Staff believe the limits shall be extended between Conde Street and East Wilson Street. IL-59 is under the jurisdiction of Illinois Department of Transportation (IDOT). As such, staff requested approval from IDOT to install the requested signs. IDOT has requested the City to pass an ordinance or a resolution prior to installation of such signs. The attached proposed ordinance 26-O-0014 is an addition to Chapter 17, Article XVII. Schedules of Designated Streets, DIVISION 4. YIELD INTERSECTIONS; SECTIONS 17-182. PROHIBITION OF EXCESSIVE ENGINE BRAKING NOISE (1) It shall be unlawful for the driver of a commercial vehicle, as defined in Section 1-111.8 of the Illinois Vehicle Code (625 ILCS 5/1-111.8), to operate or actuate any engine braking system that emits excessive noise, which shall include the use of engine compression brakes (commonly referred to as "Jake brakes"), on any street, highway, or road within the City limits. (2) This section shall not apply to the use of an engine braking system that has an adequate sound-muffling system in proper working order that prevents excessive noise. Furthermore, this section shall not apply if the driver used an engine braking system that emits excessive noise in an emergency to avoid a collision with a person or another vehicle on the highway. (3) IL Route 59, north side between Lee Road and Heritage Woods Drive IL Route 59, north side between E. Wilson Street and Conde Street IL Route 59, south side between Heritage Woods Drive and Lee Road IL Route 59, south side between Conde Street and E. PROHIBITION OF EXCESSIVE ENGINE BRAKING NOISE WHEREAS, the City of West Chicago, Illinois (the “City”) is a home rule municipality in accordance with the Constitution of the State of Illinois; and WHEREAS, the City has received recent complaints of vehicles emitting excessive engine braking noises when slowing down or braking on certain streets located within the City’s limits; and WHEREAS, the City may post signs that prohibit the driver of a commercial vehicle, as defined in Section 1-111.8 of the Illinois Vehicle Code (625 ILCS 5/1-111.8), from operating or actuating any engine braking system that emits excessive noise, pursuant to the Illinois Vehicle Code (625 ILCS 5/12-602.1); and WHEREAS, the corporate authorities of the City deem it advisable and in the best interest of the health, safety, and welfare of the residents of the City to amend the City of West Chicago Municipal Code to prohibit engine braking of commercial vehicles that emit excessive noise within the City, and to post signs prohibiting excessive engine braking noise at certain locations within the City. Grounds for removal shall include, but not be limited to, failure to be available for or respond to dispatched calls, slow response time, excessive damage claims, theft, repeated citizen complaints, inadequate service or equipment, fraud, ordinance or license agreement violations, or felony convictions of the licensee or their drivers. The updated ordinance establishes a highly structured, legally compliant protocol to ensure due process while protecting the public's immediate safety. ORDINANCE NO. 26-O-0015 AN ORDINANCE AMENDING SECTION 9-558 OF CHAPTER 9, LICENSES, PERMITSAND BUSINESS REGULATIONS OF THE WEST CHICAGO MUNICIPAL CODETO SPECIFY THE CONTENTS OF NOTICES TO COMPANIES POSSESSING A POLICE TOW LICENSE WHEREAS, the City of West Chicago is a home rule unit under Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, subject to said section, a home rule unit of government may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and WHEREAS, Section 4-203 of the Illinois Vehicle Code, 625 ILCS 5/4-203, authorizes law enforcement agencies to order the towing of vehicles by a towing service that are abandoned or that in some way impede the operations of streets or highways; and WHEREAS, Section 11-60-1 of the Illinois Municipal Code, 65 ILCS 5/11-60-1, provides that the corporate authorities of municipality may fix the amount, terms, and manner of issuing and revoking licenses; and WHEREAS, Section 9-558 of the West Chicago Municipal Code should be amended to specify the language to be used in notices sent to companies possessing police tow licensees when the possibility exists that such police tow licenses may be suspended or revoked: NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of West Chicago, DuPage County, Illinois, in regular session assembled, as follows: Section 1. That Section 9-558(a)(5) of Article XX, Chapter 9 of the West Chicago Municipal Code be amended as follows (additions are indicated by underlines; deletions are indicated by strikeouts): 9-558: REMOVAL FROM POLICE TOWING LICENSEE LIST. 1. Removal of Licensee. The Chief of Police, or