Resolution No. 25-R-0057- Contract Award - Stewart Spreading, Inc. - 2025 Water Treatment Plant Waste Lime Sludge Removal Project for a Base Bid in an Amount Not to Exceed $387,240.00 and Reject Alternate No. 1. Mr. Patel explained that hydrated lime is used to treat and soften the raw water as part of the City's water treatment process. As a result, sludge is generated and transferred to three exterior holding lagoons until contractually removed. Historically this removal was done every three years, creating a spike in the budget during a lime sludge removal year. Staff have been exploring the idea of land application of the lime sludge and would intend to remove sludge from one of the three lagoons annually for consistent budgeting purposes. The City has a permit from the EPA for land application, and staff recommends proceeding with the cost-saving land application rather than landfill disposal. Staff also believes the actual quantity to be removed will be less than estimated and the final cost could come under the $300,000.00 budgeted amount. Alderman Morano expressed his support of this plan to reduce costs, reduce landfill contributions, support farmers and their land, and be able to remove the sludge on a more frequent annual basis. Alderman Morano made a motion, seconded by Alderman Smith, to approve. Roll call found the vote unanimous for approval. Voting Yea: Aldermen Beebe, Dimas, Hallett, Morano, and Smith. Voting Nay: 0. 4.1. Resolution No. 25-R-0060 - Change Order No. 1 - Bluff City Construction, LLC. for the West Washington Street Soil Removal Project in an Amount Not to Exceed $67,967.05 for a Revised Contract value of $647,898.50. Alderman Morano pulled this Item for some updates and additional information as to how things are progressing with this project and why. Mr. Patel distributed a conceptual plan that was used as part of the excavation limits in the bid documents for this project. Essentially, the project has four excavation areas - northeast (3-feet depth); northwest (10-feet depth); southwest (3-feet depth); and southeast (3- feet depth). Once the excavation estimated limits are reached, soil samplings are taken at the perimeter of the excavation walls and sent to the lab for testing. If the sample test reveals presence of exceeding levels of contamination, further excavation limits are determined. If the sample test returns clear, excavation ceases and backfill work can proceed. The Project team is still working through the northwest and southwest and have yet to begin the southeast and northeast portions. Additionally, the stockpile of material generated from the City's utility and maintenance operations over the years did not meet Clean Construction Demolition Debris (CCDD) disposal standards and must instead be disposed of at a landfill. There is also a greater quantity of material to be disposed of than originally estimated. This change order reduces the excavation volume due to an evolving conceptual plan for the site and utilizes grant funding before the deadline. Alderman Morano concurred that proceeding this way is a good plan as future plans for the site remain uncertain; there is no need to excavate more than necessary before site plans are determined. Mr. Patel noted that the October Infrastructure Committee meeting will be cancelled as he and the Assistant Director will be unavailable to attend. He also shared that Union Pacific will be working on the railroad tracks on Nuclear Drive and Harvester Road later this month. The Bishop and Brown Project is progressing with underground work completed and some asphalt work to be done before school begins. The City has received many complaints regarding IDOT's work along Route 38, and IDOT is anticipated to resurface Garys Mill Road between Route 38 and Route 59. Alderman Morano expressed his gratitude to Mr. Patel and staff for finding cost-effective, new, and recyclable ways to conduct work for the City and its residents. 9. Adjournment. The Project will include full media replacement, sandblasting and painting of filter interior, painting of filter exterior, piping and hose replacement, removal and replacement of sight tube and associated piping work, replacement of turbidity meter and associated piping, pressure gauge replacement, tank light replacement as well as any underdrain and metal rehab deemed necessary during construction. The Water Treatment Plant was commissioned in 2006. Equipment in this environment has an average working life of 20 years. As equipment ages, its efficiency declines, maintenance costs increase, and the risk of unexpected failure rises. Unplanned breakdowns can disrupt production, damage surrounding systems, and create safety hazards for workers. To prevent these issues, it is essential to establish scheduled replacement plans based on the manufacturer's recommended service life, performance trends, and historical maintenance data. Proactively replacing equipment prior to failure not only reduces downtime and emergency repair costs but also ensures operational continuity, regulatory compliance, and workplace safety. This proactive approach allows organizations to better allocate resources and extend the overall efficiency of their systems. The Project was advertised for public bids in the Daily Herald and on an online bidding platform, QuestCDN, on August 5, 2025. A mandatory pre-bid meeting took place on August 14, 2025. STAFF REVIEW: Mehul T. Patel, P.E., CFM- Director of Public Works SIGNATURE ITEM SUMMARY: The Water Treatment Plant Rooftop Unit Replacement Project, located at 1400 W. Hawthorne Lane, as denoted in the enclosed location map, includes the removal of the two existing 25-Ton rooftop units (RTU), which are original to the building, installation