ITEM SUMMARY:
On December 23, 2010, a Declaration of Deed Restriction was recorded with DuPage County affecting
Lot 1 of the North Industrial Park Subdivision, commonly known as 348 Charles Court, then owned by
R.C. Coil Spring Manufacturing Company, Inc. The Deed Restriction was recorded to ensure that the
grading of the property would be corrected to conform with the approved grading plans and Stormwater
Management Plans for the North Industrial Park Subdivision. The Deed Restriction prohibited further
development or resubdivision of the property until the grading deficiencies were resolved.
The property was acquired by SFG West Chicago, LLC in 2022 and developed with a 260,000 square
foot industrial building. As part of the development of this property, the required grading corrections
were completed and the property now conforms with the approved Stormwater Management Plans.
The conditions that gave rise to the Deed Restriction have been fully satisfied and the restriction may
now be released.
Per the terms of the Deed Restriction, cancellation requires a written instrument signed by both the
property owner and the Mayor on behalf of the City Council, certifying that both parties have agreed to
cancel the restriction. Staff is recommending the City Council authorization for the Mayor to execute
the Release of Declaration of Deed Restriction on behalf of the City, to be recorded thereafter with the
DuPage County Recorder.
ACTION PROPOSED:
Review and recommendation to authorize the Mayor to execute the Release of Declaration of Deed
Restriction for Lot 1 of the North Industrial Park Subdivision, commonly known as 348 Charles Court,
to be recorded with the DuPage County Recorder.
COMMITTEE RECOMMENDATION:
The request received a unanimous favorable recommendation.