designee, may remove any Licensee temporarily or permanently when it is determined that: a. The License was secured by fraud or concealment of a material fact, which if known would have caused disapproval of the application. b. The service provided by the Licensee has been substantially inadequate, which shall include, but not be limited to, failing to be available for or not accepting calls, slow response time, excessive damage claims, theft, repeated complaints from citizens, inadequate services or towing equipment. d. During the term of the License, any Licensee or a tow driver: 1. Is convicted of any felony in any state; 2. Is determined to be a sex offender, as defined in Illinois law, 730 ILCS 150/2, as amended; or 3. Is convicted under the laws of Illinois or any other state of an offense that under the laws of the State of Illinois would be a felony theft of a vehicle or vehicle parts. e. If the Chief of Police, or designee, determines that a Licensee presents an immediate threat to the health, safety or welfare of the public, or if the Licensee has not provided proof of valid insurance in the amounts required by ordinance, the Chief of Police shall provide the Licensee with written notice that the Licensee is being removed from the Police Towing Licensee List immediately. Said written notice shall be delivered to the Licensee's place of business on the first day the removal is effective and shall include a short summary of the reasons for the immediate removal of the licensee from the tow list and giving the licensee an opportunity to contest the accuracy of the reasons for the removal by requesting a meeting with the Chief of Police or the Chief’s designee. The opportunity to contest the accuracy of the reasons for the tow shall be in the form of a meeting with the Chief of Police or the Chief’s designee and the licensee may contest the accuracy of the reasons for the removal of the company from the tow list. The licensee must request the meeting with the Chief or the Chief’s designee no later than seven days after the date of the written notice. The request for the meeting shall not cause the removal of the licensee from the tow list to be delayed. The licensee shall have the burden of showing by a preponderance of the evidence that the decision to remove the licensee from the towing list is based on inaccurate information. The meeting will be recorded. The decision of the Chief of Police or his or her designee shall be final and shall be in writing. The licensee may appeal the decision to the Circuit Court no later than 28 days from the date of the decision. An appeal of the decision by the licensee shall not cause a delay in the removal of the licensee from the towing list. Section 2. The primary responsibility of the Office of the Chief of Police is to provide general management direction and control for the Department. The Office of the Chief of Police consists of the Chief of Police, the Deputy Chief of Police, and the Management Analyst. The Patrol Division consists of Uniformed Patrol Officers, a Community Service Officer, and a Training Officer. A. Personnel And Police Events On June 3rd, thousands of people traveled to West Chicago to see the Union Pacific Railroad’s Big Boy Engine 4014. The Engine continues its eastward journey towards Philadelphia, then back to Cheyenne, Wyoming, where it will end its current journey on July 29th. On June 6th, the West Chicago Police Department hosted its annual Touch-A-Truck at Reed Keppler Park. Over 15 organizations donated vehicles to this well-attended event. From June 18th through the 21st, the Western DuPage Chamber of Commerce, along with the City of West Chicago, hosted its annual Railroad Days Festival at Pioneer Park. Thousands of people came out to enjoy good food, entertainment, carnival rides, and the fabulous fireworks display. On June 26th, the Police Department celebrated the Promotions of Commander Adam Reavley to Deputy Chief (Middle), Det. Sergeant Richard Langelan to Commander (Left) and Officer Alex MacDougall to Sergeant (Right). Criminal Activities Criminal Defacement: A maintenance worker in the Riverwoods Apartment complex discovered Latin King gang graffiti. There are no suspects at this time, and total damage is estimated at $40.00. Criminal Damage to Property: Officers investigated five (5) criminal damage to property cases, ranging from a car’s windshield being smashed to a broken window on a house. Retail Theft: Officers investigated four (4) Retail Thefts at four different locations around town. Stolen from the stores were cigars, nine tins of Pokémon cards, and various food items Theft of Motor Vehicle: An individual had his blue Honda sedan stolen from his driveway