of the two proposed 30-Ton RTU, and making necessary connections and adjustments to ensure proper operation of the RTUs. Furthermore, the work may involve, if required, incidental electrical and mechanical components such as modifications or installation of the curb adapter, electrical connections, mechanical connections, gas piping, controls integration, minor ductwork, testing and commissioning of the proposed RTUs, and other miscellaneous items as required to complete the project. The project is anticipated to be completed by June 30, 2026, permitting product lead times and weather. The Project is a like for like replacement as specifications are identical to the current RTUs and design work was not required, except a structural roof evaluation to ensure the roof can handle the additional weight of the RTUs. As such, a Request for Proposal (RFP) for the Project was advertised in the Daily Herald and on an online bidding platform, QuestCDN, on August 12, 2025. A mandatory pre-proposal site walkthrough was also scheduled on August 20, 2025. The deadline to submit the proposal was August 26, 2025. The FY 2025 Budget under the Water Treatment Plant Operations Funds - Other Capital Outlay Account No. 06-34- 48-4806 includes a total of $287,500 for engineering services and the construction phase for the Project. Out of the allocated $37,500, only $5,800 was expended for the design services, which leaves a total of $281,700.00 for the construction phase. The shortfall of $36,300 will be funded from the anticipated fund balance in the same account. Since the Project will be completed in FY 2026, staff will budget the Project accordingly in the FY 2026 budget. ARTICLE 6: CONTRACT TIME This contract work shall be completed by June 30, 2026, for all work. Work shall commence upon Notice to Proceed. The CONTRACTOR fully understands and agrees that the completion time is an essential part of this contract and for each day, calendar day, that elapses between the CONTRACT COMPLETION DATE and the date on which the work is completed, including the removal of all equipment and obstructions, the CONTRACTOR will pay to the OWNER, as liquidated damages, the sum as set forth in the General Requirements of the contract documents. ARTICLE 7: INSURANCE Successful bidders shall procure and maintain for the term of the agreement or contract insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work hereunder by the CONTRACTOR, his agents, representatives, employees or sub-contractors. The cost of such insurance shall be included in CONTRACTOR'S bid. A. Minimum Scope of Insurance Coverage shall be at least as broad as: 1. Insurance Services Office Commercial General Liability Occurrence form number CG000l (Ed. 11/85) with the City named as additional insured; and 2. Insurance Services Office Business Auto Liability Coverage form number CA 0001 (Ed. 10/90) or newer as amended covering Automobile Liability, code 1 "any auto"; and 3. Worker's Compensation as required by the Labor Code of the State of Illinois and Employer's Liability Insurance. B. Minimum Limits oflnsurance CONTRACTOR shall maintain limits NO LESS than: 1. Commercial General Liability: $1,000,000 combined single limit per occurrence for bodily injury, personal injury and property damage. The general aggregate shall be twice the required occurrence limit. Minimum General Aggregate shall be no less that $2,000,000 or a project specific aggregate of $1,000,000. 2. Workers' Compensation and Employers' Liability: Workers' Compensation limits as required by the Labor Code of the State of Illinois and Employers' Liability limits of$500,000 per accident. 4. Builder's Risk: Shall insure against "All Risk" of physical damage, including water damage (flood and hydrostatic pressure not excluded), on a completed value basis where applicable. C. Deductible and Self-Insured Retentions Any deductibles or self-insured retentions must be declared to and approved by the City. At the option of the City, either: the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects the City, its officials, agents, volunteers and employees; or the CONTRACTOR shall procure a bond guaranteeing payment of losses and related investigation, claim administration and defense expenses. D. Policy Provisions The policies are to contain, or be endorsed to contain the following provisions: 1. General Liability and Automobile Liability Coverages a. The City, its officials, employees and volunteers are to be covered as insureds as respects: liability arising out of activities performed by or on behalf of the CONTRACTOR; products and completed operations of the CONTRACTOR; premises owned, leased or used by the CONTRACTOR; or automobiles owned, leased, hired or borrowed by the CONTRACTOR. The coverage shall contain no special limitations on the scope of protection afforded to the City, its officials, employees or volunteers. b. The CONTRACTOR'S insurance coverage shall be primary insurance as respects the City, its officials, agents, employees or volunteers. Any insurance or self-insurance maintained by the City, its officials, agents, employees or volunteers shall be excess of CONTRACTOR'S insurance and shall not contribute with it. c. