The property contains an existing 6,500 square foot structure with an asphalt paved parking area of approximately 22,000 square feet and was most recently used as a landscape contractor's yard with outside storage (Earthcare). The City's Comprehensive Plan designates the property for Corridor Commercial use, which is consistent with, or at minimum not inconsistent with, the proposed commercial service use. The petitioner proposes to operate a Motor Vehicle Repair Shop for the repair of motor vehicles, excluding semi-trailers. All repairs will occur within the existing structure. The existing paved area will be used for vehicles waiting to be serviced or picked up. No changes to the site layout are proposed, and no outside storage will occur on the property. The Plan Commission conducted a public hearing on July 7, 2026. By a unanimous vote, the Plan Commission recommended approval of the Special Use Permit subject to the conditions listed in the attached draft Ordinance and incorporated the findings of fact identified in Exhibit B of the same supporting this recommendation. The Motor Vehicle Repair Shop is proposed on a property located in the M Manufacturing District at the southwest corner of Roosevelt Road and Town Road, an area characterized by warehousing, distribution, and other industrial and commercial service uses. Truck repair services are a practical necessity for the commercial vehicle operations concentrated in this area, and locating such a use in close proximity to those operations serves the public convenience at this location. The subject property, with its existing structure, paved parking area, and screening along Roosevelt Road, is well-suited to accommodate this use with minimal impact on surrounding properties. 2. The subject property is designed and situated to protect the public health, safety, and welfare. The existing structure will contain all repair activity, as no work shall occur outside of the building. Vehicles awaiting service or pickup are limited to designated paved areas away from the public right-of-way, and no vehicle may remain on the property for more than five days, preventing the accumulation of inoperable or abandoned vehicles. The property is further buffered by extensive landscaping and fencing along Roosevelt Road, screening operations from public view. The conditions attached to this approval collectively ensure that the use will be operated in a manner that minimizes any potential impacts on public health, safety, and welfare. 3. The proposed Motor Vehicle Repair Shop will not cause substantial injury to the value of other property in the neighborhood. The layout and footprint of the property will remain unchanged from its previous use. All repair activity will be conducted within the existing structure, ensuring no visible outdoor operations that could negatively impact surrounding properties. The five-day vehicle limit prevents the accumulation of vehicles on the property, reducing any potential for the site to take on the appearance of a salvage or storage yard. The Special Use Permit was originally approved in 2024 per Ordinance 24-O-0018. Section 5.5-8 of the Zoning Code requires a Special Use Permit to become operational within one year. A first exten- sion was granted in August 2025 via Ordinance 25-O-0037, extending the SUP to August 18, 2026. The project has been delayed pending federal approvals from the FAA and the Illinois Division of Aer- onautics, which remain outstanding. The FAA review process requires four approvals before the project can move forward. Two have been secured. The Airport Layout Plan update was approved March 30, 2026, and the ALP Regulatory Re- view was completed February 4, 2026. The airspace review is currently underway, and the environ- mental review (CATEX) remains pending with IDA behind other projects in queue. The land lease ap- plication, which is the final step, cannot be submitted until both are complete. The petitioner is re- questing a second one-year extension while those approvals are finalized. There are four primary approvals that are required to be secured: (1) update to the Airport Layout Plan (ALP), (2) airspace review, (3) environmental review, and (4) approval of the non-aeronautical lease. In 2019, Cenergy secured the approved update to the ALP, and the airspace determination. When the project was not selected for the Adjustable Grant Program, the FAA review process was put on hold. In early 2024, Cenergy contacted the FAA and the Illinois Division of Aeronautics (IDA) about starting up the regulatory review process for the DuPage Airport Solar Project. The two remaining steps were the environmental review and the approval of the non-aeronautical land use lease. IDA confirmed that, to start the environmental review process, we would need to file an Environmental Survey Request (ESR) which included a natural resource review, a cultural resource review, and a wetlands impact evaluation. The ESR was submitted in March 2024. The ESR was approved in June 2025, allowing for the submission of the environmental application known as the Categorical Exclusion (CATEX). In July 2025, Cenergy submitted a CATEX application to the IDA. After the CATEX was submitted, IDA informed Cenergy that the FAA had established a new review step since approvals were previously secured for the project in 2019. The approval, referred to as the ALP Regulatory Review would need to be completed even though the updated ALP had been approved in 2019 and the IDA confirmed that the ALP update did not expire. The CATEX could not be reviewed until the ALP Regulatory Review was completed. In October 2025, Cenergy submitted a request for an ALP Regulatory Review to the FAA. The FAA responded in an email dated January 29, 2026, confirming that it had completed the review and that it retains regulatory authority over the project. The FAA and the IDA clarified that while the ALP update had been approved in 2019, the FAA was now requiring additional information about the solar project, such as the access road, the fence line, and details of the project’s components and capacity, be provided. Cenergy submitted the new ALP update on March 12, 2026, and received approval of the ALP update on March 30, 2026. With the ALP Regulatory Review completed on February 4, 2026, Cenergy reached out to IDA with regards to the CATEX application submitted in July 2025. Coil Spring Manufacturing Company, Inc. The Deed Restriction was recorded to ensure that the grading of the property would be corrected to conform with the approved grading plans and Stormwater Management Plans for the North Industrial Park Subdivision. The Deed Restriction prohibited further development or resubdivision of the property until the grading deficiencies were resolved. The property was acquired by SFG West Chicago, LLC in 2022 and developed with a 260,000 square foot industrial building. As part of the development of this property, the required grading corrections were completed and the property now conforms with the approved Stormwater Management Plans. The conditions that gave rise to the Deed Restriction have been fully satisfied and the restriction may now be released. Per the terms of the Deed Restriction, cancellation requires a written instrument signed by both the property owner and the Mayor on behalf of the City Council, certifying that both parties have agreed to cancel the restriction. Staff is recommending the City Council authorization for the Mayor to execute the Release of Declaration of Deed Restriction on behalf of the City, to be recorded thereafter with the DuPage County Recorder.
