Proclamation A DuPage Foundation Initiative WHEREAS, Arts DuPage has regularly issued official proclamations to all the cities and villages in DuPage County on an annual basis, designating October as Arts DuPage Month; and WHEREAS, the arts embody much of the accumulated wisdom, intellect, and imagination of humankind; and WHEREAS, the arts enrich us as individuals and play a unique role in the lives of our families and our communities; and WHEREAS, the arts promote a better understanding of the diversified cultures within our communities and unify us regardless of age, race, and ethnicity; and WHEREAS, the arts sector in DuPage County consists of 2,272 arts-related businesses and accounts for 4.2 percent of the total number of businesses in the region — a larger share of the economy than transportation, tourism, agriculture, and construction; and WHEREAS, the arts provide full-time employment for over 15,000 workers in DuPage County; and WHEREAS, the arts improve our economy, enrich our civic life, drive tourism and commerce, and exert a profound positive influence on the education of our children; and WHEREAS, the arts helped lead us through the darkest times by lifting our spirits, unifying communities, and providing entertainment. Call to Order. Mayor Bovey called the meeting to order at 7:00 p.m. on October 6, 2025. 2. Pledge of Allegiance. Mayor Bovey led all in the Pledge of Allegiance. 3. Roll Call and Establishment of a Quorum. Roll call found Dan Beebe, Rebecca Stout, Sandy Dimas, Denise Carreto-Muñoz, Joseph C. Morano, Alton Hallett, Christopher Swiatek, John Smith, Jr., and Sergio Santiago were present. Aldermen Julieta Alcántar-García, Melissa Birch Ferguson, Jayme Sheahan, Carlos Aviña Soto and Matthew Myers were absent. Also in attendance Assistant City Administrator Tia Messino, Finance Director Nikki Giles, Business & Community Relations Director Kelley Chrisse, Interim Community Development Director John Sterrett, Public Works Director Mehul Patel, Chief of Police Colin Fleury, and Attorney Kevin Sterk. Alderman Aviña Soto arrived at 7:06 p.m. Alderman Alcántar-Garcia arrived at 7:23 p.m. Mayor Bovey mentioned that he spoke to four out of nine households that are facing annexation. He was told they do not want to be annexed. Mayor Bovey said they removed the boundary agreement from the agenda as the map is incorrect. 4. Public Participation. A. Richard Vigsnes – Mr. Vigsnes read a letter. He was present on behalf of Sister Cities to request contribution to support their 2026 hosting of Taufkirchen, Vils visitors. B. Phil Balgeman – Mr. Balgeman spoke about a possible tattoo shop opening in West Chicago. C. Denise Cubel – Ms. Cubel spoke in favor of Rustic Roots a tattoo shop who wants to open their business in West Chicago. D. Victor Perez – Mr. Perez spoke in favor of Rustic Roots as well. E. Matt Waldow – Mr. Waldow is the owner of Rustic Roots and is looking to open his tattoo studio in downtown West Chicago, where the zoning currently doesn’t allow this type of business. Sandberg  Bill Baez  Gregg Anderson Mayor Bovey explained that there has been a transition and when staff found out this was to expire, they moved quickly. He informed everyone council are the ones to make this decision so everyone present is speaking to the correct group. The following spoke regarding the ICE incidents that took place on October 4, 2025.  Angel Cruz – Mr. Cruz is from Casa DuPage. He spoke about the peaceful march that took place.  Griselda – Ms. Griselda is from Casa DuPage. She gave statistics about how immigrants help the United States, and how the United States do not help them. She provided a petition to Mayor Bovey.  Christianne Lewis – Ms. Lewis spoke about the city adopting an ICE free zone.  Ruby Casarez – Ms. Casarez expressed her gratitude to Mayor Bovey for being present for the community. She was one of the witnesses that saw what happened at the gas station, two documented individuals being taken by ICE.  Rebecca Hackman – Ms. Hackman spoke about how this affects the entire community not just those that are targeted. She suggested police and staff be trained on how to help those with trauma. Also, to designate safe zones for those affected. Mayor Bovey reiterated that the city police are not involved in the ICE raids. He said the chief of police has been very responsive when he asks for any video footage. The following spoke regarding the boundary agreement.  Michelle Bowen – Ms. Bowen wanted clarification on this regarding the church being the only one being considered or the homes as well. They want the city to protect them. Ms. Messino clarified that this would only include the church as they requested this change. Alderman Dimas made a motion to move Ordinance 25-O-0045 to the front of the agenda, seconded by Alderman Santiago. Voting Aye by Voice Vote: Beebe, Stout, Alcántar-García, Dimas, Smith, Carreto- Muñoz, Hallett, Swiatek, Santiago, Morano, and Aviña Soto. Alderman Morano gave a brief background on this annexation. Alderman Dimas relayed her concern of Winfield trying to get them annexed. Aldermen Hallett and Alcántar-García expressed their disagreement on the residents being annexed. Alderman Aviña Soto asked if the city would be affected if they failed to complete it. Attorney Sterk said it wouldn’t be used against the city in court. Alderman Swiatek asked if in 10-15 years the city needs to annex would they go through the same procedure. Mayor Bovey said nothing would prevent the city from doing this. Attorney Sterk said the mayor is correct, the city wouldn’t amend the original agreement but would need to start all over. Alderman Santiago reiterated that if the city doesn’t approve this, Winfield can come forward and annex them. Ms. Messino said Winfield has told her their intention is not to annex them any time soon. Discussion can be had regarding a boundary agreement. Both Mayor Bovey and Attorney Sterk said they cannot guarantee Winfield