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the City, its officials, agents, employees or volunteers. d. Workers' Compensation and Employers' Liability Coverages The insurer shall agree to waive all rights of subrogation against the City, its officials, agents, employees and volunteers for losses arising from work performed by CONTRACTOR for the City. 2. All Coverages Each insurance policy required by the clause shall be endorsed to state that coverage shall not be suspended, voided, canceled, reduced in coverage or in limits except after thirty (30) days' prior written notice by certified mail, return receipt requested, has been given to the City. E. Acceptability of Insurers Insurance is to be placed with insurers with a Best's rating of no less that A: VII and licensed to do business in the State of Illinois. F. Verification of Coverage CONTRACTOR shall furnish the City with certificates naming the City, its officials, agents, employees and volunteers as an additional insured and with original endorsements affecting coverage required by this clause. The certificates and endorsements for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The certificates and endorsements are to be received and approved by the City before work commences. The City reserves the right to request full certified copies of the insurance policies. G. Sub -Contractors CONTRACTORS shall include all sub-contractors as insured under its policies or shall furnish separate certificates and endorsements for each sub-contractor. All coverages for sub-contractors shall be subject to all of the requirements stated herein. ARTICLE 9: INDEMNITY HOLD HARMLESS PROVISION To the fullest extent permitted by law, the CONTRACTOR hereby agrees to defend, indemnify and hold harmless the city, its officials, agents and employees, against all injuries, deaths, loss, damages, claims, patent claims, suits, liabilities, judgments, cost and expenses, which may in anywise accrue against the city, its officials, agents and employees, arising in whole or in part or in consequence of the performance of this work by the CONTRACTOR, its employees, or sub-contractors, or which may in anywise result therefore, except that arising out of the sole legal cause of the city, its agents or employees, the CONTRACTOR shall, at its own expense, appear, defend and pay all charges of attorneys and all costs and other expenses arising therefore or incurred in connection therewith, and, if any judgment shall be rendered against the city, its officials, agents and employees, in any such action, the CONTRACTOR shall, at its own expense, satisfy and discharge the same. CONTRACTOR expressly understands and agrees that any performance bond or insurance policies required by this contract, or otherwise provided by the CONTRACTOR shall in no way limit the responsibility to indemnify, keep and save harmless and defend the municipality, its officials, agents and employees as herein provided. ARTICLE 10: CONTRACTOR'S REPRESENTATIONS In order to induce OWNER to enter into this Agreement, CONTRACTOR makes the following representations: 10.1 CONTRACTOR has examined and carefully studied the Contract Documents and other related data identified in the Bid Invitation Package including "technical data." 10.2 CONTRACTOR has visited the site and become familiar with and is satisfied as to the general, local and site conditions that may affect cost, progress, performance or furnishing of the PROJECT. 10.3 CONTRACTOR is familiar with and is satisfied as to all federal, state and local law and regulations that may affect cost, progress, performance or furnishing of the PROJECT. 10.4 CONTRACTOR is aware of the general nature of work to be performed by OWNER and others at the site that relates to the PROJECT as indicated in the Contract Documents. 10.5 CONTRACTOR has correlated the information known to CONTRACTOR, information and observations obtained from visits to the site, reports and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests, studies and data with the Contract Documents. 10.6 CONTRACTOR has given the OWNER written notice of all conflicts, errors, ambiguities or discrepancies that CONTRACTOR has discovered in the Contract Documents and written resolution thereof by OWNER is acceptable to CONTRACTOR, ===== PDF PAGE 15 ===== [Extraction: embedded PDF text] CONTRACT AGREEMENT Page 6 of7 that the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the PROJECT. 10. 7 CONTRACTOR warrants and represents that it is not in arrears to the OWNER upon debt or contract, and that it is not a defaulter as surety, contractor, or otherwise, to any person, firm or entity. 10.8 CONTRACTOR warrants and represents that CONTRACTOR is financially solvent, that CONTRACTOR has the financial resources necessary to perform and complete the PROJECT in accordance with the Contract Documents, that CONTRACTOR is sufficiently experienced and competent to complete the PROJECT and that the facts stated in its Bid and the information given by CONTRACTOR are true and correct in all respects. 10.9 CONTRACTOR warrants and represents that CONTRACTOR shall hereafter have no claim for payment or additional compensation based upon conditions at the work site or sites, or omissions, ambiguities or conflicts in the Contract Document and CONTRACTOR shall only be entitled to an extension of time as provided in the Contract Documents. 10.10 CONTRACTOR warrants and represents that the statements contained in the CONTRACTOR'S Certification attached hereto and by this reference incorporated herein and made a part hereof are true and correct. ARTICLE 11: MISCELLANEOUS 11.1 Neither the OWNER nor the CONTRACTOR shall, without prior written consent of the other Party assign or subcontract, in whole or in part, his interest under any of the Contract Documents and specifically, the CONTRACTOR shall not assign any money due or to become due without consent of the OWNER. 11.2 The OWNER and the CONTRACTOR each binds himself, his partners, successors, assigns and legal representatives to the other Party hereto in respect to all covenants, agreements and obligations contained in the Contract Documents. 11.3 The CONTRACTOR shall furnish any affidavit or certificate, in connection with the work covered by this agreement as provided by law.
