To protect the safety of motorists, the City desires to install a traffic control device at the intersection of IL-38 (Roosevelt Road) and Technology Boulevard. The Illinois Department of Transportation (IDOT) has jurisdiction over IL-38, while the City has jurisdiction over Technology Boulevard. In 2020, State Senator Karina Villa, as part of the Public Act 102-0017, included funding for improvements associated with this traffic control device to be appropriated from the Build Illinois Bond Fund via the Illinois Department of Commerce and Economic Opportunity (DCEO). The grant agreement was fully executed by DCEO on September 27, 2023. On March 16, 2026, the City Council approved Resolution No. 26-R-0005 awarding the Traffic Signal Installation Project (Project) at IL-38 and Technology Boulevard to Helm Electric Facility Solutions, Inc. in an amount not to exceed $949,539.50. For DCEO funded projects, the City must pay for the Project costs and seek reimbursement. The City plans to pay for this Project using the Motor Fuel Tax (MFT) funds. Due to the use of MFT funds and involvement of a state route, IDOT needs to approve the award of the Project. As part of the award process, the Letter of Understanding Agreement (LOU) with IDOT is required. The LOU states that the City of West Chicago will be fully responsible for all maintenance and energy related costs for this traffic control device. The LOU is attached for reference. The City currently has eighteen (18) signalized intersections and locations with traffic control devices along State highways, not including IL-38 and Technology Blvd. These devices are maintained by IDOT, but the City is responsible for payment of a percentage of maintenance via an Intergovernmental Agreement (IGA) with IDOT. On December 20, 2021, the City Council approved Resolution No. 21-R-0101 executing an IGA with IDOT for maintenance of traffic control devices located on State highways within corporate limits of City of West Chicago, for the term of July 1, 2021, thru June 30, 2031. This IGA will also need to be modified at a future date presumably after the proposed traffic control device at IL-38 and Technology Blvd is installed. Furthermore, along with the eighteen (18) signals located on State highways, there are two (2) signals located along Main St. All these traffic control devices are equipped with Emergency Vehicle Preemption (EVP) equipment, which in an emergency, yields the right of way for emergency vehicles to pass through the intersections without stopping. On January 17, 2022, the City Council approved Resolution No. 22-R-0008 authorizing an Intergovernmental Agreement with the West Chicago Fire Protection District (WCFPD) for installation and maintenance of Emergency Vehicle Preemption Equipment within City of West Chicago. The Project also includes installation of EVP devices. As such, the IGA with WCFPD also needs to be modified at a future date. PROHIBITION OF EXCESSIVE ENGINE BRAKING NOISE PREPARED BY: Colin Fleury, Chief of Police SIGNATURE__________________________ ITEM SUMMARY: A local resident has requested installation of Excessive Engine Braking Noise Prohibited signs along Illinois State Route 59 between Augusta Ave and East Wilson St in both north and south direction. Staff believe the limits shall be extended between Conde Street and East Wilson Street. IL-59 is under the jurisdiction of Illinois Department of Transportation (IDOT). As such, staff requested approval from IDOT to install the requested signs. IDOT has requested the City to pass an ordinance or a resolution prior to installation of such signs. The attached proposed ordinance 26-O-0014 is an addition to Chapter 17, Article XVII. Schedules of Designated Streets, DIVISION 4. YIELD INTERSECTIONS; SECTIONS 17-182. PROHIBITION OF EXCESSIVE ENGINE BRAKING NOISE (1) It shall be unlawful for the driver of a commercial vehicle, as defined in Section 1-111.8 of the Illinois Vehicle Code (625 ILCS 5/1-111.8), to operate or actuate any engine braking system that emits excessive noise, which shall include the use of engine compression brakes (commonly referred to as "Jake brakes"), on any street, highway, or road within the City limits. (2) This section shall not apply to the use of an engine braking system that has an adequate sound-muffling system in proper working order that prevents excessive noise. Furthermore, this section shall not apply if the driver used an engine braking system that emits excessive noise in an emergency to avoid a collision with a person or another vehicle on the highway. (3) IL Route 59, north side between Lee Road and Heritage Woods Drive IL Route 59, north side between E. Wilson Street and Conde Street IL Route 59, south side between Heritage Woods Drive and Lee Road IL Route 59, south side between Conde Street and E. Wilson St Two of the four locations, both north and south sides, between Lee Road and Heritage Woods Dr are already equipped with the signs reading Excessive Engine Braking Noise Prohibited. These locations were previously approved by IDOT; however, an ordinance was not required then. The proposed ordinance covers existing and proposed signs. The language of the proposed ordinance and locations of the signs have preliminarily been approved by IDOT. Section 9-558 of the West Chicago Municipal Code provides the legal framework and grounds under which the Chief of Police (or designee) may temporarily or permanently remove a licensee from the authorized police towing rotation list. Grounds for removal shall include, but not be limited to, failure to be available for or respond to dispatched calls, slow response time, excessive damage claims, theft, repeated citizen complaints, inadequate service or equipment, fraud, ordinance or license agreement violations, or felony convictions of the licensee or their drivers. This proposed amendment specifically targets Section 9-558(a)(5) to refine, clarify, and legally fortify the notification and administrative appeal process when a towing operator is immediately suspended or removed from the list due to an immediate threat to public health, safety, welfare, or failure to maintain mandatory insurance coverage. The updated ordinance establishes a highly structured, legally compliant protocol to ensure due process while protecting the public's immediate safety. ACTIONS PROPOSED: Staff recommends that the Public Affairs Committee approve and recommend to the City Council the adoption of Ordinance No. 26-O-0015 COMMITTEE RECOMMENDATION: This item is going to the Public Affairs Committee on the same day as the City Council meeting.
