dabareiner provided a staff update on Item 4.A. Discussion ensued, and
questions were asked regarding the chicken run location, penalties for violators,
disposal of carcasses, spread of Avian flu, coop size restrictions, predators,
registration requirements, minimum lot size and setback requirements and egg sales.
The members agreed upon wanting staff to research their concerns and make any
necessary changes to the proposed ordinance prior to City Council approval.
Alderman Swiatek moved to approve Item 4.A. with caveats, and Alderman
Swiatek seconded the motion. Voting Aye: Aldermen Alcantar-Garcia, Birch
Ferguson, Carreto-Muiioz, Myers, Stout and Swiatek.

8. Reports from Staff.
Mr. Dabareiner informed the members about three potential items for next month’s
meeting agenda.
9, Adjournment.
Alderman Birch Ferguson moved to adjourn the meeting at 6:37 p.m., and
Alderman Alcantar-Garcia seconded the motion. With a voice vote of all ayes,
the motion carried.
