Mayor’s Statement on Former City Administrator Complaint

As Mayor of West Chicago, I am providing a report about issues raised in certain Freedom of Information Act requests. To be specific, the City received FOIA requests related to a settlement agreement that the City Council approved regarding a claim filed by a former employee. The claim was never discussed publicly, and little information was given to the public when the settlement agreement was voted on by the previous City Council.

In early August of 2025, I asked our City Attorney to investigate because the City was missing records related to the matter, which raised concerns. We ultimately determined that, on April 22, 2022, a former employee filed a complaint with the EEOC (Equal Employment Opportunity Commission) alleging that former City Administrator Michael Guttman had engaged in sexual harassment, discrimination based on sex, and retaliation which created a hostile work environment. On May 3, 2022, the City hired an outside law firm (Laner Muchin) to investigate. The investigator interviewed Michael Guttman, former Mayor Ruben Pineda, former Alderman Lori Chassee, former City Attorney Pat Bond, and two other attorneys for the City. Following these interviews, the outside law firm generated an investigative report. Former Mayor Ruben Pineda and Alderman Lori Chasse were provided a verbal summary of the report on July 7, 2022. While this report assessed specific allegations, it did not provide an overall finding either implicating or absolving Mr. Guttman regarding sexual harassment, discrimination or retaliation resulting in a hostile work environment. During the investigatory interviews, however, Mr. Guttman admitted to having engaged in highly inappropriate misconduct of a sexual nature while at work in City Hall.

While the investigating attorney provided the report to the former City Attorney, Pat Bond, and to former Mayor Pineda, the report was not given to the full City Council. Instead, Mr. Bond provided the City Council with a very narrow view of the report. Mr. Bond also went beyond the report’s findings stating that “there was no evidence of discrimination, sexual harassment or retaliation.” As a result, the City Council, with the possible exception of Alderman Chasse, were unaware of the specifics of the allegations and of Mr. Guttman’s admissions of actions which we believe to have constituted workplace misconduct. From these facts, some may say that certain people were trying to engage in a cover up of the underlying events.

On September 19, 2022, the employee who made the EEOC complaint and the City of West Chicago entered into a settlement. At that time, the EEOC charge was dropped. Copies of that settlement have been previously released by the City in response to FOIA requests. A legal agreement entered into by the previous city administration and signed by Mayor Pineda prohibits me from speaking about the settlement except to say, “there is a settlement agreement and its terms speak for themselves.”

Due to the handling of this issue, the Intergovernmental Risk Management Agency dropped the City’s risk management coverage. The total cost of this episode to the public, including employee time spent, cannot be easily calculated. But it is clear that close to $300,000 dollars were spent to resolve the legal components of the situation. It is with recognition of this public expenditure and the potential for a deterioration of the public trust that the current City Council is doing everything it can to be transparent and ensure accountability.

Regardless of any potential cover-up in the past, the City now has information related to employee misconduct that must be addressed. We cannot go back and undo the current contract we have with Mr. Guttman, which was entered into by the City Council without knowing all of the facts. However, we will be imposing discipline against Mr. Guttman within the confines of the existing legal and contractual obligations. We trust that the actions we take will help prevent this kind of misconduct from being repeated either in West Chicago or elsewhere.

Because of the nature of the allegations and the fact that other people are involved, we are trying to strike the correct balance between public disclosure of something we believe should have been disclosed previously, compliance with legal agreements entered into by the previous administration, and consideration of the privacy rights of all individuals involved.

The findings of the 2022 investigation represent a clear breach of trust by our former city administrator: someone entrusted with great public responsibility. The results should have been made public at the time, but they were not. The 2022 investigation results were not provided to any of the current City Council or staff members until they were obtained by the City’s current Corporate Counsel, Ancel Glink, on August 16, 2025. Since then, we have taken the time needed to gather facts and determine how we could provide accountability given the situation we were left with. The current City Council, the current staff and I are unified in our desire to treat this matter with honesty, transparency, and integrity.

These past months have been challenging, but we are moving forward. Unexpectedly, I have found that these events have brought our city council closer together. I believe we are stronger and more dedicated than ever to serving West Chicago with integrity, and putting the needs of our community first.

