ITEM SUMMARY:
The City of West Chicago has owned and operated Underground Storage Tanks (UST) at its facility located at 135
W. Grand Lake Blvd for City's fuel needs since the 1950s.
A leaking underground storage tank (UST) incident was reported on March 26, 1997, during removal of a 2,000-
gallon UST used for the storage of gasoline. Approximately 240 cubic yards of contaminated soil and 1,900 gallons
of contaminated groundwater were removed within 45 days. However, petroleum contamination persisted in the
subsurface. Site-specific remediation objectives and an engineered barrier were informally proposed to the Illinois
EPA in the reporting at that time. These were rejected in correspondence from the Illinois EPA dated September
25, 1997, until the full extent of soil and groundwater is determined.
Since 2022, the City has worked with Resource Consulting, Inc (Resource) to complete soil sampling, soil
investigation, review analysis, development of a Corrective Action Plan (CAP), and drafting bid documents. On
November 21, 2025, the City Council approved Resolution No. 25-R-0069, authorizing an amendment to
professional environmental services with Resource for this Project. Subsequently, the City Council approved
Resolution No. 26-R-0014 with R.W. Collins Co. to address the soil contamination resulting from the leaking UST.
However, on July 10, 2026, the Illinois Environmental Protection Agency (IEPA) rejected the CAP stating the work
proposed in bids does not address the benzene, ethylbenzene, and total xylenes contamination that extends to
north of SB-19 (Soil Boring) and east of SB-20. Additional soil sampling and analysis will be required in these
directions since the soil contamination plume will most likely extent further than soil excavation proposed in these
bids. Resource notes that the additional phase of Site Investigation now required by the IEPA had previously been
proposed by Resource but was not required by the IEPA at that time.
Additional work required by this amendment will include additional soil borings and analysis to address the IEPA
comments along with construction oversight, project management and preparation of Corrective Action Completion
Report (CACR) after construction activities have been completed. Based on the project review history, once the
revisions are submitted to the IEPA, the review timeframe is approximately 4 months. It is likely that additional
remediation work may need to be added to the R.W. Collins Co. contract based on the revisions and assuming
R.W. Collins Co. will agree to additional scope. Currently, staff estimates this Project will start in the summer 2027.
The project is eligible for the recovery of certain costs through the IEPA Leaking UST Reimbursement Fund, which
requires documentation of eligible work. The exact amount of reimbursement for professional services will be
determined by the IEPA. The amount of reimbursement for the construction activities will be determined at the time
of approval of the CAP by the IEPA.
The amendment will be funded using Capital Projects Fund 08-34-53-4825 where $36,985 is available.

at 135 W. Grand Lake Blvd in an Amount Not to Exceed $12,500 for a revised Not to

Amendment to Professional Services Agreement

Resource Consulting, Inc. is requesting the approval of this amendment to the professional services
agreement between the City of West Chicago and Resource. The amendment reflects the costs for the
additional work that the Illinois Environmental Protection Agency (EPA) is requiring for the project prior
to approving the plan and budget for the corrective actions designed for the project.
The requested change order is a result of the Illinois EPA requiring additional field work and sampling
before any remedial work will be approved for reimbursement. Since the last amendment was approved in
November 2025, Resource Consulting completed the bid documents with your office and provided the
documentation of the effort to the Illinois EPA along with an updated scope of work for corrective actions.
The Illinois EPA rejected this plan recently and is requiring an additional phase of Site Investigation that
had been already proposed by Resource and rejected by the Illinois EPA in 2023. This correspondence
serves as a request for a change order to include the fees for the additional work required by the Illinois
EPA. Resource will proceed with the additional work upon the approval of this change order by the City of
West Chicago.
Project History
The leaking underground storage tank (UST) incident related to the facility was reported on March 26,
1997, during the removal of a 2,000-gallon UST used for the storage of gasoline. The presence of petroleum
contamination in the soil surrounding the UST location was apparent at the time. Early Actions activities
were performed in the form of the excavation and disposal of 240 cubic yards of contaminated soil and the
removal of 1,900 gallons of contaminated groundwater within 45 days of the reporting of the release. (A
portion of these costs were recently deemed eligible for reimbursement as described below.) The project

was deemed eligible for reimbursement with a $10,000.00 deductible by the Office of the Illinois State Fire
Marshal (OSFM) around the same time.
At the completion of the soil and groundwater removal, it was determined that petroleum contamination
persisted in the subsurface. Site-specific remediation objectives and an engineered barrier were informally
proposed to the Illinois EPA in the reporting at that time. These items were rejected in correspondence
from the Illinois EPA dated September 25, 1997, until the full extent of soil and groundwater is determined.
Resource was contacted by the City in 2006 to restart the project, but the City ultimately decided to postpone
work until 2013 when Resource was contacted again. The Stage 1 Site Investigation was completed by
Resource in 2013-2015. Project work was again halted at this time by the City.
Tim Wilcox, formerly of the City's Public Works Department, contacted Resource again in 2022 to
complete the project. This work (with the exception of the actual corrective actions) has been completed
under the existing contract and change orders. All of it has been documented in reporting on file here and
with the Illinois EPA.
Project Reimbursement
As you know, the project is eligible for the recovery of certain costs through the Illinois EPA Leaking UST
Reimbursement Fund. The reimbursement process requires the submission of comprehensive paperwork
documenting the project activities that were deemed eligible. Costs are deemed eligible during the planning
and budgeting stages of the project.
As stated previously, the budget associated with the Corrective Action Plan that includes last year's bidding
process was submitted in March 2026 and rejected in July 2026. The rejection included the additional
sampling that the Illinois EPA requires prior to approving the corrective actions. This change order includes
those fees and the related professional services - field work, data evaluation, the preparation of a CAP
Amendment, project management, and reimbursement paperwork.
Our professional services, the scope of which will be included in the Corrective Action Plan Amendment,
will be reviewed and possibly modified.
PROJECT WORK COMPLETED SINCE NOVEMBER 2025 CHANGE ORDER

Resource completed the review, data analysis, and additional documentation required by the Illinois
EPA that will be included in the next CAP.
•
Resource completed the bid document and managed the bidding process with the Department of Public
Works. Resource then prepared and submitted the CAP Amendment that included the results of the
bidding and the updated plan and budget based on the results of the bidding process including the pre-
bid meeting.

Resource Consulting continued the management of the project as questions and comments were
received from the City of West Chicago and the Illinois EPA regarding the submission.
ADDITIONAL PROJECT WORK TO BE COMPLETED
•
Resource is preparing an updated CAP Amendment that proposed the new work required by the Illinois
EPA.
•
Once the next CAP Amendment is approved by the Illinois EPA, Resource will conduct the field work
and document the results of the investigation for submission. This will include updates to the scope of
work and budget as necessary.
•
Once the update CAP Amendment for the performance of the corrective actions is approved by the
Illinois EPA, Resource will provide construction oversight and management of the actions.
•
Upon completion of the corrective actions, Resource will prepare the project's Corrective Action
Completion Report (CACR), prepare a budget amendment ifneeded, provide project management with
all parties involved, prepare final TACO calculations as required by the Illinois EPA, and complete the
additional preparation of reimbursement paperwork.
TOTAL REQUESTED ADDITIONAL PROFESSIONAL SERVICE FEES
$12,500.00
An updated summary of the project accounting since the start of this phase of the project in 2022 is attached.
TERMS OF AGREEMENT
This amendment to professional services agreement continues the work begun under the last contract dated
August 26, 2022. Please have a City official sign below to acknowledge that the General Terms and
Conditions of that contract apply to the continuation of work as outlined in this proposal.