at 3:27 am. The victim had a tracker under his front seat, which showed his car at Cook County Hospital. Ring doorbell video footage showed two unidentifiable suspects walking down the street, then entering a vehicle and leaving southbound on Rt 59. The vehicle was located, parked, and unoccupied in the Cook County Hospital parking lot. There is no video footage of the suspects leaving the vehicle. The vehicle was processed by West Chicago Police Evidence Technicians for possible DNA. The Investigations Unit is following up. Burglary: The victim had his storage unit broken into, and several tools, including a welder and generator, were stolen. The Investigations Unit is following up. Burglary To Motor Vehicle: The victim reported that the landscaping truck that he parked overnight at the Citgo Gas Station was broken into and stolen was $4,000 U.S.C, a backpack, and his US passport. Entry was gained through the rear driver’s side door, which doesn’t lock. There are no exterior cameras that show the area where the truck was parked. Possession of Controlled Substance: On June 5, 2026, Officers Solis and Lukaszek conducted a traffic stop. While speaking with the driver, the officers discovered she was attempting to hide a glass pipe under the driver's seat. Officers obtained consent to search and located the glass pipe and confiscated a clear baggie from her purse containing a crystalline substance. She ultimately confessed to the substance being methamphetamine. The substance field-tested positive for the presence of methamphetamine. She was charged with a class 3 felony for Possession of Methamphetamine, Possession of Drug Paraphernalia, and Endangerment of a Child. She had her two-year-old child unsecured in the vehicle at the time of the stop. DCFS was notified. The child was released to the father. A. Officer Activities In June of 2026, Officers responded to a residence in the 300 block of E. Stimmel St for an individual who overdosed on heroin. Officers were directed inside by a resident and brought to the male victim, who was lying on the ground outside a bathroom door. The victim was initially not responsive and did not appear to be breathing. Based on the victim's condition, DUCOMM was notified, and medics were dispatched. Officers began chest compressions until other officers arrived on scene. Ofc MacDougall administered one dose of NARCAN. Officer Montgomery resumed chest compressions before administering the second dose of NARCAN. The victim regained a pulse and was breathing when he was transported to the ambulance, later becoming conscious in the back of the ambulance and talking to EMTs. Officers took photos of the bathroom, which contained a needle cap, unused needle, small spoon with suspected heroin, and a lighter inside. All the items were collected and submitted into evidence for destruction. At the hospital, the victim stated he had not used in over a month and was very upset with himself for putting himself in that condition in front of his family. No charges were filed at this time. In June of 2026, Officer Solis #65 was working a traffic detail at North Ave/Keil Rd. While running radar, he observed a motorcycle traveling 88mph in a 45mph zone. The motorcycle continued eastbound at over 100mph as he attempted to catch up. He caught up just west of IL- 59 after activating his emergency lights and sirens, but the vehicle did not stop, disobeying the red light at North Ave/IL-59. Knowing the motorcycle was not going to stop, Officer Solis disengaged and relayed information about it over the radio. The motorcycle was located a short time later, and Officer Solis observed that the driver was a female with brown/blonde hair, dressed entirely in light gray, and saw her face as she turned. He observed her wearing protective eyewear as well. She did not stop again and continued at a high rate of speed, circling back to IL-59, where she disobeyed the stop sign at Hahndorf and turned northbound. She quickly accelerated to over 70mph. Seeing she was not stopping. He then observed her run a red light at IL-59/North Ave and nearly collide with two vehicles. DuComm provided the female registered owner's information from a LEADS inquiry, which revealed that she had a revoked DL. Officer Solis was able to positively identify her based on the photo response and descriptors provided by the inquiry. The officer located her on Flock earlier in the day, wearing the same clothing and eyewear (Carol Stream, 2007hrs, North Ave/Schmale, and Bensenville, 1556hrs, Brookwood/Route 83). She is also observed riding the same motorcycle on several other occasions on the Flock LPR’s. Officer Solis obtained a felony Aggravated Fleeing and Eluding warrant for the offender.