El investigador entrevistó a Michael Guttman, al exalcalde Ruben Pineda, a la exconcejala Lori Chassee, al exabogado de la ciudad Pat Bond, y a otros dos abogados de la Ciudad. Después de estas entrevistas, la firma de abogados externo generó un informe de investigación. El exalcalde Ruben Pineda y la exconcejala Lori Chassee recibieron un resumen verbal del informe el 7 de julio de 2022. En su lugar, el Sr. Bond proporcionó al Concejo de la ciudad una visión muy limitada del informe. El Sr. Bond también fue más allá de los hallazgos del informe declarando que “no había evidencia de discriminación, acoso sexual o represalia”. Como resultado, el Concejo de la ciudad, con la posible excepción de la exconcejala Chassee, no estaba al tanto de los detalles de las alegaciones ni de las acciones reconocidas del Sr. Guttman que creemos constituyeron conducta inapropiada en el lugar de trabajo. A partir de estos hechos, algunos podrían decir que ciertas personas estaban tratando de encubrir los hechos subyacentes.

El 19 de septiembre de 2022, el empleado que presentó la queja ante la EEOC y la Ciudad de West Chicago firmaron un acuerdo de conciliación. En ese momento, se retiró el cargo ante la EEOC. Copias de ese acuerdo han sido previamente divulgadas por la Ciudad en respuesta a solicitudes de FOIA. Un acuerdo legal ingresado por la administración de la ciudad anterior y firmado por el alcalde Pineda me prohíbe hablar sobre el acuerdo excepto para decir: “existe un acuerdo de conciliación y sus términos hablan por sí mismos”.

Debido al manejo de este asunto, la Agencia Intergubernamental de Administración de Riesgos retiró la cobertura de gestión de riesgos de la Ciudad. El costo total de este episodio para el público, incluyendo el tiempo del personal, no puede calcularse fácilmente. Pero está claro que cerca de 300,000 dólares se gastaron para resolver los componentes legales de la situación. Es en reconocimiento de este gasto público y del potencial para un deterioro de la confianza pública que el Concejo Municipal actual está haciendo todo lo posible para ser transparente y garantizar la rendición de cuentas.

Independientemente de cualquier posible encubrimiento en el pasado, la Ciudad ahora tiene información relacionada con conducta inapropiada de un empleado que debe abordarse. No podemos retroceder y deshacer el contrato actual que tenemos con el Sr. Guttman, el cual fue ingresado por el Concejo Municipal sin conocer todos los hechos. Sin embargo, impondrémos disciplina al Sr. Guttman dentro de los límites de las obligaciones legales y contractuales existentes. Confiamos en que las acciones que tomemos ayudarán a evitar que este tipo de conducta se repita en West Chicago o en otro lugar.

Debido a la naturaleza de las alegaciones y al hecho de que otras personas están involucradas, estamos tratando de lograr el equilibrio adecuado entre la divulgación pública de algo que creemos que debió haber sido revelado anteriormente, el cumplimiento de los acuerdos legales celebrados por la administración anterior, y la consideración de los derechos de privacidad de todas las personas involucradas.

Los hallazgos de la investigación de 2022 representan una clara violación de confianza por parte de nuestro exadministrador de la ciudad: alguien a quien se le confió una gran responsabilidad pública. Los resultados debieron haberse hecho públicos en ese momento, pero no fue así. Los resultados de la investigación de 2022 no fueron proporcionados a ningún miembro del Concejo de la ciudad actual ni al personal hasta que fueron obtenidos por el actual Asesor Jurídico Corporativo de la Ciudad, Ancel Glink, el 16 de agosto de 2025. Desde entonces, nos hemos tomado el tiempo necesario para reunir hechos y determinar cómo podíamos proporcionar rendición de cuentas dadas las circunstancias que heredamos. El Concejo de la ciudad actual, el personal actual y yo estamos unidos en nuestro deseo de tratar este asunto con honestidad, transparencia e integridad.

Estos últimos meses han sido desafiantes, pero estamos avanzando. Inesperadamente, he descubierto que estos acontecimientos han acercado más a nuestro concejo municipal. Creo que estamos más fuertes y más dedicados que nunca a servir a West Chicago con integridad y a poner las necesidades de nuestra comunidad en primer lugar.