can’t in a year give them notice they will annex them. Alderman Hallett said he’s sure the crowd can change Winfield’s mind if that were to happen. Alderman Stout made a motion to approve Ordinance 25-O-0045, seconded by Alderman Hallett. Voting Aye: None. Voting Nay: Beebe, Alcántar-García, Santiago, Hallett, Dimas, Smith, Swiatek, Stout, Aviña Soto, Morano. Motion failed. A. Alderman Beebe asked for the September 15, 2025 minutes to be corrected in 13.A. to include: Attorney Krafthefer will look into having an appointment for now and who would be the whistleblower auditing official. Alderman Morano made a motion to approve the September 2, 2025 and September 15, 2025 minutes with the amendment from Alderman Beebe, seconded by Alderman Smith. Voting Aye by Voice Vote: Beebe, Alcántar-García, Stout, Dimas, Smith, Carreto- Muñoz, Santiago, Swiatek, Hallett, Morano, and Aviña Soto. Motion carried. 6. Discussion and Possible Action to Approve the Corporate Disbursement Report. Alderman Dimas made a motion, seconded by Alderman Swiatek approving the October 6, 2025, Corporate Disbursement Report in the amount of $2,208,313.25. Voting Aye by Roll Call: Beebe, Alcántar-García, Stout, Dimas, Smith, Carreto-Muñoz, Swiatek, Hallett, Aviña Soto, and Morano. Voting Nay: Santiago. Motion carried. 7. The Reading of the Proposed Consent Agenda: *Development Committee: A. Ordinance No. 25-O-0032 – An Ordinance Amending the Code of Ordinances of the City of West Chicago to Define Certain Terms in its Liquor Code and to Create a New Liquor License Classification and Regulations Addressing the Sale of Packaged Alcoholic Beverages at Gas Stations. B. Ordinance No. 25-O-0044 – An Ordinance Amending Section 3-13 of the Code of Ordinances of the City of West Chicago to Address Changes of Ownership and/or Organizational Management of An Existing Liquor License. C. Alderman Stout made a motion to establish the Consent Agenda to include Items 7.C. through 7.E., seconded by Alderman Swiatek. Motion to Approve Items on the Established Consent Agenda: Alderman Swiatek made a motion to approve the amended Consent Agenda to include Items 7.C. through 7.E., seconded by Alderman Santiago. Voting Aye by Roll Call: Beebe, Alcántar-García, Stout, Dimas, Smith, Carreto-Muñoz, Santiago, Swiatek, Hallett, Morano, and Aviña Soto. Motion carried. Mayor Bovey mentioned that at first, he was against demolition of city owned property, but the houses are not salvageable. He said soon they will share the purpose for those lots. 10. Consideration of Items Removed from the Consent Agenda: There was discussion of Items 7.A. and 7.B. Alderman Dimas gave a brief summary of the Liquor Control Commission meeting that discussed both this item and 7.B. There has been a long-standing gas station who previously sold spirits along with beer and wine. When council changed the code to allow more gas stations, they made it clear that they would only be allowed to sell beer and wine. This long-standing business is requesting they be allowed to continue selling spirits. The Liquor Control Commission felt it would be best for the entire council to decide. A representative from the long-standing gas station (Shell) clarified they would not be selling the shooter bottle size. Alderman Beebe said he received public comment about this item, and it was against it, therefore that is how he will be voting. Alderman Santiago made a motion to approve Item 7.A. and 7.B., seconded by Alderman Aviña Soto. Voting Aye by Roll Call: Dimas, Santiago, Swiatek, and Stout. Mayor Bovey would like to appoint members to the Downtown Revitalization Commission. The commission consists of 9 members and Mayor Bovey is one of them, as well as Aldermen Beebe and Myers, Sarah Phalen and Dave Sabathne. Mayor would like to appoint: Denise Kolode, Greg Salzman, and Daniela Ballines. Alderman Alcántar-García made a motion to approve Denise Kolode to the Downtown Revitalization Commission, seconded by Alderman Smith. Voting Aye by Voice Vote: Beebe, Alcántar-García, Dimas, Smith, Carreto-Muñoz, Hallett, Swiatek, Santiago, and Morano. Alderman Aviña Soto abstained. Motion carried. Alderman Alcántar-García made a motion to approve Greg Salzman to the Downtown Revitalization Commission, seconded by Alderman Smith. Mayor Bovey said he wants to talk to Omar Espinosa to see if he wants to be part. His boss also expressed an interest so Mayor will wait to see what they decide. Ms. Chrisse gave a brief explanation about a business who opened in 2024 wanting to operate a video gaming café. He was told only certain businesses were allowed to have a video gaming license. The business needed to be a restaurant, have a full kitchen, be open and operating for at least a year before video gaming could be applied for. The business owner has expressed hardship and requests an amendment to allow a shorten time period to allow video gaming. Alderman Stout said it was discussed that the one-year timeframe was to ensure the business could stand alone without video gaming. This is why they felt the entire council should provide input. Alderman Dimas said that the owner did say there was hardship. They didn’t want to set a precedent for other businesses. Mayor Bovey said he’s not in favor of video gaming in general but is there a reason to make an exception based on a hardship or decrease the time to nine months. He mentioned originally video gaming was allowed because of hardship due to covid. The business owner was present and informed council he has had his liquor license for a year now. He just wants to add video gaming to help his business more. There was discussion among the aldermen on whether there should be an exception, propose an amendment to the ordinance or not allow any business to obtain their video gaming before they qualify. There was an informal vote and the majority voted that there not be an exception. Staff will check with Aldermen Birch Ferguson, Sheahan, and Myers. 14.
