The construction easement is needed to grant the owner access to the City property to perform modifications to the basin. The proposed work includes re-grading the top of the berm and the overflow weir to raise the overflow elevation 0.3 feet which will add 2.126 acre-feet of storage to the basin. By raising the overflow elevation of this detention basin, the total detention volume of the basin increases. This is necessary to allow for the future development of undeveloped parcels in the subdivision, such as Mr. Muccianti’s. Without a modification to the existing detention basin, development of the vacant parcels becomes difficult. Staff has reviewed the submitted plans for this work and has approved a site development permit for this construction. A temporary access/construction easement has been prepared by staff that will allow access for the work to be performed. Once the work has been completed the temporary easement will cease. ACTION PROPOSED: Discuss and recommend approval of the proposed Temporary Access/Construction Easement. Throughout the course of the project, Grantee may access the temporary easement at any time, without notice to Grantor, to perform the authorized work identified on the approved plans, attached as Exhibit “A”, including any of the aforesaid improvements located thereon. 2. The temporary easement is granted specifically for the purpose of allowing the Grantee ingress and egress onto, over, under and above the property to perform stormwater modifications to the existing stormwater detention basin, as shown on Exhibit “A”. Further, Grantee may perform inspections on the improvements located therein. The rights and obligations of the Grantee shall extend to its employees, officers, agents, contractors, and sub-contractors. This easement agreement shall be non-transferrable without written consent of the grantor. 3. The Grantee agrees that it will perform any work hereby authorized on the temporary easement, or on the improvements located therein with reasonable care, skill and diligence. The Grantee will perform said work in such a way as to avoid harm to improvements adjacent to said easement. The Grantor agrees it will not interfere with or remove the support of the same. In the event any adjacent area, (during construction of permanent utility improvements by the Grantee, or its assigns), should become negatively disturbed, the Grantee shall restore the adjacent area as nearly as possible to the condition in which it was before the Grantee's entrance thereon. 4. The Grantee may store equipment and materials in the temporary easement while performing any construction authorized on the approve plans in said easement. Grantee will promptly remove all such items upon completion of the authorized work. 5.
