The subject property is located on the east side of Charles Court, approximately 200 feet south of Washington Street, in the M Manufacturing District. The property is 1.47 acres and has a 23,000 square foot flex industrial building. The site contains 38 parking stalls with two access points on Charles Court, one of which is a shared access with the property to the south. Behind the building is a 10,500 square foot fenced in storage area. The petitioner is the contract purchaser of the property. They intend to use the property for internet based, motor vehicle sales and provide repairs and body service. Repair work will be conducted within the interior of the building. At their September 3, 2025 meeting, members of the Plan Commission voted 5-0, with two absent, in support of the proposed Special Use Permit. ACTION PROPOSED: Discuss and recommend approval of the requested Special Use Permit. Attachments: Draft Ordinance 25-O-0048 and Plan Commission Recommendation ===== PDF PAGE 49 ===== [Extraction: embedded PDF text] ORDINANCE NO. 25-O-0048 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR INTERNET BASED MOTOR VEHICLE SALES, MOTOR VEHICLE REPAIR, AND MOTOR VEHICLE BODY SHOP 391 CHARLES COURT WHEREAS, on or about September 15, 2025, Maidan Real Estate Holdings, LLC, (the “APPLICANT”), filed an application for a Special Use Permit for internet based motor vehicle sales, motor vehicle repair, and a motor vehicle body shop with respect to the property legally described on Exhibit “A” attached hereto and incorporated herein (the “SUBJECT REALTY”); and, WHEREAS, on September 22, 2025, a notice for a Public Hearing on said application was mailed to all owners of real property within 250 feet of the SUBJECT REALTY and was published in the Daily Herald, and a sign advertising the Public Hearing was installed on the SUBJECT REALTY, all as required by the ordinances of the City of West Chicago and the statutes of the State of Illinois; and, WHEREAS, the Public Hearing was conducted by the Plan Commission/Zoning Board of Appeals of the City of West Chicago on October 7, 2025; and, WHEREAS, at the Public Hearing, the APPLICANT provided testimony in support of its application, and all interested parties had an opportunity to be heard; and, WHEREAS, the corporate authorities of the City of West Chicago have received the recommendation of the Plan Commission/Zoning Board of Appeals which contains specific findings of fact, pursuant to Recommendation No.25-RC-0019, a copy of which is attached hereto as Exhibit “B” which is, by this reference, incorporated herein. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of West Chicago, Du Page County, Illinois, in regular session assembled, as follows: Section 1. DATE: October 7, 2025 PUBLIC HEARING The Plan Commission/Zoning Board of Appeals conducted a public hearing for PC 25-21 on Tuesday, October 7, 2025 in the Council Chambers of West Chicago City Hall – 475 Main Street, West Chicago, Illinois. RECOMMENDATION After a review of the requested Special Use Permit, the Plan Commission/Zoning Board of Appeals (PC/ZBA) recommended approval of the requested Special Use Permit and incorporated the following findings of fact into its recommendation: (A) The proposed uses, including internet based motor vehicle sales, motor vehicle repair, and motor vehicle body shop, are most appropriate in the M District. The subject property is surrounded by other industrial uses compatible with the proposal. (B) The proposed motor vehicle repair and body shop will occur within the structure. The building will be used for office and to store vehicle inventory. The property has an existing fenced-in outside storage area that can be used for storage of additional vehicle inventory. (C) The proposed uses will be compatible with the surrounding properties and will not negatively impact the surrounding property values. (D) The use of the subject property for internet-based motor vehicle sales, motor vehicle repair, and a motor vehicle body shop, are listed as Special Uses per Sections 11.2-4 (C), 11.2-4(E), and 11.2-4(DD) of the West Chicago Zoning Code. ORDINANCE NO. 25-O-0049 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST CHICAGO – CHAPTER 3, SECTION 3-12 (c) DECREASING CLASS O LIQUOR LICENSE WHEREAS, the Illinois Liquor Control Act, 235lLCS 5/4-1, authorizes municipalities to determine the kind and classification of liquor licenses; and WHEREAS, based on a review of Chapter 3, Section 3-12 (c), it has been determined that Class O must be decreased to reflect the current number of active licenses; and WHEREAS, the Code of Ordinances must be amended to decrease the number of available Class O Liquor Licenses. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of West Chicago, DuPage County, Illinois, in regular session assembled, as follows: Section 1. That Sec. 3-12(c) of the Code of Ordinances is hereby amended by substituting the following language for Class O liquor licenses: “(c) There shall be no more than the following number of licenses issued for each class: …………………Class O 0……………….” Section 2. That all ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance are, to the extent of such conflict, expressly repealed.
